The Sonoma County schaefers office says the body Sheriffs Office says the body was found by an employee early friday afternoon. They say it looks as though the body was in the dumpster that was then emptyied into a recycling truck. An autopsy is expected on monday. Among the bay area three biggest cities, San Francisco had the most significant increase in homicides last year and yesterday a Memorial Walk was held in honor of those murder victims. There were 68 homicides in San Francisco last year, an increase of about 1 3 compared to the Previous Year. Participants in the Memorial Walk carried crosses symbolizing each one of those killed. The walk was organized by a group affiliated with a local catholic archdiocese. And as the debate over gun control continues, big crowds and long lines filled the crossroads of the west gun show that closes today with an estimated crowd of 18,000 by the time the weekend is over. It was packed inside the cow palace. The demand was for all things gun related and it tipped unprecedented levels since lawmakers started talking about harsher gun and ammunition laws in the wake of the Mass Shootings like the one in Sandy Hook Elementary School in connecticut last month. Because of californias 10 day waiting period no one walked out of the show with guns but they did walk away carrying boxes and boxes of bullets. Authorities say the 56yearold pilot was flying from San Luis Obispo on business yesterday and didnt realize his landing gear was up until he hit the runway. He was the only person on board and wasnt injured. The airport had to be closed, though, until that plane could be moved. Last week a small plane overshot the same runway also with no injuries. In International News today, troops from four african countries expected to arrive in the west african nation in mali to join in a battle against islamic extremists. Hundreds of french soldiers began an operation on friday to push back the rebels. France is concerned about its safety of its citizens in mali as well as the danger the entire country could become a haven for alqaeda. Two days of fighting have left at least 11 civilians dead. In afghanistan seven villagers died today as they tried to pull bodies from a mosque. Overnight nato and afghan troops leading two a two hour gun fire. In the morning residents found a mosque partly destroyed and as they were digging to get people back something exploded killing seven. Its possible a suicide vest on a dead insurgent had blown up. We will have the forecast. First we will take a break. Citrus growers in the south save their crops. Well, the cold weather plaguing california has Citrus Growers in the south scrambling to save their crops. Thats right. And one kern county orchard they couldnt pick the oranges fast enough. One grower harvested only about 1 3 of his oranges before the temperatures plunged. His grove is a small part of calls californias 2 billion citrus economic but also an economic reality at work here. If the freeze destroys his crops he wont be able to employ workers. It is freezing for sure. We are even looking at possible record breaking lows . What do you think . It is really going to get down there. Theyve got a hard freeze warning in the Central Valley and that is bad news for a lot of the growers. For us in the bay area, freeze warning, temperatures down in the 20s this morning, but out the door in about an hour and a half the numbers will recover to the 30s around the bay and inland. Coast will be a little bit warmer than that, get ice on glass, not ice in glass around the bay with some ice on the windshield probably. Freeze warning posted throughout the bay area and we will see that for the next couple of nights. In fact, tonight could be colder than it is this morning. So the numbers are really down there, 24 to 34 degrees, protect the plants and pets and good luck after that. Its 27 in concord right now, oakland has got 34, livermore at 26 and 29 degrees at san jose, in santa rosa right now it is 24 degrees so that is an icy bite to start out your sunday morning. Freezing temperatures again tonight, we will get more sun tomorrow. Its drier this morning, though. The winds are out of the northwest, the general flow is out of the northwest and that being a very low humidity direction, means theres not as much moisture in the air to form ice on the windshield and it will be warming up slowly but warming up next week. On the satellite, you can see on the time lapse here that northwesterly flow off the coast, big dome of High Pressure in full command of the eastern pacific and this is as for how it usually goes. We had that series of storms and rain and a big low pressure trough that was carved out over the west coast for a while. Things just moving away as you get a deep trough in the way and then a tall crest following it so we had that detrough of low pressure. Its followed by a big dome of High Pressure and thats why for a while we are going to look for things to be sunny and chilly in the bay area and actually warming up at the end of next week. Pinpoint forecast, 26 degrees in santa rosa tonight, 36 for a low in San Francisco, san jose down to about 30 degrees, and pinpoint forecast is calling for numbers to recover to the upper 40s and low 50s in the bay area, about the same as yesterday with pittsburgh at 49 degrees, 49 at fairfield, 49 at brentwood and 50 degrees at livermore, up in the north bay numbers will be near 50 degrees and in the extended forecast, tomorrow chilly and then as we extend it to out toward the latter half of the week, looking for numbers to be in the upper 50s instead of the low 50s, so the numbers recover but only recover about a degree a day, but a week from now, by next sunday, next monday, we will be back into the 60s in the bay area. We could be talking about a heatwave, for this time of year a heat way. Thats it for weather. Lets get the latest on whats happening in the state. On thursday goffger governor jerry brown declared the state will be back in the black. And the governor is projecting Budget Surpluses now through 2017. Thats right. Now, the Legislature Still has to come up with a revision in may. Those are kind of the real numbers. These are the wish numbers. Joining us now is state senator jerry hill who from the looks of things actually brought the budget with him. I wrought it a little light reading. We got it on thursday and its been very interesting since then. Okay. Lets go back to the idea of this budget. We actually get two, this one is the one the governor sets out and thats his wish list. Yes. Thats where he wants the money to go and thats but the reality is we still have court decisions, we have fights over it and we have to find out by may whether the amount of taxes or revenues that hes projecting come in. You guys skeptical about his happy days are here again routine . Well, you know, looking at the budget, have you ever driven in europe . You know the highway signs, the speed limits in europe its considered over there philosophical concept. Thats what we see with this budget. It is his idea and realistic. Hes taking real numbers and kind of melding them into something that will work. I think its a good budget, realistic, balanced in the sense hes not spending as much money to pay back the short term debt as he was projecting last year and thats how the budget is balanced and we will see how it plays out in the future. When you say melding it into something that will work, that translates for a lot of people into these budget tricks that end up to be a totally realistic budget in the end but we hear about all of these tricks. Thats what we have seen in the past but this one is different because the numbers are you know, we are only talking about a billion dollars of deferrals or changes in the pay back of the debt but the real money is here because of the projections of income and the expenditures that are restricted from which could be more positive than they are going to actually end up to be. Absolutely, absolutely. Is there any structural change in this budget from past budgets . Because what we have done before is sort of stopped paying different things, put workers on furlough, save money that way, short gap things. Do you see anything under jerry brown that changes the structural deficit of california . The good thing is, yes, hes paying back some of the debt we had. We had about 27 billion that was used and borrowed from special funds to balance a budget in the past. That hes paying back slowly and by 2016 it will be down from about 4 billion from 27. We are paying back some of the deferrals for schools, k through 12 education, we do that trick, pay in july where they owed them in june so you could get the savings for the Previous Year and thats in here too, paying back about 2 billion. Thats what voters were sold on when they passed proposition 30 to raise taxes was the idea of more money going to education, does this fulfill that promise . It provides about 2. 7 billion more the csu and uc system and thats where a lot of the support is and the governor made a contract. I think he has a contract with the voters and hes willing to live up to that, ask them for more resources, ask them for money and taxes and you got that and hes not going to be irresponsible with that if we move forward. One thing i think is a little bit annoying to people is that and when we passed prop 30 is that it was doomsday. We were going to see duh coronaian draconian cuts and then we have a Budget Surplus. Was that crying wolf then to get everybody to back that . No. This budget has 6 billion from that tax increase so without that 6 billion we would be short that amount of money. So we needed that money to balance the budget as the governor projected earlier that we will have a balanced budget if you pass the tax increase. We were in sacramento on monday when the legislature all got back together, a lot of new members up there. You couldnt recognize half of them. But theres also i already saw the lobbyists in the halls and theres going to be a pushback to start spending money again after the years of drought and that is going to be a challenge for you folks up there. It certainly will be a challenge and i think the governor has resolved not to do that. He said it a number of times in his budget statement on thursday but there will be testing and some legislators will try to test the resolve of the governor by bringing forth proposals and some of them its hard to say no especially with the 2 3 of the Legislature Democrats and i think some proposals will go through i believe and i have confidence that the governor will veto it at the end of the day. Time for one last question. What do you see as the biggest fight this session in sacramento . Well, the biggest fight last year was pension reform and workers compensation. This year its going to be Education Funding. Who gets the money . Who gets the money . Right now we have winners and losings and at the end of the day we want to see winners and winners and not just different winners and losers and thats going to be the fight this year is over Education Funding. Which districts get it . Exactly, the governor has a proposal, he wants to find for those English Learners and low income areas and thats going to be the issue because the suburbs in many cases are they are funded differently and have a lot more money and not many people are willing to give it up. Okay. Always a tugofwar when it comes to money. State senator jerry hill thank you for joining us this morning. All this recent wet weather we have seen over the last several weeks, its turning one bay area hillside into a landslide and that is threatening the Lawrence Berkeley lab. Its caused the evacuation of building 46, closing a stretch of mcmillan road and displacing 160 employees. The building is directly in the way of all that land coming down. Several outside specialists including the u. S. Geological survey are trying to stabilize the area until they are sure that building 46 is safe from danger. On the surface it seems like the impossible has come true. We were just talking about this with jerry hill. Governor brown latest budget plans suggest the state has gone from a deep deficit to a surplus. I discussed the budget with Melissa Griffin and former mayor and state assemblyman willie brown who knows a bit about the budget goings on in sacramento. Their take on the change . Hes going to have to restrain his friends and relatives from ruining the good feel that has come with his presence and hes going to probably have to rely upon the republicans and conservative democrats to be the coalition that keeps him in place. So the supermajority for jerry brown is highly overrated. He doesnt need it. But he does appear to have the support of the republicans. Yesterday they were efuseive in the support of his budget compared to anybody, even compared to Arnold Schwarzeneggers budget. Hes the one thats going to stand between what the democrats want to spend and the republicans responsibility of fiscal responsibility. Jerry brown and got prop 30 passed on his integrity. He put himself out there and put his name on it and basically said trust me with this money and now that voters have voted to give it over to him, republicans are going to be relying on him and so are moderate democrats to rein in the spending tense dances attendances of liberal democrats. Are they part of his program as well . Are you kidding . You dont think they spent all that money and all that effort to stand by and watch yesterday . No way. They intend now to be aggressive about trying to get california back being the golden state in every category and that clearly in some cases means spending more money for certain things. Theres another thing that the governor has brought out to bring back california to its golden days. He wants to change regulations in the state. He wants to make it more business friendly. In fact, he might even be trying to change some of the environmental rules. How do you see that playing with the democrats and the republicans . Well, the republicans of course are going to be on board but this exposes one of those the main fissures that we are seeing emerge state wife, you have the fault lines are now between moderate democrats and more liberal democrats and thats going to be exposed in this effort. How do you see it going down where he says ill spend more but you have to give me breaks in work rules and things that the Business Community wants . Let me assure you again, the Teachers AssociationEnvironmental Movement and all those people that laid down their swords to come together to produce prop 30, to kill 32, they didnt do that to have things move in the direction that those two advocates that they had won would have taken people. They really do want now to be aggressive about getting back to where they were when gray davis was in power. I dont think anybody believes this Budget Surplus is either going to materialize or last very long. The democrats have already come out and said they plan to restore funding to programs in addition to whats being restored in the brown proposal. Do you think this budget deficit or i mean these golden days are going to last or is it going to be over by may . No, they will stick around for a while. Youve got to understand hes got great blessings, 38 new members of an 80 member house are brandnew, they have no idea about anything and believe me, they will eventually emerge as the power in the halls of the legislature and they are going to be jerry brown aficionados until it comes time to run for reelection and thats two years. In other words egot a little bit of a window where everybody is happen happy, 6 billion extra to work with but things have a way of returning to the way they were before and you can bet in sacramento the pressure is going to be on him. I bring experience from having been a local City Council Member and also a courtroom prosecutor and i think especially when we talk about reasonable gun safety measures, i have been a big supporter of that and ive already been working with my freshmen colleagues to take measures to protect the sacred amendment but Second Amendment but reduce gun violence in america. Gun violence obviously a very hot topic in congress. What is it like to just walk into Something Like that, a debate thats already been going on for a long time being the new kid on the block . Well, for me all im asking in congress and what im supporting is a bill that asks the rest of the country to follow what california already bans which is assault weapons and magazines with capacity beyond 10 rounds. So people in california will not be affected. We just think that the rest of the country should have to have that same type of law. Is it difficult to get credibility, though, walking in as the new guy and trying to, you know, pass Something Like that . Theres 84 new members of congress, about 45 on the left is democrats and 39 republicans and so what we want to do, we see ourselves as problem solvers. So weve done a number of weeks of orientation, ive reached across the aisle, ive made friends on both sides and i think that we both feel this new charge from the people who elected us that we cant just do it the same old way because thats not going to work anymore. No. Everybody is over it. The Approval Rating of congress is really dismal. Why would you want to join a group that is what was it . They are lower cockroaches in the polling . I didnt know it was that high. But it is, i mean, your assistant da, city council person, you had a good life going. This is going to have you back in washington monday to friday and then hopping the red eye back to the east bay and then turning around and hopping back, nonstop and then getting reelected every two years. Its not exactly a great job. Well, this is an area i know well, i grew up here and i want nothing but the best for the people who i grew up with. My father was a Police Officer and served locally and so that sense of service and going into the lions den which i understand, its a lions den but i think an avalanche takes a snowball and i can go back there, find people on the other side of the aisle and work to grow our economy, reduce our debt, get our spending under control and im up for the job and ready to get to work. Whats the vibe like back there . There is this vibe among our freshmen class that we are sent there to solve problems and i really do sense on both sides right and left, that what we just saw happen at the end of 2012 with the fiscal cliff, that that cannot be repeated. That was an absolute disaster and we have to come out of that united. Okay. Quick question. We talked about gun control. What is your other top issue as you head into the next session . My top issue is not gun safety measures. Its actually growing the local economy. Im on the Science Committee and on the Homeland Security committee and Lawrence Livermore laboratory, they are our largest employer in the district and i want to get business and government on the same page, enable Government Research to create private sector jobs because i think technology is actually allows us to work in a bipartisan way because it knows no party. The way we communicate today is through our mobile devices and our ipads, our notebooks and so lets use technology, create new jobs, move forward. Smart move. Hes on the Homeland Security and Tech Committee and hes going to get the money for Lawrence Livermore lab which is in this district, politics 101, welcome to it congressman. Thank you. Of secondhand smoke. And some of them cant do anything about it. [ continues ] [ gasping ] a little more about governor browns budget plan which he says he will leave california with a which will leave california with a Budget Surplus. In this case there could be a tugofwar evolving over those dollars and thats why we sat down with former state Assembly Leader willie brown and Melissa Griffin from the San Francisco examiner and to see our political insiders about education. I started asking melissa if california is completely out of hot water yet as far as education goes. Absolutely not. Theres still a lot of fighting to be done before we get a final budget. The Brown Administration admitted that it made some very interesting assumptions when it created this budget. It was created before we tackled the fiscal cliff in d. C. It was created before Fourth Quarter tax returns came in. It makes a lot of assumptions that may or may not pan out. As we know, every year we get a budget and then it is sometimes billions off of mark later when all the numbers come in. One thing i wanted to ask you is that its happy now and as melissa points out we still have these other financial assumptions but have you seen any change fundamentally in how california spends its money . Is it still sustainable or are we still overreaching . No. Totally sustainable. And believe me, there clearly needs to be some additional money spent in k through 12. You really do need to do something about the gap thats being created between the end product of a kid in Public School in california and in other states and one time we were in the top 10. We are now in the lower 40s and thats not good. So they are going to have to do something about that and with these resources they can. But with these resources comes the governors idea of taking some of the money, a good portion of the money and putting it to low performing schools, poor schools and places where the kids dont speak english. Thats going to pit urban and rural districts against suburban districts, isnt it . Of course. And they already are pitted against each other for various kinds of resources. Rural districts tend to be more right leaning and looks as if hes repaying some of his political allies even though that might not actually be underpinning. Where do you think that plays out . Because thats going to be a big tugofwar in you says you suburbs you get enough money, they are voters and they spend money on their schools and they are not going to be happy with the state taking it away. Reality they dont have the numbers. The population in this state has shifted towards the world of urban and believe me, every urban dweller is going to look out for the people in the urban area and those are where the low performing schools are located and they are going to get the assistance they need. They will draft the formula in such a way that it doesnt appear to be sectional. Its going to follow the student of the school on the bases of a need so if youre in fresno and you got a low performing school youre going to be as eligible as if you were in South Central los angeles for that assistance. That legislator is going to be conflicted. His rule status will be challenged in terms of whether or not he joins with los angeles to get money for that low performing school. Do you think california will ever figure out how to spend its education dollars . Seems to be two debates we dont have enough and when we do, we are not spending it right. Trying to understand the formula that they use to even determine how much money is going to schools is a ph. D. Requirement. I cant there might be three people who never seems to end. But look at our own situation. Our Community College for one example, you will have to address the needs of Community Colleges. San franciscos Community College is an example of an institution that cant seem to get its act together even though it has. Dollars equal to Community College dollars any other place. We are almost about to be without accreditation because we are misspending it, all those changes i think we are going to have to close on that one. That is a great vote of confidence. Answer, no, we will never get it together. Well, there are going to be a lot of critical eyes on Education Funding this time around, thats what prop 30 was sold on. Thats right and i think one of the compromises might be they will set a certain level of funding for all the schools and any money above that might go to the more harder pressed but even then thats going theres going to be a fight because everybody is feeling hardpressed. Numbers warming about a degree a day between now and next weekend and a lot of sun around today but through 9 00 this morning the numbers will be below freezing through many of the inland valleys and theres going to be frost and all of that stuff around today and tomorrow and probably on tuesday morning. After that, we will begin to warm up enough to get out of this. Not looking forward to seeing my pg e bill after this week. Thats right. A lot of heating going on out there. That was only one argument that walked the capitol. Republicans lined up to criticize the president s choices for defense the c. I. A. And even the treasury department. Democrats said wheres the diversity. The two sides were no closer than ever on deficit reduction. All that was as a showdown on gun control looms after the new shooting. The
