Youre2 major rulings been handed down by the Supreme Court on thursday. First, justices blocked a nationwide settlement with oxycontin maker Purdue Pharma. It would have shields and members of the Sackler Family who own the company from civil lawsuits over the toll of opioids. It would have also provided billions of dollars to combat the opioid epidemic. Second, the Supreme Court is also dismissing a case about emergency abortions in idaho temporarily clearing the way for pregnant patients to get abortion when their health is at risk. For more kron 4, Stephanie Lin spoke to law professor and political commentator jessica levinson. So the start off your could you walk us through the significance of todays ruling started with the Supreme Courts decision to provide emergency abortions. Now, does this ruling surprise you at all given the balance of the court . It doesnt because it really is a temporary ruling. So what were talking about here is a federal law that says if you walk into an emergency room, then you are entitled to necessary stabilizing treatment and necessary. Stabilizing treatment is understood under the federal law as being an abortion. If that is whats necessary to save either the life or health of the pregnant woman. Now, we also then have a state law in idaho that says only abortions to save the life of the woman. So we had this conflict. But what happened is during oral arguments, essentially both sides said, well, things are shifting a little bit where the federal government said i dont think that we actually are covering as many instances as you think, idaho, an idaho said actually are exception for when you can obtain abortions is broader. So what the justices saw is that the parties have kind of converge to the point where the court said, you know what, things are changing, go back to the lower court, sort this out. And then if you need to, you can come back to u. S. Worth noting, of course, that the 2 big abortion cases, this term, were both tossed out before the court. Got to the merits of the case is and of course, im speaking about the mifepristone cases. The other very interesting distinction that youre making there. Now in the interest of time, lets make sure that were covering the other big case at the court ruled on today. The justices rejecting a multi billion dollar Opioid Settlement involving Purdue Pharma. So can you walk us through this and the ripple impacts . Yes, so essentially what the court said is that if you want to create a settlement, then when one that looks like this one and explain a little bit what i mean by that. Dont do it through the bankruptcy reorganization process. So Purdue Pharma had declared bankruptcy, but the family behind Purdue Pharma, the Sackler Family had not. And as part of Purdue Pharmas reorganization plan under the bankruptcy code, the Sackler Family had entered into an agreement with states localities need american tribes and individuals. And agreement said essentially i will pay you this amount of money, if you will find that i can not be liable. Im immune from any further suits and what the court said with respect to that agreement is basically dont do it as part of a bankruptcy reorganization plan. Got it. Okay. So how much do you see todays rulings playing a role if at all and the debate thats happening tonight, the president ial debate. Its a great question. I think obviously reproductive choice and abortion is going to be an issue that i would expect that we will hear about in part because this is the court did it did overturn roe v wade almost exactly 2 years ago to the day. And thats obviously decision that affects a lot of women. And we did obtain im a bit of an abortion decision as we talked about. I dont expect that we would hear a lot on the National Stage given all of our other issues about the bankruptcy code. But you certainly could hear about the criminal issues facing the former president. Ok, well, we also know the Supreme Court still needs to rule on whether trump is mister trump is immune from criminal prosecution stemming from the january 6 riots. Do you see that case is one that will move voters to support another term for President Biden . So its interesting the polling indicates that it really does matter what happens in courtrooms to the voters in the sense that it did move the needle a little bit when it came to Public Opinion that the former president is now a convicted felon. And of course, were referring to the new york case in terms of the district of columbia, federal election interference case that is pending and the questions surrounding that case. Theres 2 in the Supreme Court that could affect case. And you know, will it move the needle . I mean, i think a full airing of those issues would have been useful for the voters, but frankly think whatever happens in the Supreme Court, its probably too late for that case to go to trial. Okay. So we probably do you think well hear any new developments on that case by november. Well, the Supreme Court does have to theres a decision day on friday and the decision day on monday and they do have to decide if trump is absolutely immune from criminal prosecution. If you enjoy quality a qualified immunity or no immunity at all, and they also have to determine whether or not the obstruction statute that hes our charged under is a good fit for the events of january 6, absolutely. We will hear more about those cases before monday night. All right. Fantastic will. Thank you so much for your perspective and your insight on all of this. So much more. We love to ask you, but well have to save it for another time the law professor and political commentator jessica levinson, we appreciate knowledge.
