Basically, drivers are still innocent until proven guilty. Heres what does happen and what happened with malihan back on june 7th. For a dui, an arresting officer will take the suspects physical license away and send it to the dmv. The officer gives the driver a form, a ds367, which is a 30 day, temporary license. From that point, the driver has 10 days to contact the dmv to set up a hearing , where the department will decide whether or not to revoke driving privileges altogether. Malihan did schedule that hearing, and got her regular license back from the dmv, but the hearings not until october 18th. Also, she hasnt been convicted of a dui in court. She hasnt been proven guilty. unfortunately, she was involved in two duis in a very close proximity, and the last one resulted in the loss of life. Interestingly, the law on a drugrelated dui does not call for an arresting officer to take away a physical license or give a temporary one.
