The woman passenger was taken to the hospital and no word on her condition this morning. Both male drivers have not been released. More than 1200 customers are still without power this morning in fremont. Last night a pickup truck collided with a utility pole leaving live wires dangling in the street. Officers are blocking traffic in the area while those wires are still on the ground. Both the driver and the passenger are safe. Police arrested the driver on suspicion of driving under the influence of alcohol. It happened yesterday when they said they were working on smoke detectors in the home. Officials havent released an official explanation to how the fire started but the son of the man who died believes he knows what caused it. I would be shocked if the report from the Fire Department indicates that it was cigarette smoking. The son because of his dads smoking there were times he dropped a cigarette and burned holes in the carpet. He believes that might have been the cause in this fire that unfortunately killed his father. Crews contain the fire within an hour preventing any damage to nearby homes. In belmont a fire broke out and 1 of the units in an apartment complex and started in the kitchen of the 3rd floor while the resident was cooking. He then stepped out of the department for a few minutes when he came back he found the fire. He quickly grabbed his dog and escaped safely but he was unable to save his cat who died in the fire. Officers say just after midnight they received reports of a driver traveling the wrongway. Now the driver was heading north in the southbound lanes when he crashed head on into another vehicle instantly killing the driver and seriously injuring the passenger. The woman passenger was taken to the hospital and no word on her condition this morning. The identities of both male drivers have not yet been released. More than 1200 pg e customers are still without power this morning in fremont. Last night a pickup truck collided with a utility pole leaving live wires dangling mt. Street. Officers are blocking traffic in the area while those wires are still on the ground as safety is their top priority. Both the driver and the passenger are safe. Police arrested the driver on suspicion of driving under the influence of alcohol. Fire Officials Say a fire that killed one person in san ramon could have easily been prevented. It happened yesterday when they say there was no working smoke detectors in the home. They have not released an official explanation on how it started. I would be shocked if the report from the Fire Department didnt indicate to some degree that it was from his cigarette smoking. Crews contain the fire within an hour preventing any damage from nearby homes. In belmont a fire broke out in one of the units at an apartment complex. It started in the kitchen of the third floor unit while the resident was cooking. He then stepped out. When he came back he found his kitchen on fire. He quickly grabbed his dog and escaped safely but he was unable to save his cat who died in the fire. With so many people cooking, fire officials ask everyone to be extra careful. Definitely be very careful any time you are cooking. Dont leave things unattended on the stove. It only takes a moment for the cooking to get away from you and lead to a tragedy. Fire officials add that this type of fire is quite common and that most fires do start in the kitchen. No one was hurt when a cal train hit a car on the tracks last night in San Francisco. The accident happened around 8 00 last night. Authorities are still trying to figure out who had the right of way in that accident. And happening today coming off two road wins the San Francisco 49ers are back home to take on the Washington Redskins at levi stadium. But tonights niners game comes with controversy off the field. Protestors will be outside the stadium marching and rallying against the Washington Team name. President barack obama defended his decision to use executive authority to enact changes to the u. S. Immigration system this morning. Joining us now is political analyst michael yanki with more on this move. Lets recap the changes that obama is wanting to make. What is the biggest sticking points . The big changes, hes giving what is called deferred action. He is suspending deportation for a total of three years at a time to two new groups of undocumented immigrants. First group are parents of children who are american citizens. Or permanent residents. And second hes taken the age limit off the dreamers. Children that were brought here by their parents as undocumented immigrants. It was cut off at 31 years, now there is no age limit to that. The potential is maybe but the question is really how many of those are really going to apply. For the First Program in 2012. For the first group of children that were brought here. Maybe 5060 of those eligible apply. There is a reason behind that. The reason is that when you do that, you are essentially turning yourself into the government. You have put yourself on a list to say i came here illegally and now because i meet these certain conditions, i will apply to getth three year stay of deportation. So who does this nod include . What groups are excluded . Right. I think the Biggest Group that you heard a lot about are the parents of the dreamers. The kids that were brought here illegally and their parents who are also here were not covered by the order despite a lot of pressure by a lot of folks from the Latino Community because the idea of family union or preventing family break up was the purpose behind this entire procedure. That is not going to happen. What you will hear a lot is the word discretion. That is the president as the head executive of the country has the ability to decide who rewants to deport. What he is essentially saying is im using my discretion to excuse one group of category for a threeyear period and the other hes not going to. I think they say hay have this memo from the Legal Council and Justice Department to say he cant do an executive order upon an executive order. Quite frankly i dont buy that. Big bold move by the president. What do you think are the likelihood of republican retaliation . Well, its a question on what kind of retaliation the republicans will take . Because this is a very big political issue. This is very important to the Latino Community for coming up already on the 2016 election where latinos were critical in the election of barack obama. So you will see a lot of noise and screaming. I dont think you will see the republicans in congress there trying to take specific action against the president. What they will do is go to the courts. They will hope by making the courts be the bad person, they can wash their hands of it and say it really wasnt my fault. It was the courts who blocked the president from doing it and try to spare themselves of the political fall out. Whether or not that is believable, i dont know. They will probably look at things by blocking appointments, cutting as priorities and spending in other areas. Obama care maybe . I think obama care is up for the Supreme Court again. I dont know if they may try another run at obama care but it will be ticky tack stuff you dont necessarily see but they will the president will understand his retaliation. So his nominations may get held up for a year. Specific program that the president cares about may find itself defunded. When it applies to the immigrants but other types of priorities. There will be other things you will see all along and it will be coached in the terms of retaliation. And what do you think the impact could be here in california and also the bay area . It depends on how it effects the community. I think in terms of the practicalities. For example at the beginning of the year undocumented immigrants will be eligible for drivers licenses in california. So that is already happening. Anyone covered by this is now eligible for health care or bo ma care, social security, federal benefits. Whatever. But a lot of them are covered by health plans in the bay area by healthy San Francisco. Alameda, the bay area, etc. In terms of the burden of local government, not so much. In terms of what it means to a community to not have to worry about their parents or their families being broken up or deported or the fact that you are at a workplace and one phone call and you are out of the country. Jeff, thank you so much for joining us. This is in contra costa county. It is called a heart for christmas. What can we expect in clayton . The first thing you can expect to see that you will not see anywhere else is snow. We have brought snow to clayton in the form of some very interesting special effects that put snow on the ground and snow in the air and what we have for you is kind of a whole new world that you can enter. So we have 60,000 Christmas Lights and we have projection and water fountain and all sinked to a 20 minute light show. And so weve got our character snowball and flurry. And the families that come see this will be able to really leave contra costa and enter our make believe land of our two acre property. Well 60,000 lights. What is the electricity bill like . I cant imagine. You know its 100 led. We are set up to run 100amps of power if we need to. How did you get this idea to do this really big, Big Christmas light display . Well, when i was in college i spent most of my time at disney land. And the inspiration really came from this little girl which is is what our charity is about. I have a background in theater and lighting and film so i wanted to take the skills and put it to a good cause because i wanted to do something for the families to be able to come and enjoy but we also have this little girl that needed a lot of help. And we found that we could do an out reach with those skills. Tell me about katie. Katie grace is i believe she just turned 12. We met her when she was 6 years old. She has pulmonary hyper tension. Very rare heart and lung disease. Very difficult to treat. And the only treatment of any listening longterm value is a transplant. Transplant is not a cure within itself. It is more of a disease for a disease. Ultimately we knew her for half a decade when she wasnt supposed to live each year. What we did is we are going to do this Christmas Display to bring outreach to her. And so that is what we did. And by the grace of god i think in june she finally got herhearted and lungs. So its been really good. That is wonderful. And this is a peek of what you did last year. Actually this is exclusive video for this year. This is all brand new. Last year we put up lights and they danced to music. This year it is really to reference disney kind of microfantastic. We have a story line, a 20 minute show. Its not a drive up where you can come at any time. There is specific show times because you want to be there for the beginning, middle, end. Because its an emissional jersey. And then the great thing too is the display is for sale or parts of it; right . Yes. And all goes toward katie and supporting her and her family. Exactly. The display to come and see it is free. To make it snow on you it costs 0. 25. People would come in and say this is really cool, i havent seen lights like these anywhere else, can i take them home . Last year it wasnt an option. This year i essentially purchased extra and said these lights if you want to come and you see something you really like, you can actually take it home that day in what we call katies trading post which is a reference to frozen. This whole show is inspired by frozen which is a lot of fun. But you can purchase most, not everything, but most of the lights you see you can take home that day. And tell me about some of the behind the scenes work that goes into this. I mean you are stringing up thousands of thousands of lights and decorations. What sort of manpower is behind this project . There is about 5060 people in total that have come to help. A lot of volunteers have come from volunteereastbay. Org. And then i have a core team of people i work with. I started official design of this back in may. I have clocked Something Like 300 hours. And then i reverse my sleep schedule and live in a tent outside. Its been aned a vaneture. Come to my house and help me with mine. I just want to put lights up. Its fun. Its a lot of fun. Its been about 5060 people and then this year we have volunteers on site every day and we dont even have them all signed up yet. It will be a couple hundred people have worked on this. And you guys are also going to be donating to is it Childrens Organ Transplant Association . Yes. New this morning chp is reporting that alcohol likely played a factor in a double fatality in novato earlier this morning. Just after midnight they received reports of a driver traveling the wrong way on highway 101 near the san antonio owe road onramp. The woman passenger was taken to the hospital and no word on her condition this morning. The identities of both male drivers have not yet been released. More than 1200 pg e customers are still without power this morning in fremont. Last night a pickup truck collided with a utility pole leaving live wires in the streets. While the wires are still on the ground as safety is top priority. Both the driver and passenger are safe this morning, but police did arrest the driver on suspicion of driving under the influence of alcohol. Fire Officials Say a fire that killed one person in san ramon could have easily be prevented. It happened yesterday when they said there was no working smoke detectors in the home. Officials havent released an official explanation on how the fire started but the son of the man who died believes he knows what caused it. I would be shocked if the report from the Fire Department didnt indicate to some degree that it was from his cigarette smoking. Crews contained the fire within an hour preventing any damage to the nearby home. In belmont a fire broke out in one of the units in an apartment complex. It started in the kitchen of the third floor unit while the resident was cooking. He stepped out of the apartment for a few minutes. When he came back his kitchen was on fire. He quickly grabbed his dog and escaped safely. He was unable to save his cat who died in the fire. With so many people cooking this week for thanksgiving. They are asking fin to ever dont leave things unattended on the stove. It only takes a moment for cooking to get away from you. This type of fire is common and that most fires start in the kitchen. No one was hurt when a cal train hit a car. Happening today coming off of two road wins the San Francisco 49ers are back home to take on the Washington Redskins at levi stadium. Todays niner game comes as more controversy off the field then on it. Protestors will be outside the stadium marching and rallying against the Washington Team name. And they have one clear message they want washington ownership to change the team name. Its a name they call very offensive. This protest is just the latest to greet the washington football team. Many of the protests have popped up at some of their games. Many native americans are urging the team to change their name. Earlier this year they canceled some of the teams trademarks citing the name as disparaging. The team is appealing that decision. The teams owner Daniel Snyder is not budging to this point. Not choosing to change the teams name. Protestors want to send him a message today. I would say please take a moment and look at our people and our culture and traditions. Talk to some of us. Talk to some of us that are not in your survey. Work with us to understand to get this changed. Reporter and this morning Washington Team official declined comment on this protest but the owner Daniel Snyder said earlier this year in an espn interview he is not changing the teams name. He called it honor and respect. You can see the protest still an hour away but a few dozen protestors already gathering. Meanwhile one of the students who was wounded during that shooting says he forgives the shooter. 18yearold elijah valez is is recovering from his injuries. Valez was grazed by a bullet during thursdays cay use. The shooters motive still isnt entirely understood. Valez says he is just grateful to be alife. Authorities are interviewing a number of people who knew the shooter as they try to determine a motive. Good morning. A grand jury has been considering whether to indict the ferguson Police Officer who shot and killed unarmed teenager Michael Brown. Michael, why are we still waiting for the grand jury . There is a couple factors that go into it. First its an officer involved shooting. And stats show when there is an officer involved, grand juries take a little bit longer. Somewhere around 34 months. This is out of the ordinary for that. Second is that this is a grand jury that requires 75 of consensus of the folks to nine out of 12 to make it to make a decision to bring forth what is called a true bill. That and a lot of other jurisdictions it takes a majority. Third and this is the most controversial is that the prosecuting attorney Bob Mccullough who gained a lot of notoriety early on because of the attempts by members of the to ask him to qualify himself because his father was Police Officer killed in the line of duty. Because he himself has had a spotty record in terms of prosecuting officers in the past. Hes decided to do something entirely different. You have often heard the theory that a grand jury can indict a hand sandwich. It comes from the fact that the prosecutor and grand jury. The prosecutor only presents a certain amount of evidence that is favorable to what he wants to do in terms of the charge and that is how an indictment comes down. This is very different. Mccullough has decided he will bring everyone before the grand jury. Everybody. He let Darren Wilson the officer testify. Hes let every witness that could possibly identify testify. He has not cherry picked which ones he wants to bring. Hes even allowed the expert who did the autopsy for Michael Browns parents to come in. He hasnt directed them as to what he wants them to do. He has given them the range of charges they can look at. But he is not prosecuting within the context of getting an indictment. In many ways its a mini trial and that is very, very different. And so what are some of the options before the grand jury . I think basically they have everything from first degree murder which would be very, very hard to prove to Second Degree murder which is delivering an intent to kill. To Involuntary Manslaughter to to voluntary manslaughter to Involuntary Manslaughter. For example in the grand jury proceeding for shrimp boy and le land yee you have not heard anything. Hear you have been hearing leaks. There has been a lot of testimony that has come out. A lot of officers have been speaking on and off the records to reporters. There is a one of the things that is bothering the Community Person is the lack of integrity they see in the entire grand jury proceeding. The unusual nature of how its being conducted. That is why you see all of the unrest and that is why you see people getting very nervous. A journalist just got arrested in ferguson for allegedly breaking some peaceful demonstration law. The government already declared a state of emergency. Even though no emergency exists. There is all of this cry shown doe of i dont know anticipation, awareness, nervusness, fear. They are getting ready for the potential fallout from whatever they do decide. So tell us a little bit about the grand jury i understand it reflects the community that they are in. Yeah. Its six white men, three white women, two African American women, one African American male. Again nine of them have to agree in order to make to bring forth any kind of charge. Their term has been extended. It has been extended again. Usually around 60 days. It has been given the maximum of four months. It can go until december if need be. Everyone is convinced they would bring an indictment down last week or at least a decision down last week. No one knows what is going to happen. We to know, now know, the parents of Michael Brown have been told they will be told first. Now they have been told whether that means two minutes before the press conference begins, a day before, as soon as the grand jury reaches a decision. No one know what is that is. And govern nixon hasnt helped much saying we need 48 hours to prepare. The fact is with so many leaks in this process, once the decision that they make is made, it will get out there and then stuff is going to happen one way or another. And the grand jury doesnt indict is it over . It can be over. You can always convene a new grand jury. In this case i have no idea what will happen. Likelihood of a civil rights is minimal. Police show reportersth gun that they say the boy was using. Its described as an air soft type pellet gun that closely resembles a real handgun. Community activists gathered in new york city last night to protest another Deadly Police shooting. This comes after Authorities Say a Rookie Police officer shot and killed an innocent bystander in the dark stairwell of a housing project. The officer has since been removed from duty but the shooting comes as the nypd faces heavy scrutiny from civil rights leaders. New york mayor called the accidental shooting a tragic accident. Massachusetts state Police Arrested a man after he assaulted another man at Bostons Logan International Airport while he was naked. Police say he stripped inside of a womens bathroom, climbed into a drop ceiling, crashed through and landed on the floor and assaulted an elderly man all while naked. Police have no idea what motivated this action. The man faces multiple charges including attempted murder, mayhem, assault and battery. A Sea World Rescue Team faces an unlikely surprise. Team members say they were targeted by hecklers and someone was throwing rocks at them. Nobody was hurt but the employees say they had to leave and return to ocean beach with police protection. Costs for students will go up as much as 5 per year over each of the next five years at all ten uc schools statewide. Emani howl the 12yearold San Francisco girl that went missing two weeks ago is back home. Her father tells kron 4 they got a tip that she was on a San Francisco bus. They found her on the bus at third street and evans avenue saturday afternoon at 2 00 p. M. The girl is in Good Condition and being interviewed by investigators. Its still not clear where the girl has been but her parents are happy to have them home seam with them. This allowed Pedestrian Safety improvements and Service Reliability along the 71 route. The project will eliminate several bus stops and add curb extensions. The project supports the citys policy to eliminate all pedestrian deaths in ten years. We started the morning off in the 40s. It looks like we have warmed things up into the 50s. San francisco pretty close to 60. We are high and dry around the bay area. But honestly not too much accumulated in the south bay. Sunnyvale did pick up a quarter of an inch. We did have an opportunity to bring wet weather around the bay area and increase those totals. The good news is thanksgiving will be dry. Temperatures in the low 70s for thursday. But wet weather back in the forecast as we head into next weekend. So you just need to stick to the list and not veer off the list. What is number four . Number four is that you need to not use mental notes. So in other words this budget is only as good as the paper its written on. So you just have to have this thing with you and you have to not only include you start with the people that you want to buy gifts for, but then dont forget to add the drinks and the food for your party and for decorations, etc. Add all of that. If you have receipts from the prior year which i most people are not going to. You can put them online sames if you put them on a credit card. And use those. But at least you want to print off this budget that you used this year so you have it for next year so you have an easier start. How do you go about budgeting what you think is reasonable for the family holiday presents list . That is really tough. It certainly depends on your income. But i think that you really need to look at your whole budget. Hopefully you have one. If not, that is not too hard either and i can help anyone that wants help with that. Of course just making a budget. So it is sort of got to fit into your annual budget. Okay. All right. But some people at home might be watching weve got a list but once in awhile you do come across amazing black friday deals. Youre not saying not to shop at all on black friday; right . That is right. He is described as a caucasian man between 3040 years old. Police say he was last scene wearing an orange hooded sweat with gray and black letters before he ran off. The incident happened inside of a public bathroom at Lafayette Park in Pacific Heights. And that is the sketch there. Take a good look and call San Francisco police if you have any information.
