And today a judge heard arguments from both sides to determine if those will be dismissed or not. Last january, Des Moines Water Works sued three siouxland counties. The utility is suing 10 drainage districts, claiming the water it receives from the Raccoon River is polluted by nitrates from ag operations located upstream in those counties. The counties Attorney Says that under iowa law, drainage districts are immune from lawsuits and therefore some of those counts should be thrown out. How law works and theyre stepping outside the bounds of rules allowed regarding drainage the Water Utility serving 500,000 customers in central iowa says it has spent more than one pointfive Million Dollars since december to remove nitrate from the water to keep it within safe drinking limits.
