also, this has put a spotlight on the whole issue of domestic violence and how it is handled in the courts. hastings professor, george hastings joins us to shed light on it. is this case being handleled the way these cases are or is this special? >> it's pretty normal from the prosecution's standpoint, having a witness woe is recanting in a domestic violence case is not unusual at all -- >> reporter: the wife -- >> charges that have been filed are if scale to the evidence, a the leave as we have heard it publicly, so far and i think the judge's actions may be on the conservative side, but fairly normal. the one unusual thing on the defense sideshow, the defendant is seeking to exercise his rights to a speedy trial, which is pretty unusual in a misdemeanor case where the person is out of custody. >> reporter: he is accused of grabbing her arm, no one went to the hospital. he said she is no danger, yet, the judge said "you stay away until the entire court proceedings is done. that could be months. >> i characterize that on what is conservative. judges have a responsibility to protect victims, when there is an allegation of violence. it's a little conservative. >> >> reporter: another question i'm asked repeatedly is how much violence constitutes domestic violence? in other words, she said he grabbed her arm and is there any defense for it. -- . >> the statute reads the injury has to be a traumatic injury, but that can be very minimal, in fact. >> >> also, if there is a pattern. does that come into play? >> can come into play and generally speaking, if you have a pattern of past violence or more severe injuries, this particular charge can be charged as a felony or a misdemeanor? >> yep, because the injury was minor and has no criminal record. >> >> reporter: given that all and all of this going on, we have the situation of he is still a law enforcement official. can he or shoulding continue in that capacity or should he step aside? >> there is no domestic violence exception to the presumption of innocence. these constitutional protections are for these types of situations. i don't think he needs to step aside unless and until he is convicted. >> >> reporter: don't other law enforcement officials have to step aside? they take you off the street, put you on administrative duty. even a sheriff's person would be put on administrative duty >> if they were involved in a shooting and being investigated. i don't think there is any need for him to step aside at this time. there is nothing -- if he were remanded into custody before trial and it could happen, very unlikely. that would present a different situation. >> reporter: do you see him having a conflict? >> no, i kind of like squirrely. i think that pretty well covers it. it will be foggy and squirrely at candlestick. just what the 49ers need to add a few points to the spread here. as we see, increasing clouds and a chance of showers moving in. just off the coast, a band of showers that will be moving onshore here in the next hour or so. we see a lot of clouds across the bay, it day, the main feature will be the rain, we should stay light after the deluge of the last several days. this front is much weaker in comparison. in the next hour, we'll begin to see light shower activity in and around the bay as you can expect it to be with us tonight and tomorrow as well, more rain than wind tonight out of the south. and then the showers will continue and actually peak out over the we hours of the morning here into the monday morning commute. >> >> high surf advisory up for the coast, wind advisory for tonight. after the game, 10:00 to 6:00 am tomorrow, gusty winds south, 20-30-miles an hour gusting to 50, but they will be ramping up throughout the day, resulting in the squirrely conditions at candlestick. rain an wind all day long. we'll see the last of the frontal systems moving our way, we are catching the tail end of it with most of the rain to our north. but we will have an inch to an inch and a half for the other locations, -- game time, a few hundreds of an inch of rain if that. most of the moisture staying to our north, as we push through the rest of the night, we'll collect most of the accumulation as the rain picks up in intensity into the we hours of the morning. now, we'll look for temperatures to be in the mid- to low 50s for today. again, showers monday morning, drying out, beginning to warm up into and through the end of the week, here. it looks like we'll get a nice break in this wet pattern, which just reminded us what winter should look like around here, this time of the year, now, we have a nice wet day to contend with here for game day as once again, we'll see some light showers developing. there you go, phil. >> i'll go with that, squirrely as it may be. >> >> it will make for an interesting game. . od morning! newt gingrich beat mitt romny in a south carolina primary, our political analyst, joe, joining us, how rare is it to see three different winners in three different primaries. >> actually, very rare. . >> different people win in different places. i think everybody understood that mitt romny would do well in the northeast, new hampshire was not a surprise. given the candidates, it's predictable, but it's not typical. >> >> right about now in the republican lineup is when it starts to happen. democrats are start of scattered and then they go on, but in the past couple of wastes, south carolina has been where it started. this is neuter torrey for this. what does it say about the party? especially the conservative development of the party? >> ever since southern democrats in the 1960s and 1970s began to reconsider whether or not they should be democrats. these are some whose money has traced back to the civil war. ever since they reconsidered the fact they were voting for people like george wallace, an independent, instead of voting for democrats. both parties have recommended that the road to the white house goes to the south and south carolina is one of those states that matters in that equation. if you are going to win as a democrat, you have to be able to win some of the southern states like barack obama did in 2008. if you are a republican, you have to have those people because the christian -- south carolina, florida is next, how will that effect things? >> newt is flying by the seat of his pants, because he has been -- i wouldn't say making this up as he goes along. but in some ray ways, he was last to the party. but he has a recognizizable game. he comes with baggage, but he has a recognizizable name and there is no shortage of people who have deep pockets and throw big money at him if it looks like he will win. he will be competitive in florida, i think, on the advertising front, but it's still romny's to lose, he is well capitalized. in florida, he is in the facing the base that he faces in south carolina. . you are asking a very good question and the answer is in two parts. first, they are looking for someone who is not romny, primarily the driver here. less of an issue in florida. that was part of the reason he was thrown out the other thing that is important, gingrich has talked frequently about his past and said he asked for forgiveness and that's a code word in those state where they buy into that. >> >> it was the media that opened the debate with that question, if there is one thing this group likes less than questions about is the media. he turned it on the media he knows what he is playing to, he is fast. >> he recognized the same kinds of voters are looking for any reason not to vote for romny. i agree with you, it is sort of silly, but he used the forgiveness point as a way to rationalize -- >> we'll continue this situation in our next half hour of news coming up on 44 cable 12. thanks for being with us. we'll be right back. . speed rail system- reach agreement on the plan to fix the delta, improve our schools, reform our pensions and make sure prison realignment is working big promises from governor brown during his state of the state improve our schools, reform our pensions and make sure the prison line is working. >> >> big promises from governor brown during his state of the state address last week. a major theme in his annual address. california will have the funding, he says, to make the lofty projects a reality. i was up there, 5 was up there, we covered it all and sat down are our political insiders to take a look at the governor wants to pour into these projects even though he doesn't have the money. what does that mean?
