News I'm Scott Simon Florida Florida Florida the 218 midterm election season rolls on in Florida recounts looming the race for governor between the Democrat Andrew Gillum and Republican Rhonda Santas a Senate seat between the incumbent Democratic Senator Bill Nelson and the Republican and current governor Rick Scott Mark Putu writes the Florida playbook for political thanks so much for being with us thanks for having me it's good to be good are there still hanging chads you know we banned those in 2001 after the disastrous 2000 presidential recount and fortunately for the state is part of the reform and it takes point 5 percent that is half a percent to go to recount so the governor's race in Florida is probably going to recount and what about the Senate race now the center 8th a lot tighter and a little more controversial actually because of some potential ballot design problems the Senate race in Florida is point $18.00 percentage points margin $14848.00 ballots and it takes point 25 percent to go to a manual recount now that's not entire manual recount of all 8000000 ballots 8200000 ballots what happened are they run the ballots to the machines and they tally them up and then all the ballots that don't record a vote because there's a quote over vote that is more than one candidate is selected or an undervote that is no candidate is selected are then manually reviewed and that gets me to the 2nd thing that I was kind of mentioning it's a little more controversial in the Senate race because it looks like bad ballot design might have cost Bill Nelson mightily because Broward County is a very Democratic county and they had a tremendous number of under votes as no one voting in the Senate race because it appears that a good number of people perhaps as. Many as 20000 might have missed the Senate race because it was in the lower left hand corner right under the instructions and if you look at the Senate race compared all the other races it got fewer votes in Broward County even compared to say the state agriculture commissioner forgive my forgive mine I have a t. But don't don't all parties weigh in on ballot design or those days I might live in an age of Pollyanna aspiration bull they have they do have the ability to at least protest they have the ability to see it at the time the ballot is sent out ahead of time to say hey here's what the ballot looks like and the Senate campaign of Bill Nelson did not complain President Trump has said there's evidence of election fraud is there evidence. So far no and in fact a governor Rick Scott who's running for Senate against Bill Nelson had given a rather extraordinary press conference believe a lost track of days might have been on a Wednesday or Thursday perhaps Thursday night and he had also mentioned that there were Democrats recall trying to steal the election and had sort of mentioned fraud and referred the matter on of the state's version of the f.b.i. How do people hold up. You know it's been really difficult the same center where families had been waiting to hear about whether their loved ones lived or died at the borderline Bar and Grill where the gunman with walked in and started shooting is now an evacuation center for people fleeing the fires and in a city where pretty much everyone knew someone or knew someone who knew someone that was in that bar it's really a lot to take yesterday the mayor of 1000 Oaks and her Fox talked about that while asking people to please heed warnings and leave if they're asked to leave Take a listen just up 48 hours ago our city experienced a tragedy that had national implications with the bass shooting in the loss of life of 13 individuals and here we are just a few last hours later not talking about another crisis right here in 1000 Oaks and now students at Pepperdine University which had students at the bar on Wednesday night are sheltering on campus as this massive fire burns closer to them. When shootings occur and alas they have occurred statistically almost every day this year people search for answers why somebody anybody would do this any more information about the gun. Well right now there's there's just a lot of speculation about the why the shooter was 28 and a Marine veteran and lives in a neighborhood right nearby and my colleague Martin Kostic spoke to people who knew him in high school who described him as an intimidating person who harass people one woman saying she was shocked by the news but not really surprised that he do something like this the sheriff here in Ventura County speculated about his mental health deputies had responded to his home in the spring and found him irate a little irrational but ultimately he was evaluated and deemed Ok not a danger to himself not a danger to others law enforcement also confirm that there is a social media post referencing the shooting that they believe is from the gunman as a matter of policy the Facebook removes quote mass murderer Facebook pages and Instagram accounts so we haven't seen the original post so really the long answer Scott is no we we still don't know why please tell us about the victims the people who were kewl. You know we've learned a lot about them from their families and their friends as they grieve them these days that have passed Cody Kaufman is a 22 year old who people say tried to protect many in the bar from the shooters only to be killed by him killed himself telemarketer follows a survivor of the Las Vegas shooting he was 27 people called him tell him he loved to line dancing which is why he was at the bar that night was country night so they had a line dancing for people 18 and over there was a college freshman up coffee shop owner a Marine veteran employees of the border line Bar and Grill and Sergeant Ron he lists from the sheriff's department he was the 1st to respond walked into the bar to stop the shooter and was killed himself he's being remembered as a hero who surely saved lives by moving in so quickly and I know that sheriff's offers us to deal with foreigners to don't think Yeah so the Ventura County Sheriff's Department is dealing with a lot mourning the loss of one of their own investigating this terrible crime and now they've spent the last day and today evacuating people from their homes in the county and trying to make sure people are safe and for a little fogl in Southern California thanks so much for being with us thank you. The American Civil Liberties Union Southern Poverty Law Center and other immigrant rights groups have filed lawsuits against the trumpet ministrations new proclamation that would deny asylum to people enter the country illegally the president signed that order yesterday before flying to France we're joined now by Lindsey Harris highest chair of the National Asylum refugee committee at the American Immigration Lawyers Association thanks very much for being with us. Thank you so much for having me. I don't know what a different footing executive order proclamation is. Well proclamations seem to be more rare they do you kind of echo of something Morial but it has basically the same effect as an executive order and how would this change would somebody who wants to apply for asylum must do. Well it's trying to bar asylum for people who enter the u.s. In between courts with entry when they when there was a will forgive me when you say in between ports of entry would some people phrase that as a legally. Yes the administration calls that illegal entry you don't call it illegal entry if it's not the report of entry. I don't I don't call it legal entry when somebody is seeking asylum because our asylum look have recognized since 1980 the right for any person who is present in the us regardless of how they got here to seek asylum and that's and it provides for them to be able to apply for asylum within their 1st year as I recall reading them all right gets That's another bar that was put in place in 1906 but you're supposed to file within one year arrival so what the administration has done this week is try to create a new bar but that actually does conflict directly with the statute with the Refugee Act from 980. Miss Harris what use are those Americans who might say look I have a world of sympathy for people who want to silence it's important for America to be that beacon in the world but come through port of entry and apply don't don't slip in over the border. Well there's a number of reasons why it's very difficult and sometimes impossible for people to come through ports of entry often they don't know they're supposed to do that people are fleeing for their lives and don't actually know what the part of the feature is or even what asylum as they just know they're trying to get to a safe place others also what we've been seeing especially in the last couple of years is people being on The Also you tend away from ports of entry even yesterday there were reports of a bridge you know between now passed on to the wires being closed down and there's also people are waiting for Dave sometimes even months at the border they're being families tend to weigh 9 times when they do walk up to a port of entry and say that they're seeking asylum and many people don't have the resources to sit and wait in Mexico and furthermore there is targeting of migrants an asylum seekers in Mexico that makes unsafe for them to stay there so there's lots of reasons why people would instead cross the river come over the border and then 10 themselves and immediately to Customs and Border Protection what would what does the law say as to what the government would authorities need to do and so much as I'm here to apply for asylum. So the law says that basically you're then supposed to be asked for questions in the questions are along the lines of Do you have a fair return if your home country are you hate seek asylum which would be tortured if you attend if somebody says yes in response to any of the questions it's supposed to be and always a mag referral to a credible fear interview which is kind of by threshold test to determine whether someone could be eligible for asylum what the Trump and the administration have kind of the last couple days is trying to take away that credible experience gave people who cross in between ports of entry and if there's no interview there's no way of gauging there there are appeal for asylum. Well yeah well actually the government does provide an other type of entry that they've made clear they're not taking away which is a reasonable stance but then people I may be eligible for a much lesser form of protection called what's called his removal rather than asylum so they're still going to be a very likely go through the process and have the whole education immigration court say nothing about this is actually going to save the government any time energy of resources Lindsey Harris professor of law co-director of the immigration clinic at the District of Columbia School of Law Thanks so much for being with us thank you very much. You know the president President Nixon understood the Constitution he understood how to govern. He knew he was walking a tight rope so when a lot of different people in Congress the public the courts stood up and showed their courage and they were outraged and started to push back he backed down. He let the investigation continue and 10 months later he resigned this time and that looks like a circus where the clowns are walking a tightrope in slow motion and some people are cheering as if it's a joke but it's not a joke Mr Doyle I must say you you sound almost almost wistful speaking about Richard Nixon Well yeah you know I've never compared Richard Nixon to Thomas Jefferson before would never thought I should but I told someone yesterday that compared to Donald Trump Richard Nixon is Thomas Jefferson. Are in a league that is your opinion do you do you believe there's a constitutional crisis of right now I do. I do I believe that. President Trump doesn't know much about governing the United States or about the u.s. Constitution he's a good argument for having the president pass a citizenship test. I guess they don't have to take it now do they come to know no . Archibald Cox for whom you work made a decision to speak directly to the American people back in 1973 before. Way I could find to cover that all up and started using drugs she got into opioids prescription pills heroin all that for a little little bit of time her family got her into treatment Nicole had been sober for 9 years when she and her husband decided to have a baby this was something she wanted to feel she told her doctor if she needed an epidural she didn't want any fentanyl in it she didn't want to feel high because I'd remembered seeing like other friends and stuff they'd used and they were feeling good and stuff and I didn't I didn't want that to be a part of my story at the girls are usually a mix of 2 types of medications and the agent and a painkiller usually fentanyl but addiction expert Dr Kelly Peiffer says it's easy to formulate one without the fentanyl there is no medical reason why someone should be forced to be exposed opioids if they don't want to pay for says there's another issue for women who are in active treatment for opiate addiction and taking methadone or suboxone some other narcotics commonly used for pain during labor can immediately reverse the effects of those treatments and suddenly in the middle labor which is already painful and now you're in the middle of the worst withdrawal of your life. Section and doctor sent her home afterward with a bottle of Percocet another opioid expert says in a situation like this ibuprofen would have been fine any parent will tell you there's nothing more stressful than 1st week of being a parent and having a baby and being in sleep deprivation and here you have a little bottle of a given that you used to turn to to make you feel better when you're stressed 1st the fires then the fat Nolen or epidural and then the percocet it was the 1st test to seeing how her sobriety and motherhood would line up I was Ok I was Ok with it it was just it just was something that happened she called a friend who's also in recovery and talked it all through she said the percocet could have sent her down a rabbit hole but it didn't she was fine leaving that behind. In a lot of people metaphorically felt it as the baby coming out of the ashy you know the life coming from the ashes and stuff and I feel that I feel like it was a big time for our community and me personally to be reborn in some way now. Well I think we came out of a pretty divisive election and that's followed by Veterans Day which is the day that we constantly thank our veterans and yet I would submit that this year it's pretty important that we find a way to overcome the polarization and one of the ways we can do that is when the country seems to think us and revere us is veterans that we can use that platform to be a bit of a civilizing force so rather than marching in parades this year we're gathering in communities around the country to do some community service where will you be or you'll be doing on Veterans Day I'll be in Charlotte North Carolina and I'll be joined by some recently resettle refugees among them a couple interpreters that served with us in Afghanistan and will be placing flags at a local cemetery and you're an aviator by training I gather I was indeed and served to have this right completing 5 tours of duty in Iraq and Afghanistan I did before you were tired why is the goal of the civil society so bored and you know I was just recently watching these election results and one of the people that I was with was actually a refugee that was resettled when she was 10 years old from Bosnia and she marveled at the fact that we have an election that is free and fair that we accept the results of and I look around my country and I see how polarized we are we need to figure out how to come together I look around my communities though and I'm hopeful I see community come together that don't ask what tribe you belong to but need to get busy knowing your neighbor helping your neighbor covered covered wars including u.s. Troops in wars I think I understand how you can work alongside someone with whom you have great differences on other issues because nothing is more important than the job that you have in front of you and looking out for each other how do you do that in civilian life. I think in civilian life one of the things that we're finding is that people are not required to talk to people that they disagree with among the ways that you do that is you gather we're gathering to conduct service and so if you're working at a homeless shelter if you're working to help former incarcerated youth or for helping in a low income neighborhood no one's asking you what your political philosophy is you might well find that that person supported a different candidate than you did and then from that opportunity to work together I think perhaps we can find some common ground. After a few months of living in my car and being terrified every night I was like Oh I think I'm ready to die think I want to die now this is you know I know a bunch of other things that kind of happened around that time to you and some of them I've kind of blocked out and some of them I remember more than I want to and. I didn't want to die I just didn't want to be in pain anymore it's a cliche but it's a very painful accurate cliche and I was driving and I passed a church with their lights on and it was a weeknight so that seemed strange and I for whatever reason turned in and they very very sweetly were like you know took me and were like Ok come here like this girl is bringing a lot into this room and we're so sweet and kind and talk with me and prayed with me and I was like yeah whatever whatever and then you know I ended up living with these women for a while and they you know took me in immediately just like we want you to be part of our family which like you know still now like makes me cry because. I just was so aware that I did not deserve that and I still struggle with when people are like I'd love to be your family or birds because I don't like what are you talking about because the wounds are so deep. I mean of course you deserve. You're a human being and you make a lot of us laugh and of course but but all that being said why do you why do you have a hard time accepting kindness from people I didn't get it for a really long time I got really really hard core opposite I just all I knew was pain and trauma and abuse and survival and not being good enough and. I spent most of my time feeling just exceptionally worthless and it was reminded I was reminded of that just really constantly for most of my life and you know it's easy to say like oh my childhood was tough oh well but what do you do when I think we all sleep under the rug and you know I've spent the last couple years just really realizing how much pain I was in as a child and I think that's true for a lot of us claim what are you doing for the holidays. You know I hate that because didn't well I get from to buy the book I did you know try to be familiar Yeah I you know I know. You know what I want to be optimistic about because this is the 1st holiday season I'll be spending with my rescue dog so.
