While many argue there is an unwritten rule that the president should not appoint a Supreme Court justice in the last year of his term hall says theres nothing in the constitution about that either. Hall the president who is in office should be able to appoint, whether that person is a republican or democrat. That is his, or maybe eventually, her constitutional right and constitutional duty. Even if the republicans succeed in blocking an appointee hall says it could end up hurting them in the longrun.
