its health into a negotiated state. >> you are required to protect historic artifacts including trees if you can. we can. there is plenty of room on the west side of the tracks near el palo alto the tree and there's never been a plan by any aspect of the high-speed rail program none of the alternatives would endanger that tree. >> reporter: the tree has become the latest talking point in the community debate over high-speed rail. >> it's been around a long time, seen a lot of changes in the city. would like to see it hang around and see more changes. one of the changes not being high-speed rail. >> it's a tree. and it's a lovely tree and i would hate to see it bite the dust. but if it were a necessary thing, this would be one of the things that would have to go. >> reporter: el palo alto was recently given a check-up and despite its old age it was found to be in excellent health. so it should be around for a long time as the debate around the tracks continues. in palo alto, len ramirez, cbs 5. >> it's shaping up to be a soggy weekend for all of us in the bay area. a wet weather system moved into the area this afternoon. this is downtown san francisco earlier. roberta gonzales is in the weather center. where it's raining and the commute. >> reporter: this is not the storm of the century but it's the first winter storm of the autumn season. and as we can clearly see, the leading edge of the system is now slicing across north bay. but ahead of it we have pockets of heavy drizzle or even light precipitation right there from concord through walnut creek. you also see it lining the bay from richmond, berkeley, swinging around to oakland. the leading edge of the rain is now just on the outskirts of terra linda moving towards san rafael. all this will be sliding towards the golden gate bridge and then eventually surrounding the entire bay area. hardest hit now happens to be the santa rosa area back in through petaluma into sonoma. now we will have heavier precipitation. the amount usually expected between now and sunday when the snowflakes are going to fall in our local mountains. >> thank you. a 14-year-old boy killed two teenagers in a crash this morning at 12 a.m. on ocean avenue in san francisco. five teens were in the car when it sped off the roadway. the two passengers who died were actually thrown out of the car. another passenger was rushed to the hospital with life- threatening injuries. that 14-year-old driver by the way now facing vehicular manslaughter charges. there was a serious event that looked like a stunt but five people in four cars were history. rick villaroman shows us how it all happened. >> the mustang literally probably driving about 90 miles an hour and then he -- >> he fishtailed me here. the car was off the pavement. he kind of slammed into the back of the green car. >> i hear you know a lot of cars just metal twisting and all of a sudden the cab smashed into us -- >> reporter: it looks like the driver of the mustang went for the joyride of his life down the streets of san francisco ending up here at powell and sutter streets. it wasn't even his car. bouncing down the street of san francisco. sound familiar? the popular movie called bullitt with steve mcqueen comes to life and in real life people get hurt. chris was in this parked car. >> my neck cranked a little bit. and i kind of got a little pain a little bit but i managed. >> reporter: other people weren't so lucky. in all, five people were transported to local hospitals with nonlife-threatening injuries. hurt yes, killed no. >> this can be fixed. >> reporter: and that's the real luck here at union square. in san francisco, rick villaroman, cbs 5. a teenaged girl brutally assaulted during a homecoming dance blacked out during the attack from drinking brandy. that according to a nurse who testified at a preliminary hearing today. 7 suspects accused of raping the girl were escorted into court this morning for a fifth day of testimony. the nurse also said the girl suffered head trauma so severe, her entire face was swollen. the suspects range in age from 16 to 43. all but one faces life behind bars if convicted. parole agents and deputies conducted early-morning raids in contra costa county part of a statewide sex offender sweep that think call operation safe playground. the goal to make sure sex offenders and parolees are living where they are registered. authorities authorities have arrested 400 people so far. hundreds of police attended a memorial for former san francisco police chief alex fagan. he died at 60 years opened from a heart attack. he retired in 2004 after 31 years of service. next, two bay area moms allegedly go on a shopping spree and you wouldn't believe where police say they got their money. how they were caught allegedly stealing from their children's school. >> and growing outrage over new security procedures at the airport. who won't have to go through the patdown procedure. have you started putting together the thanksgiving shopping list? thousands of dollars disappeared from a san jose elementary school. and the suspects? the mothers of two students. they accused of pocketing $30,000 in school donation. mark sayre shows us the expenses that raised some suspicions. >> reporter: parents arriving at julia baldwin elementary school to drop off their kids were shocked by the news. two former leaders of the school fundraising club face felony charges for allegedly stealing $30,000 in donations which were supposed to benefit all students here. >> it's just sad. you people volunteer, you don't know who they are. you trust, you know, your money with them basically is what it is. and it just happens. you don't know. >> reporter: the santa clara county district attorney's office is charging 42-year-old jennifer vazquez and 28-year- old wendi hayes with felony grand they have. they allegedly stole money from the home and school club, which relies on donation from parents to help pay for school programs and supplies. but credit card charges to retailers like netflix and old navy promised the bank to notify the school of possibly suspicious activity on the account. >> how can you do that? we're here to protect our kids and help them in everything that we can and a parent comes and takes her from our kids, you know? very, very wrong. >> reporter: even though the club is not officially part of the school, one parent wants to know why there are not better financial controls. >> it's sad with big money missing. >> reporter: wendi hayes' attorney says she has paid back most of the money attributable to her. a statement from the home and school club confirms that most of the money from both defendants has since been returned. in san jose, mark sayre, cbs 5. patdowns and body scanners are sparking outrage among airline passengers even the flight crews. but starting today, the pilots are going to be exempt from security routines. the transportation safety administration, tsa, agreed to let the pilots pass through security by showing two photo ids. now, those identifications are checked against a secure flight crew database. some pilots are saying they are so traumatized by the searches, they are unable to perform their duties. passengers who are upset with the scanners and the patdowns, they are planning an opt out protest on wednesday. feeding a family during the holidays sure can get expensive. we are going to have some tips on how to save money on your holiday feast. that's coming up. and well, speaking of turkeys... it's an up it's a sign of getting older. how to get rid of turkey neck. >> can you see the smoke flying here in the weather center? yes. this system will come in waves. a little lull in the activity about 7 a.m. right after sun-up. and then you will see we have that break through the most of the area until lunchtime. rotating all the way to the southern portion of our bay area. heaviest precipitation and the gustiest winds up to 35 miles per hour will be on saturday night. rainfall is not the headline of the system although we will record 1.5" in the north and also been 1.5" across the coastal range of the santa cruz mountains by sunday night. but generally speaking, about a half inch of rain. temperatures tomorrow, cool. unseasonably cool. in the 50s. we are talking 30 degrees cooler than wednesday. and if you are heading out to the 49er game on sunday afternoon, 52 degrees with scattered showers. that isolated thunderstorm possible. lingers showers, wraparound moisture on monday. tuesday partly cloudy and then we dry out for that big getaway day on wednesday as we set you up for thanksgiving and black friday will be sunny and bright. mypix tonight, if you are thinking about going to yosemite we have lots of precipitation there, as well. and here we have some light rainfall falling at the holiday ice rink at justin herman plaza at the embarcadero. this is my favorite time of the year. we light up about 10,000 lights at the embarcadero center. that's the official kickoff of the holiday season here in the bay area. big doings there at 6:00 tonight when the big program gets started. dress in layers and have your umbrella. and have yourself a very good time. allen?
