far behind. a hurricane warning is in effect for puerto rico and the u.s. virgin islands. earl is expected to become a dangerous category 3 storm later today. >> we'll have to watch for the possibility of perhaps landfall somewhere in the eastern part of the united states. although at this time, the national hurricane center is saying that probably it will make a turn to the east. but by then, it doesn't mean we're out of the woods because right behind that we have potentially another tropical system, fiona. and that could take a southern track than earl. >> cruise ships are being diverted to avoid earl and airlines have already started to cancel flights. meanwhile, residents along the gulf coast remembered a killer storm that hit five years ago -- hurricane katrina. katrina devastated new orleans, a city still trying to get back on its feet. manuel gallegus reports. ♪ amazing grace >> reporter: a french quarter funeral new orleans style for katrina. mourners say it's time to bury the old girl and with her the grief of the past five years. >> just bury the memories. >> come out and be part of the celebration. >> reporter: post-k, new orleans is a city of contrast. the government invested $15 billion to build a 350-mile perimeter of levees, flood gates and pumping stations. tourism is back in the french quarter, about 80% of what it was five years ago. and another trend, many have come here to find opportunity, like twin brothers matt and dan, who have more heating and air work than they can keep up with. >> i'm hoping this is a great neighborhood by the time we're done. >> reporter: but even as new houses are being built, it's estimated a third of the city's liveable home, some 50,000 like this one, are vacant. now the population is down about 100,000 compared to before the storm. more than 800 louisiana families are still living in fema trailers and the decaying remnants of katrina are everywhere. not just in the lower ninth ward. on this five-year anniversary, the president told a crowd at louisiana xavier university the government is committed to rebuilding. >> my administration is going to stand with you and fight alongside you until the job is done. until new orleans is all the way back. >> our lives were forever changed. >> reporter: and as the preacher told the mourners at the jazz festival, the spirit of new orleans will never be broken, come hell or high water. manuel gallegus, cbs news, new orleans. today in the gulf, engineers hope to begin removing a temporary cap that stopped the gulf oil leak. the government has ordered bp to stand by just in case the operation produces another leak. once the cap is removed, engineers hope to raise the failed blowout preventer. investigates believe the blowout preventer may explain what caused the explosion that triggered the leak. jealousy appears to have trigger add a deadly weekend shooting rampage in western arizona. they say brian diaz shot and killed five people saturday, including his ex-girlfriend, the mother of his children. diaz was barred from seeing his ex-girlfriend after he was accused of hitting their infant son. >> i guess they broke up and she had another boyfriend. i guess he come back last night and decide he was going to take them all out while they were partying. >> diaz then allegedly grabbed his children and fled to his sister's home in southern california. police say he died of a self-inflicted gunshot wound. the children were not harmed. today in chile, mining crews plan to start drilling a hole wide enough to rescue those 33 trapped miners. on sunday the miners sent new video and messages to heir families. the miners will have to clear tons of rock as the rescue shaft is drilled. if the bottom of the shaft becomes plugged, the rescue operation will be delayed. afghan president karzai had more pointed criticism of coalition strategy. karzai said this morning that coalition efforts to fight afghans insurgency have produced nothing but civilian casualties. he said there was a, quote, serious need to alter the strategy. over the weekend seven more u.s. troops were killed by insurgent attacks. 42 americans have been killed in afghanistan this month. now to the controversy over the proposed mosque near ground zero. we heard again from the religious leader spearheading the project imam faisal abdul. in an interview, he says the strong opposition is tied to the upcoming u.s. elections. many conservative candidates have used the project as a campaign issue. one person we haven't heard from is the man behind the proposed islamic center, sharif el gamal who came up with the idea and bought the property. cbs news asked him where the money was coming from. >> the money is coming from the people wanting to be involved in the project. people from all walks of life. >> reporter: you decided to draw a red line around certain organizations you won't take money from. >> we will not take money from iran. we will not take money from hamas. we will not take money from organizations that have un-american values. >> and you can see more of the interview tonight on the "cbs evening news." on the "cbs this morning after japan's central bank took action to stem the rise in the yen gaining more than 1.5% while the hang seng was mostly higher. today wall street gets the july personal income and spending report. despite a big day on friday, fears the economy could slip back into a recession put stocks in the red for the week. overall the dow lost more than 0.5% while the nasdaq slipped more than 1%. the obama administration is considering resurrecting the tax credit for first-time home buyers. the $8,000 incentive expired several months ago but the recent slump in sales has some concerned the housing market could tank again and take the economy down with it. sunday the white house's top housing official said several new programs are in the works but no decision has been reached. the government has cleared a major air merger for takeoff. the justice department said they found no anti-trust problems with the merger of united and continental airlines. shareholders still have their vote on the deal which would create the world's biggest airline. if you're looking for a new deal on a new computer, it might pay to wait a couple months. friday chipmaker intel said demand has been much weaker than expected. intel sales are a sign as a bellwether for the industry because 80% of pc companies use their chips. and sales from back-to-school shopping have been weak, meaning retailers could be forced to offer deep discounts this fall. and "the last exorcism" put a scare into moviegoers opening at number one taking in $21.3 million to win the weekend box office. behind it fellow newcomer "takers" with $21 million. and after two weekends in the top spot "the expendables" slipped to third place. betty, that is one movie will you not see me going to, the exorcism. i don't without ropes or climbing gear. it only took about 30 minutes to reach the top, where he was taken into custody. police say he will be prosecuted to the full extent of the law. some sad news this morning. a 13-year-old motorcycle racer has died after a crash at the indianapolis motor speedway. peter lenz fell off his bike and was run over by another motorcycle. the team from vancouver, washington, was hit during a warm-up lap. he was taken to the hospital where he was pronounced dead. high temperature helped create a slick track that may have contributed to the accident. lenz was a rising star in teen racing. >> he was 13 years old. very accomplished. nine national championships in various forms of two-wheel racing. had been racing with us for two full seasons. >> lenz is the youngest racer ever killed at the indianapolis motor speedway. former baseball star roger clemens will appear in court today for the first time since he was indicted by a federal grand jury. while this afternoon's hearing in washington is expected to be short, it's been anticipated for more than two years. tara mergener has more from washington. she joins us live. good morning. >> reporter: good morning, betty. today's hearing should be a simple one. clemens will be asked if he understands the charges and to enter a plea. legendary pitcher roger clemens is expected to plead not guilty today in federal court. the 48-year-old will be arraigned on six charges he lied to congress about his use of performance-enhancing drugs. >> let me be clear, i have never taken steroids or hgh. >> reporter: in 2008 before lawmakers, clemens denied taking steroids or human growth hormone but at the same hearing his former trainer brian mcnamee claimed he injected the baseball player with those drugs more than 30 times between 1998 and 2001. >> throughout the course of the years it was winstrol, also known as stanozolol, testosterone, steroids and hgh. >> reporter: the indictment charges clemens with one counted of obstruction, three counts of making false statements and two counts of perjury. federal prosecutors reportedly offered him a plea deal but he rejected. his attorney has refused to comment on the details of the proposal just saying his client is innocent. >> roger didn't use steroids. he didn't use hgh. and he didn't lie to congress about it. >> strikeout number 4,000. >> reporter: clemens stepped off the mound in 2007 after 24 seasons with major league teams, including the red sox, yankees, astros and blue jays. the seven-time cy young award winner is the third baseball player indicted for perjury, joining barry bonds whose case goes to trial next spring, and miguel tejeda who pled guilty and went on probation. along with a $1.5 million fine, clemens could face up to 30 years in prison if convicted, though most sentencing guidelines recommend 15 to 21 months. and the presiding judge says he hopes the case will go to trial by next spring. betty, >> reporter: white won an emmy for hosting "saturday night live". >> congratulations to all those winners and those nominated as well. this morning on "the early show," a look at the emmy's red carpet fashions. i'm betty nguyen. this is the "cbs morning news." fashions. i'm betty nguyen. this is the "cbs morning news." no oil has flowed into the gulf for weeks, but it's just the beginning of our work. i'm iris cross. bp has taken full responsibility for the clean up in the gulf and that includes keeping you informed. my job is to listen to the shrimpers and fishermen, hotel and restaurant workers and find ways to help. that means working with communities. we have 19 centers in 4 states. we've made over 120,000 claims payments, more than $375 million. we've committed $20 billion to an independent claims fund to cover lost income until people impacted can get back to work. we'll keep looking for oil, cleaning it up if we find it and restoring the gulf coast. i was born in new orleans. my family still lives here. bp is gonna be here until the oil is gone and the people and businesses are back to normal... until we make this right. sunday marked the fifth anniversary of hurricane katrina and its devastating effects on the gulf coast. while most of the attention went to the aftermath in new orleans, the storm first hit in a parish there which was nearly wiped off the map. as michelle miller reports, the parish is still rebuilding. >> reporter: when the surge stopped and the winds waned, peggy martin's home and garden she spent a lifetime cultivating were gone. >> inside was chaos. but it was totally -- it looked like hiroshima. >> reporter: katrina made landfall in lower plaquemines parish, accessible mostly by ferry and 65 miles south of new orleans. three people died, two of them martin's 80-year-old parents. >> they found them in the front yard over here. both about 50 yards apart. >> reporter: before katrina, about 15,000 people lived on the parish's east and south ends. today, it's about 3500. some low-lying communities look like ghosttowns. nearly 700 families are still living in mobile homes and fema trailers. oystermen gary lost his home and boat. he didn't return to the east bank fishing village for three years and says little has been done. >> this community is still devastated. >> reporter: the bulk of the more than $600 million in federal recovery money has gone to the more populated north section of the parish, leaving those in the lower section feeling neglected. do they have schools? >> no. >> reporter: do they have courthouses? >> no. >> reporter: plaquemines rebuilding its fragile infrastructure is more than a year away from being ready. levees like this one are five years behind. and this year the bp oil spill again stalled the economic life line of the parish, shutting down once bustling marinas. >> if the wildlife -- >> reporter: byron, president of louisiana's oystermen association believes the community will survive. >> this is our home. when you have nowhere else to go, you have no other choice, but to buckle down and get it done. >> reporter: there are signs of progress. a handful of public buildings have opened. churches are being rebuilt. the only restaurant, the black vel et ois velvet oyster bar in the parish, which was completely destroyed, is open. for peggy martin the devastating loss of family and home came to be symbolized in the death of her prized rose bush. it had survived a month under water but was destroyed by bulldozers cleaning up debris. or so she thought. what is this here? >> those are just weeds. >> reporter: this? >> it's alive!
