Jan crawford on the case before the Supreme Court today. Captioning sponsored by cbs this is the cbs evening news with scott pelley. Pelley good evening. This is our western edition. The new commissioner of the National Basketball association chose the nuclear option. Today, adam silver banned Los Angeles Clippers owner Donald Sterling for life and urged the rest of the nba owners to force him to sell his team. It is punishment for racist comments the 80yearold sterling admits that he made, comments condemned by president obama as incredibly offensive. Here is commissioner silver this afternoon in new york. Mr. Sterling may not attend any n. B. A. Games or practices. He may not be present at any clippers facility, and he may not participate in any business or player personnel decisions involving the team. Pelley and commissioner silver said this about the ownership of sterlings half billion dollar team. I will urge the board of governors to exercise its authority to force a sale of the team and will do everything in my power to ensure that that happens. Pelley silver would have to persuade threequarters of the n. B. A. s owners to give sterling the boot. Silver also fined the billionaire 2. 5 million, the maximum allowed by the n. B. A. Constitution. The money is to go to organizations that fight the kind of into at sterling expressed on an audio recording made public over the weekend. This is sterling speaking to his coaches and the fans to them, and pioneers of the game, like earl lloyd, chuck cooper, sweet water clifton, the great bill russell, and particularly magic johnson, i apologize. Pelley but what about an apology from Donald Sterling . Mr. Sterling acknowledged it was his voice on the tape and he has not expressed to me directly any other views. Pelley reaction was swift and seemed nearly unanimous. Carter evans is in los angeles where the clippers have a play off game tonight. Reporter n. B. A. Players and politicians watched the announcement from Los Angeles City hall and they got what they wanted. This is the defining moment in our history. Reporter former n. B. A. Allstar Kevin Johnson is now an adviser for the National Basketball players association. Today stands as one of those great moments where sports once again transcends, where sports provides a place for fundamental change on how our country should think and act. Reporter but if n. B. A. Commissioner adam silver had not acted swiftly to punish Donald Sterling for his racist remarks, the players were prepared to make a move. Roger mason is Vice President of the players association. I reached out to other players around the league and made it clear that the players were ready to boycott the games. Reporter theyre now demanding an immediate vote from team owners to oust Donald Sterling. Do you believe the board of governors will have enough support to force the sale of the team . Man, i havent heard one owner not support sterling selling this team in the media, and i cant see i know a lot of openers personally from spending time during negotiations. I would be shocked if it wasnt unanimous. Reporter reaction on social media was immediate. Dallas mavericks owner mark cuban wrote, i agree 100 with commissioner silvers findings. Magic johnson said commissioner silver showed great leadership in banning the l. A. Clippers owner for life. And lebron james said thank you for protecting our beautiful and powerful league. The web sites home page is changed to show only a team logo with the words, we are one. Protesters are planning a rally here at Staples Center tonight before the clippers take the court, but, scott, the tone of that protest is changing right now to support the team and encourage team owners to vote out Donald Sterling. Pelley carter, thanks very much. So will the owners vote sterling out . We called the other 29 n. B. A. Teams today. Most of them wouldnt comment yet but the houston rockets, sacramento kings, and the Chicago Bulls told us they support forcing sterling to sell. James brown of cbs sports is a special correspondent for cbs news. J. B. , does silver have the support of the rest of the owners . He made it clear himself, adam silver, that he had not talked to all of the owners but as in any other organization, he talked to the key owners who support and influence he can count. Pelley what might have happened if he took a half measure . Not only a boycott by the star players, the marquee players, but the rank and file were universally in agreement that any free agent would never go and play for the Los Angeles Clippers. Pelley now, silvers only been the commissioner since february. This is his first big test. I noticed today he said, i apologize. He took it on board himself. Why did he do that . Hes a man of character and integrity but number one he represents the league. Number two, he is the top face of the league. Hes been groomed for this position for quite some time and, quite frankly, everyone should have been offended. I think him being personally offended and expressing it that way speaks volumes about the man adam silver. Pelley james brown, cbs sports and special correspondent for cbs news, thanks j. B. The other big story tonight is the violent weather. This was steadman, north carolina, this afternoon, another twister in a storm system thats driving through the south and midwest. In the last three days, there have been 125 tornadoes reported and 34 deaths. Vincente arenas is in bessemer, alabama tonight. Vicente. Reporter scott, a strong line of storms is expected in Central Alabama tonight. Some of the homes here have blue tarp on them because theyve been damaged. People are now bracing for what could be another rough night of weather. This is some of the damage in jefferson county, alabama. The tornado cut a halfmile path in some places. As soon as i walked out the door, i could see debris swirling in the air outside and it was getting louder. Reporter brian gober is fire chief in kimberly. He took cover in the corner of his firehouse and used his body to shield his wife. That room shouldnt be standing. Theres no reason theres nothing special about that room as far as structural. So theres no other way to explain it other than we had a protective hand over us. Reporter two of the People Killed in alabama had refused to go to a storm shelter. Another, university of alabama swimmer john servati, died when a concrete wall collapsed on him. The National Weather system says the tornado that hit louisville, mississippi, was an ef4. The secondmostpowerful type with winds up to 190 miles per hour. You can see in this timelapse satellite image how the storm systems bloom as waves of cold, dry air over the nations midsection crashes into warm, moist air from the gulf of mexico. The Emergency Operations center in birmingham expects a threat of tornadoes well into the night. Rain has also been a big problem. Mobile, alabama, got 4. 5 inches in just an hour. Another three are expected before the night is over. Scott. Pelley more to come. Tracking the Severe Weather is eric fisher, chief meteorologist of our cbs station wbz in boston. Eric, what can we expect . Scott, were watching another very active evening of storms. The atmosphere here across the southeast is a little worked over from this morning. Thats a good thing. It decreases the volatility just a little bit but still we need to remain very vigilant as we head through the overnight. Tornadoes watch out in central, northern alabama, back towards new orleans. Also here in eastern north carolina. We had a couple of wall clouds, dangerous storms off to the east of raleigh. The area were watching tonight from the louisiana border, across the southeast, including atlanta. By the time we get toward tomorrow morning we would see a few more strong tornadoes, large hail, and widespread and severe. Tomorrow were still watching the same storm mainly along the east coast from d. C. Southward, the tornado threat is a little lower here but certainly still damaging weather. The tornado reports have been prolific. Scott, 128 reports of tornadoes this outbreak before sunday, there had only been 93 tornadoes in the entire country all year. Pelley the very latest there is extreme weather in the west as well. Southern california is in a heat wave. The temperature in los angeles tomorrow is expected to hit 95. The San Fernando Valley could reach triple digits. Along with the heat, dry, gusty winds are raising the threat of wildfires. By then, package handler liza aiken was already running. I heard something drop on the floor and i looked to my left, saw a knife laying on the ground. Reporter aiken also spotted the gunman. She recognized him as a coworker she often worked alongside in the conveyor belt. He was in all black. I believe he was in camou. He had bullet strapped to his chest like rambo, and the knife was probably a foot long. I heard a couple of pops, but i dont know what he was aiming at. I didnt look back. Reporter the gunman, identified as 19yearold geddy kramer, was also carrying explosives, molotov cocktails that he never detonated. It appeared to be a shotgun. Reporter dr. Michael nitzken said the six wounded employees were between 19 and 52 years old. Its a sense of organized chaos. Weve got the initial warning fortunately. We dont usually see this many from a shooting but as all of our training and procedures paid off, we were well prepared. Reporter the gunmans family has released a statement and scott, it reads in part, we make no excuses for his actions and we are shocked and devastated by them. Pelley mark, thank you. Today, secretary of state john kerry called on russia to leave ukraine in peace. But kerrys words and new u. S. Sanctions havent caused russia to blink. The u. S. Accuses moscow of whipping up prorussian militants who have taken over government buildings in Eastern Ukraine, a possible prelude to a russian invasion. Holly williams is there. Reporter in luhansk today, prorussian separatists seized control of the Regional Government building. As police looked on, the separatists trampled a ukrainian flag and raised a russian one in its place before moving on to the citys police headquarters, some of them armed with automatic weapons. Another uptick in violence in Eastern Ukraine. The mayor of kharkiv, gennady kernes, is fighting for his life tonight after he was shot in the back in an assassination attempt. And in donetsk, peaceful pro government demonstrators were attacked by maskedwearing separatists wielding baseball bats and batons. These Police Officers stood by and did nothing to stop them. As this separatist insurgency gains momentum, ukraines government and its Security Forces appear weak and ineffectual. The armys attempt to recapture territory from the militants outside the town of slavyansk recently came to nothing. Dmytro tkachenko is a pro government activist who we met delivering razor wire to a National Guard base after a nearby base was attacked by separatists. Do you think that the soldiers are frightened at the moment . I think that they feel something not good. And now this is one of the poorest army in the eastern europe. Reporter ukraines government is hoping to stave off civil war and stop this region from breaking away. So, scott, whats happening here is frustrating for the countrys leaders. The acting president Oleksandr Turchinov condemned the police in Eastern Ukraine today for what he called inaction, helplessness, and sometimes criminal betrayal. Pelley Holly Williams covering for us in Eastern Ukraine. Thank you, holly. Tomorrow, iraq will hold its First Nationwide elections since u. S. Withdrew in 2011. Do the police need a search warrant to look at it. An Airline Passenger looks out the window and sees an engine on fire. And well have the story of a young survivor of the tornadoes whwhen thehe cbs evenining newes pelley today the Supreme Court handed down a major ruling in an environmental case. In a 62 decision, the justifies upheld e. P. A. Rules that limit power plant pollution that blows downwind into neighboring states. Polluting states say the rules are an unfair economic burden but the e. P. A. Says they are necessary to protect health. From time to time, the law has to catch up with advances in technology. And with cell phones now more like handheld computers, the Supreme Court heard arguments today on whether the information stored on a cell phone is protected by the constitution. Heres chief Legal Correspondent jan crawford. Reporter the question before the court is whether police can automatically search through a cell phone when making an arrest, just as they would a billfold or briefcase or whether officers first need a warrant. The justices struggled to find the right approach, plying words written 200 years ago prohibiting unreasonable searches and seizures to new technology that makes personal information more readily available than the founders could ever have managed. Said Justice Elena kagan, people carry their entire lives on cell phones. Thats the world we live in. More than 90 of American Adults have a cell phone and 58 have smartphones that essentially are like minicomputers. The Obama Administration argues that cell phones are fair game during an arrest. As Justice Antonin Scalia put it, our rule has been if you carry it on your person, you ought to know it is subject to seizure and examination. But scalia indicated there should be some limits saying, it seems absurd for police to search a cell phone if theyve stopped someone for a minor traffic violation. A concern echoed by Justice Anthony kennedy. Were living in a new world. Someone arrested for a minor crime has their whole existence exposed on this little device. Now the justices also showed they were pretty savvy about technol. They were talking about twitter and facebook, and whether Police Officers could put a cell phone on airplane mode, all of this, scott, in a court that does not allow cam radz or any recording device inside, not even cell phones.
