One of them he released one without posting bail hearing system as it was a small misdemeanor that individual's been kidnapped and I imagine is in pieces across the desert land somewhere down in Southern California so I'm just wondering you know good try what some minute there's a lot of things that go into the trial that need to be worked on the d.a. Generally and a lot of high profile cases over charges cases we have the explanation that I just get of the judge releasing this federally indicted individual charges that carry a life sentence being from a jail so it's not that I'm concerned about and the beginning stages before a trial I think is going to be looked at Campbell I would I would answer that by saying every trial is not going to go the way you think it should every trial is not going to go the way I think it should now you presented some particulars of the case here. I and my or my other listeners only know what you've told us we don't know anything else about this there may have been any reason probably was a reason maybe the reason is one that you would not find adequate but nevertheless there is much more to this than you laid the for us just now. But once again the fact of the matter is in America we do have due process that is defined as a trial that the caller in the last hour. He was talking about a capital case and he was simply saying we don't need to have a trial now what he's talking about there is a lynching when you simply go to jail and get prisoners away we don't know we need we know this guy's guilty there's an oak tree Here's a piece a rope let's do it that is not legal and if you do that you have committed murder that that is legally murder that's a lynching and the the color same to well I guess he understood what I was telling him he said he did but he said I really don't agree I was thinking myself that's scary because if there's one thing in this country we all need to agree on it's that you do not take the law into your own hands the the thing is I'm this guy in the in the in the synagogue if he'd been shot and killed while he was in the act of doing is his thing that's not the same there are people who try to draw. Analogies there it's not that you're stopping somebody in the act once they are apprehended and this is why in this day and age I don't want them apprehended because I understand that there will never be an execution so I want them shot down and killed on the spot it's the it's not as good an alternative I'd much rather have a fair trial and an execution that's what an ideal world would produce but lacking that. Burning him down to the ground as he stands is the best alternative. Well a number of your police agencies locally and across the nation have done just exactly what you explained right there they take out people they kill them they don't shoot for a lower limb they don't shoot to wound they shoot and unload the entire clip and this is happening number times here in Salinas was not just one shot it's a number of shots to kill the person so they did do that which is explaining it's a convenient way right to save money in a trial but those are the. Also it saves innocent lives because some of those people might hit the streets again at which point innocent lives are in danger right now I want to look at something like Judge John Phillips who is a high county supervisor who I know for a fact that individual to prison for a DUI There was a number of DUIs and part of the sentence didn't require but the wiser on this individual this isn't in 2015 here we're speaking about another excuse me 2012 kids are less he sent to prison why would you need to give raffle last year. But nevertheless there was a time in California when 3 members of the California State Supreme Court were voted off the court in one night. They were up for reelection and majorities of the people of California said no we don't want these people on the court anymore and they were off. So it's very serious and very real and. Ok we have an open border right now so I will recap a little bit well I'll just add a little icing to the cake I opened my program today by saying that a shooter like this guy who pulled his number at that synagogue and in Pittsburgh should be given a fair trial and executed I firmly believe that I believe that in the case of capital crime where there is no doubt of who is guilty execution is a perfectly. Acceptable thing to do it will save the public a lot of money do you want to support this guy 46 years old you want to pay to keep him in prison for another $30.00 or 40 years that will cost a lot. And also there is a deterrent value and please don't tell me that capital punishment is not a target. The reason people say that is because well where they have capital punishment they still have version crime so it doesn't deter everybody no it doesn't I concede that. You what if it gets hurt even one person. If it prevents even one potential malefactor from indulging in this sort of behavior. Then God bless it. Now there's the question problem how do we prevent innocent people from being executed and I earlier in the program I said we can do this you noticed maybe across the country Illinois I guess it was a few years ago the governor commuted the sentence of everybody who was on death row said oh there's problems with all of these I don't know what the hell Illinois uses for a system to decide who gets the death penalty or not. I don't know that I know how California used to do it and our system maybe you need. It was a really very simple and logical system worked very well. Here's how the story Suppose you were arrested for a capital crime murder Ok you're sent to trial obviously well a trial you're found either guilty or innocent if you're found innocent of course you're released and you walk free if you're found guilty of a capital crime you then go to a 2nd trial. You say wait a minute what if you've already been found guilty the 2nd trial is called a penalty trial. This is how California has administered capital punishment over the years 1st are you guilty or innocent if you're innocent so long if you're guilty then we decide what penalty you get. Remember now in the penalty trial doesn't find you guilty or innocent you're already guilty herder. But what are the circumstances where is this accident. Was it self-defense. Defense You may have even better quit at the 1st phase the point is are there are extenuating circumstances are there any orating circumstances all of that is what goes into the penalty trial that you receive if you're a capital offender here in California. And not everybody who goes to that trial gets the death sentence. The court at the penalty phase has a number of alternatives they can send you to execution they can sentence to life imprisonment and of course in California life imprisonment usually meant that in 7 years you came up for parole you might not get paroled but it was a possibility. The point being people sentenced to death in California were guilty. Absolutely certainly and probably of a more heinous crime than a simple murder. Right now we have several 100 people I think it's something like 800 people awaiting execution and same question it's ridiculous it's a joke. If I were governor we'd start running them through the smoke out. If you took one a day to take years to administer justice to all these people. And everybody would be calling me every name in the book. And I'd be saying look how much money I'm saving the taxpayers and we're eliminating the chance that any of these thieves will ever see daylight again. Would I review them yeah I would to make absolutely sure that every single person on death row fit the definition of this guy Bowers or of the that the offender Jennifer called in earlier I think or name was Jennifer called in and talked about her father who'd been killed by a guy who came in and started shooting and she in that case no doubt of who's guilty. And there are many cases where it's not a matter of oh well we think or he was there at the time no we know beyond any doubt not reasonable doubt any doubt at that point pull the lever. And final thing I don't know of any case in California where an innocent person was executed. I believe that our system of 1st trial and then a penalty trial has effectively prevented that the penalty phase does not administer capital punishment if they're not dead sure that it's merited nor should it ever be administered and leisure dead sure that it's marriage in short and they want capital punishment but I am not interested in any innocent person ever suffering execution is that possible yes yes it's possible it is possible that a few people who should be executed might not be. I can live with that. But the idea that an innocent person would go to the gas chamber that I will not put up with. And again you tell me that can't be done I tell you yes it. They're just. Being there was on hand and I'm glad they caught him and I'm glad. I think there are some unanswered questions makes me kind of speculate that perhaps this individual is not acting alone for instance how did he obtain all of the mailing addresses for these very high prominent private you would expect it to be private people for one thing the other thing there's been some issues about the condition of his van and the you know all of his propaganda and such now let it feel a bit more like Ok How were the records show on how long is how that van How did you purchase it you know if if you saw that event for years that's one thing but if you just had it like for a month or something are there something a little shaky there on how might have been purchased. Anyways it's just the just the meat to me there's still a few few questions where may not quite be as it appears but I'm actually calling about the capital punishment Ok. So you mentioned that some people say. The death penalty is not necessarily a deterrent Well now now that's true it isn't necessarily a deterrent it isn't well it isn't a deterrent in every case and. True. I want to make the point that it's the ultimate deterrent because once the death penalty is successfully issued with an individual that person will not be able to kill anyone or commit any other crimes ever again Ok that's another issue it is a guarantee it is a guarantee against recidivism Yes That's that's that's that's obvious on the face of it when I say deterrent I'm not talking in that sense I'm talking in the sense that what effect will this execution have on other people who may be contemplating similar Mal affections and I know I know I know what you mean by I had a hunch you did that what to make clear to our listeners I understand that not every murder will say oh gee there's capital punishment I better not do this but some of them will and even if it's only one in 10 if that many people can be dissuaded from committing acts of capital murder by capital punishment that I'm all for it. The other issue is a lot of anti-capital punishment. Advocates will make an argument that well gee we'll just have this person walk in just walk up and kill for the rest they're not life and they can never harm anyone else again and so forth and I call law I call b.s. On that because 1st off. Someone can always you can always have a you know liberal governor someone come in and basically you know just do an early release on somebody the other thing is they can always potentially escape and also the correctional officers and the prison staff and all but could certainly be harmed by one of these people. And the only way the other thing the only way to guarantee security would be to place these people in permanent solitary You know some place like Pelican Bay on steroids and at that point arguably you have a bigger 8 to minute issues in you look capital punishment means that cruel and unusual punishment acts what I'm talking about that's what the 8 The men. Now there's no way that you can call the death penalty cruel or unusual I mean it's been used for centuries but the idea of this exotic esoteric confinement that deprives you of all human association frankly if I had my choice between either going to get gene or spending the rest of my life like that hey bring on the blade Jack I'm ready. You know I think I want to say is it's not just the workers in the prison that might be impacted by an inmate.
