A carson city judge is considering arguments questioning the constitutionality of nevadas School Choice or Education Savings Account program. And news 4s terri hendry joins us live from the carson City District courthouse with the latest on this. This hearing was short and sweet, you could say. Reporter well, shelby, the only argument before the district judge in this case, judge james wilson, were pretty there was no jury. The judge simply listened from the bench to arguments proand con. This lawsuit is challenging the constitutionality of the program. It was brought forward by parents concerned that this will take public money away from Public Schools. The lawyers for the parents are hoping the judge will stop the program before it is implementing. The program would give around 5,000 per student to qualifying family whose want to use that money for private school or other educational options, including home schooling. As a parent, this money is going to take money out of the Public Schools and it needs to stay in the public school. It is public funds. Reporter the Attorney Generals Office is arguing this case and theyre arguing that the presumption is the nevada laws are constitutional and that the burden of proof in a legal sense will be on the plaintiff or the challengers in this case to show there is actual harm. Implemented yet, they say that harm that they describe is just speculative. Now, theres no word on when the judge will make a ruling, but he has to hurry. The state is ready to issue checks starting in february. About 4,200 families have signed up for this program. A reno hospital says it will pay for an autopsy on a 20 yearold woman who died while on life support. She died monday at st. Marys Regional Medical center where she never woke up from anesthesia after surgery on april 126789 family Attorney Says her father wasnt told the cause of death was respiratory failure. And the Attorney Says the womans father was at the hospital and noticed she had trouble breathing even with a ventilator, but the father wasnt in the room when her heart stopped. The Attorney Says the family is making arrangements for an autopsy to determine her cause of death. And the crime watch, nevada authorities have made an arrest goes back 12 years. The detectives with the Sheriffs Office arrested pam irwin of elko in the 2003 murder of her husband james. The investigation began in december of 2003 after the family members became concerned that they had not heard from james for some time. The sheriff officials were not able to find him and it wasnt until 2015, last year, that they developed some new leads. The sheriff mike i len says thats when the detectives found a shallow grave in some foothills. They discovered remains there were those of james irwin. Throughout the day we are expecting to see those isolated and scattered snow showers, really across the region, not really looking to see much accumulation tomorrow, but Eastern Nevada, that is a different story. Reno and sparks tonight, down to 25 degrees. Were looking at cloudy skies and 50 chance of snow out in throughout the rest of the evening. Taking a look tomorrow, were looking to reach 38 degrees, which, again, not quite average, but getting closer to it. Day time highs in Eastern Nevada will see the upper 20s to the mid 30s, and then one to two inches of snow is possible in Eastern Nevada tomorrow with right winds going to be the trend across the region. Tonight in fallin, down do 25 degrees as well and topping out at 39 degrees tomorrow. If we do see any snow there, it would be a mix with the warmer day time high. Carson city looking to top out at 37 degrees with isolated snow showers possible there as well. And then around the lake were looking at scattered showers with the day time highs in the 35 degrees the glenbrook and truckee, pretty cold out there tonight, dropping down to 15 degrees. Up north in susanville, were going the see the mid 20s tonight. Across the board, the mid to upper 30s with scattered down ton valley.
