reporter: the aclu says more african americans were arrested compared to whites last year. >> it is more likely that black people are to be arrested for marijuana possession. it is true across the country, true in california, true in san francisco. >> reporter: the sfpd is said to operate in a similar fashion to other police departments and profiles minorities using pot possession as a reason to discriminate. >> blacks are 4.3 times more likely be to be arrested than whites. >> reporter: which is hard to believe when you think about the tolerant view of marijuana use in san francisco and there are marijuana celebrations every year with thousands openly smoking weed. sfpd did not address the years of the study from 2001 to 2010 but said in 2011, the year the current chief took office, there were only 11 misdemeanor arrests for pot position in the city and nearly half of those were white. they say racial profiling is against department policy and marijuana possession charges usually come as a secondary charge for things like outstanding warrants or public intoxication. i'm jeff bush in sacramento, kron 4 news. people say crime from oakland continues to spill into the city of san leandro. but as they are telling phillipe jegal, it is leading to a decline. >> reporter: proactive police work may have prevend future crimes, crimes committed by people not liveing in the city. in the past two weeks, nor stolen cars have been recovered as well as more illegal firearms. two men were stopped on hubbard avenue. they took the men into custody for stolen property. daniel vasquez from oakland was arrested for a traffic stop. those are just a few of the example of proactive police work. police say the crime sup registration unit is oftentimes responding to crimes as they have been happening leading to arrests. on thursday from 6:00 to 7:00 at night, police here at going passing out crime prevention tips to pass along to their neighborhoods saying tackling crime is a call that alerted police to what was going on outside the homecoming dance. they made no word about sexual assault, only that there was a drunk naked girl. turns out the caller was the sister-in-law of someone near the scene but not at the scene. they also heard from officer todd keiser. he was the first to spot the girl under the picnic table. what he saw, condom wrappers, no undergarments, he believed it was a sexual assault. he said he was also the first to approach her. she did note respond. he goes onto say he shook her and she didn't move. eventually, she moved and it was at that time he knew she was alive. throughout the testimony, there was no mention of the two suspects on trial. however, there was a mention of manuel ortega. officer jeff woodson says he said i didn't rape her. she was a drunk woman. she wanted it. she wanted all of us. ortega is now serving 32 years in state prison for this rape. he is expected to testify during this trial. in martinez, dan kerman, kron 4 news. concern among customers after a pharmacy employee who worked at two east bay target stores tested positive for hepatitis a. she ate the contaminated and now recalled berries from costco. concerned customers should be aware that most symptoms don't show up until two weeks after being exposed. >> people don't know. their hands become contaminated with that. that can contaminate other
