mark leno would knock simple possession of drugs such as cain, methamphetamine and heroin down from a felony charge to a misdemeanor. 13 other states have similar laws. supporters say the change could save millions of dollars, but opponents say it sends a message that drug use is not a big deal. new tonight a protest turned violent at the state capital. at least two officers were hurt after clashing with dozens of occupy oakland protesters. they were there to protest a separate rally by a pro-right group called the south africa project. san francisco police and chp were escorting them away when occupiers threw bottles and cans and rushed police. at least two occupy members were arrested. we are following a developing story in mountain view. fire crews are cleaning up after a major fire damaged several units of the dana gardens apartments. firefighters received reports of flames before 3:30 this afternoon. students at a preschool across the street were kept indoors as a precaution. as its peak the fire was elevated to four alarms. >> because there is -- it's a multiunit facility and we wanted to pro event it from extending to other units as quickly as possible. >> fire crews say five units were completely destroyed in that complex while five others suffered water damage. no injuries have been reported and the cause is not yet known. a make or break ruling today in the domestic abuse trial of the san francisco schiff. the judge ruled a key piece of evidence can be used against ross mierkarimi. phil matier tells us how it could be a game changer. >> reporter: there is no doubt about it. the trial against ross mierkarimi is hanging in the bam. but when the judge made his decision, the scales of justice tipped decidedly against the sheriff. here's the story. embattled san francisco sheriff ross mierkarimi lost his bid to toss out usual photographic evidence in his upcoming trial of the bruise he allegedly inflicted on his wife during a new year's eve fight. >> the statement of -- the should have been excluded. >> reporter: it was a make it or break it attorney for the prosecutor. >> obviously, we were pleased. we have maintained all along that this was admissible evidence and evidence that is critical to the case. >> reporter: the d.a. had good reason to be worried. wife lopez so far has refused to cooperate with police. and as stephen clark, himself a former santa clara county prosecutor noted. >> this doesn't come in, they have no case. >> reporter: mirkarimi's attorneys argued the video should be tossed for two reasons. one, it was made the day after the fight and two, it was made because mirkarimi's wife want today have evidence in case a child custody battle ever developed between the couple. in other words, that it was set up. the judge, however, disagreed saying that the taping was not staged. court watchers tell us the ruling could be a game changer. especially if wife lopez, who claims now that it was all a misunderstanding, has to take the stand. >> she has to make a decision whether she is going to testify and try to explain what she said on the tape and put a different context to it. >> reporter: the defense also raised concerns about the release of the bruise photos to the public, saying it might make it hard to get a fair trial here. >> i think it's an improper purpose to submit those. >> reporter: but the d.a. says tough as the photos may be, they are all part of the legal proceedings. >> there is always a concern when you have a trial that involves well known people within the community. >> reporter: now, the next round is going to be a judge deciding whether a former girlfriend of the sheriff's can come in and testify over allegations of previous abuse, allen. after that it's jury selection. but one way or another it looks right now like this case is going tetryl. >> phil, this is moving along very quickly? >> reporter: it is. but it's going to take about a week for them to sort things out. they are saying that jury selection could start as late as next monday. >> phil matier, thank you. well, the scandal involving alameda county supervisor nadia lockyer may involve a sex tape. reports are that it features lockyer and the man she had an affair with. that man apparently gave that to her husband and threatened to release it publicly. this happened weeks not officially asked the fbi for help. oakland police have arrested a suspected burglar who hid out for hours after exchanging gunfire with officers. that manhunt blocked off an entire neighborhood for much of the day and put a nearby school on lockdown. how the nearly four-hour search finally ended. >> reporter: as you said, it started as a burglary and next thing police knew bullets were firing. they apprehended that suspect. police say this is the man who hid out in the east oakland neighborhood for hours after a home burglary that ended in gunfire. he was armed with several guns. he did point his firearm in the direction of officers and shot at oakland police officers. >> reporter: for hours afterwards the suspect hunkered down in this neighborhood, slipping from yard to yard, tracked by a highway patrol helicopter. >> it's like a war going on here. >> reporter: chopper 5 captured a heavily armed s.w.a.t team moving in along with the arrest of a separate suspect. a possible person of interest in the crime but not believed to be the shooter. a nearby school was locked down and neighbors trying to go home were locked out. >> we can't get in. everything is just blocked everywhere we went. >> reporter: a perimeter so large oakland police were forced to bring in extra officers. street comes joined by desk comes. resources stretched so thin that officers could only respond to some crimes. at 1:40 they finally found the man cornered by cops and k-9 units blocks from the home he allegedly burglarized. now, the suspect was not armed when police arrested him. but i just got a call a short time ago and police tell me they did recover two handguns in this area. live in oakland, christin airs. tonight nearly half a dozen east bay renters find themselves victims of a housing scam. the illegal scheme that allegedly turned foreclosures into big bucks. >> reporter: dana, he is being held on $180,000 bail. the district attorney's office says this man has at least five victims. maybe as many as 20. 62-year-old alfonso salazar faces nine felony counts ranging from grand theft to perjury and burglary in what prosecutors call a sophisticated foreclosure rental scam in contra costa county. >> claiming ownership and title over properties they have no ownership right over and renting them out by basically posting an ad in craigslist and innocent people are paying two, three, four, up to six thousand dollars to rent the properties. >> reporter: salazar was a licensed realize agent until last year and worked for country wide mortgage. >> he knew thousand five checks in the mail that are going to bounce. i am waiting for them to come back. i will be charged a late charge of $20 on one. >> reporter: the fdic is assuring the former customers of home savings of america that they will get their money back as long as it's under $250,000. but as far as the debit cards not work and the bounced checks, these customers are on their own. reporting from it's safe. the federal deposit insurance corporation, or fdic, is the government agency that insureds deposits up to $250,000. they don't provide a list of problem banks. so the only way to keep tabs on your bank is to check the numbers. now, one place to look is the investigative reporting workshop website. it's a non-profit news organization that tracks the health of banks. in this case we searched home savings of america. now, the first number you want to look for is its total troubled assets. home savings has $51 million in bad loans that are unpaid or 90 days late. the next warning sign. capital assets and reserves which here only add up to about $13 million. that's how much the bank has total, and clearly not enough to cover its troubled assets. it's also showing a negative describes the moment when a teenage gunman opened fire on students inside a suburban cleveland high school. >> he pulled one shot. it made us look. >> reporter: mueller was sitting at a table with gallegos, cbs news, chardon, ohio. new at six, it looks like california's budget problems are worse than first thought. the non-partisan analyst office believes tax revenue will be $6.5 billion lower this fiscal year than what the governor predicted. however, facebook's initial stock offering would increase revenue by an estimated $500 million this year. governor brown and state lawmakers need to close the state's $9.2 billion deficit. well, even as the state budget shrinks california is spending more and more to lock up prisoners. in fact, we spend more on prisons than higher education. but where is all that cash going exactly? some of it goes to a well paid doctor who hasn't seen a patient? years. >> it's the biggest, most expensive prison system in the country gobbling up cash faster than ever. $10billion a year and growing. it cost about $45,000 a year to keep an inmate at a state prison like the one here in jamestown. about a third of that cost is health care and that's a cost that's going only to rise along with the age of the inmates. but contributing to that cost is one doctor here at jamestown who makes $239,000 a year and he doesn't treat one patient. william savage, a prison doctor, still has an office here but his name plate has been taken off the door and he hasn't treated inmates for four years. >> dr. savage is not allowed to treat inmates or provide patient care. >> reporter: why? we don't know. all they will tell us is savage is being evaluated by a peer review committee to see if he is competent to practice. however, dr. savage is collecting a paycheck and he has a tasty reputation. >> he was best known for passing out doughnuts and candy bars. >> reporter: darrell wine used to work at the prison. he says savage, better known as the doughnut doctor, was very popular with the staff. >> candy bars sometimes. ice cream. there was one time he even brought hamburgers. >> reporter: he was hired as a physicians assistant under contract. he says at more than $180,000 a year in part to backfill the duties that dr. savage couldn't perform. >> interestingly, if he needed to order something that physician would normally order he would write the order but he would have to have myself or one of the other physicians or p.a.'s sign the order. >> reporter: so why is the doctor still getting paid amid a four-year investigation. his competence as a doctor? >> civil service rules require you have to go through certain steps to terminate an employee. they cannot terminate him, but at the same time he cannot sow patients. >> reporter: he remains in legal limbo until a committee decides his fate. meantime, he makes close to $250,000 a year and comes to work at a place he is best known forehanding out doughnuts. dr. savage did not respond to multiple
