Over time the gas the gasoline tax would have less and less revenue coming into it as we switch to a noncarbon fuel. Under the plan the gas would go up by 10 cents a gal. Registration would jump by 35 bucks and zero emission cars would have to pay a yearly 100 fee. It would bring in money, and they agree that this type of plan is just too much for the voters right now. For exampledo you want to pay a mileage fee or flat fee when you register your car . I think everybody feels theyre paying enough fees. Another option would be to make these paid toll lanes turning carpool lanes into toll lanes. So that is an option. But itsgoing to have to come out somewhere. Exactly. So what theyre talking about now is maybe smaller bites gradually over time. Because when it comes to taxes, people dont like to pay especially at the pump. Meanwhile on the roads theres another debate going on. Andthis one is between cars and motorcycles. Thats all about lane splitting. When motorcyclistsride between lanes of stopped or moving traffic. Now a bill headed to the state assembly could sanction the act, the American Motorcyclist Association is calling for less restrictive rules. They saylane splitting is actually safer than having sitting than for them to sit still behind cars that cant always see them. They see you moving. Whenyoure still theyre looking for another windshield in a dashboard, not a motorcycle. The measure would allow motorcyclists to ride between cars up to 50 Miles Per Hour faster than the flow of traffic. But there would be a 15 miles an hour limit. Its already allowed. So its going to get interesting because this is a Court Challenge where a judge would decide rather than a popular challenge where everybody would weigh in. Thats probably smart for the proponents to go to the court side. Going for the popular side, the timing is horrible for them because everybodys ready to support them coming to town. And at the same time theres a movement in sacramento thats going to put a fast track on this Court Challenge and have it wrapped up in nine months. Sowell have the clock ticking on that game as well. Meanwhiletheres a vote expected on the controversial house moratorium. That would put a new stop in the mission district. This isvideo from a recent protest about it. The moratorium wouldbe in place for 45 days and possibly extended after that. Its an issue that hit a political boiling point a few days ago. This is a shouting match that broke out at the San Francisco democratic central committee. Scott weiner who is against the band caught a lot of the heat during the meeting for his position. But he didnt want to go into detail about what happened. Its the most important issue facing San Francisco. And weare all incredibly passion at about finding solutions. The bottom line, he says, it doesnt matter where you stand on the debate. Everybody is in agreement that Affordable Housing solutions are needed and fast. Some say reducing the number of Housing Units available in the mission is only going to make things worse. Thats right. And this side however says we need more Affordable Housing and they want more federal money. But in the meantime they want a moratorium put on because theres only so much space available. Oakland city leaders now enforcing an old ordinance saying people will be arrested if they protest after dark on city streets. That in turn has sparked new protest. They still can gather in public spaces, march on sidewalks. Those are all permissible. But we are doing a better job of managing these crowds to avoid situations that cause vandalism and cause protest to end early. The mayor says shes using a new approach to an existing law. Demonstrators dont plan on stopping anytime soon despite arrests and citations. Joining us now is one of the representatives from the Lawyers Guild who has been working on this. I understand you have a meeting scheduled monday with the mayor and the police chief on this. Yes, theyll be meeting with the police chief monday afternoon. Were hoping to work this out and for the mayor to rescind this ban on protest. What is it about the mayors ban or her rules governing this that you dont like . Well, first of all, they violate a federal court order, a Settlement Agreement that the city is party to in response to Massive Police misconduct around protests in 2011, 2010 and previously. But this rule doesnt ban protests. What it says is after dark or starting at 8 00 you have to be on the sidewalks or in a park. They dont want you or protestors out on the street. What is it that you find objectionable about that . Its a ban on protest because most people during the week work, go to school, protests dont fit on the sidewalk. Street marchers have been routinely facilitated by opd for years. They have been facilitated in part because of this Court Agreement that you helped hammer out; correct . Thats right. And part of it was for everybody to be safe. The ideawas that the police were supposed to facilitate a march so that marchers would be safe, traffic would be safe, nobody would get hit by a car and property would be safe. Butthat hasnt been working in recent years. Well, that has nothing to do with weather marchers were on the street or sidewalk. Ifproperty was damaged that didnt happen in the middle of the street. So this ban has nothing to do with safety. Demonstrators perceive it a a crack down on protest. Andpeople are not only protesting Police Violence against black people around the country, but theyre protesting mayor schaaf. This is oakland. We have a long tradition of protests. Okay. But if people are turning out and they are going to protest and they are going to be given the chance to speak, what is it about this that you find so inhibiting . The marches in oakland are too big to fit on the sidewalk. The crowd control policy, which is an opd policy agreed to by the city provides that the police will facilitate that kind of First Amendment expression. Theres no significant disruption in traffic and any of these recent protests. What about the businesses that have been damaged, the cars that have been vandalized, do you have ongoing problems with in a . Nobody is saying that police cant arrest people that commit vandalism or other crimes. Thathas nothing to do with weather people can lawfully express their First Amendment rights in the street. But the street marchers get larger, the police are unable to be everywhere at one tim. Typically that happens when the police are focusing their resources on making mass arrests or doing other enforcement action around the lawful political protests and then people are doing vandalism down the street. So focus so there was no vandalism, there was no unlawful activity at these black womenled march the last few nights. Lots of police off their regular duties to make a need mass arrest block traffic for hours while the arrests are taking place. The other side would say were moving in early to prevent what happens later. We have the march and then the vandalism. Question, do the demonstrators have a responsibility for keeping a handle on things . Dothey have any responsibility in your opinion . The demonstrators have a responsibility to express their views and if theres unlawful activity, the police can do their job of arresting people that commit crimes. But the organizers of these demonstrations if they know seven out of ten times it winds up with them getting out of hand, do they have a responsibility of saying we shouldnt do it this way . Itsnot working . I dont think thats the demonstrate ors responsibility. Theres people committing crimes off to the side. At the sametime thats where Police Resources should be going. So thats not the responsibility of the organizers, how part of their participants react . No, because i dont just because they cant control what anybody does. And thedemonstrations that have been repressed this past weekend were completely peaceful, completely lawful. There was no unlawful activity of any kind, yet the police focused on stopping those demonstrations from taking place, taking officers off their regular duties to fighting serious crimes. I understand youre going to be meeting with the mayor and the police chief. What do you hope to get out of it . We hope mayor schaaf will simply see that this is not an effective policy to stop vandalism. Whats more, it violates the federal court order. Shes trying to get the police off of the negotiated Settlement Agreement out from under federal monitoring. Ifthey cant follow their own policies, thats never going to happen. If that doesnt work, are you taking her to court . Yeah. We have the ability to go back to court under a Settlement Agreement. Lets take a look at the weather out there. This is a story that goes away sunday at midnight and theyre coming back to try to get it done, but i dont have a lot of confidence that rand paul and others are going to let it go throug. But who benefits . Bothsides . By virtue of the fact that youre elected by districts, its not a national issue, its a district issue. And believeme, that will control what they ultimately do. The image at the top looks awful when it cant be resolved. And we all criticize it. But believe me, when you go back to your individual district and your people go rah rah, you forget. Is that in fact reflecting the views of the people . Not in this case, because in this case there is a majority of the senate, 50 plus one that wants to pass this bill. Thisis about them playing games. But i think this is politics. And unfortunately on this National Security issue once again people dont have their priority straight. On the leadership side, sometimes when you want to defeat something, you set the bar higher than its possible to get there, and then that way you can be for it, but yet you killed it. And that may be what mcconnell is actually doing it. Well, that is the time on our tradition, either set the bar too high and say it didnt make it, nice try, or the other one is to actually not show up for the vote. And say well, we didnt quite get the numbers there either. But not on National Security. This is an important issue. But its also one where the public is divide. This is a bigger debate about that. This is really about who has care, custody and control of the data. And i think that everybody generally agrees that we dont want the nsa to have care, custody and control of it. So the compromise standoff the phone Companies Hold on to it and use a process with the subpoenas to get the information. I think thats a compromise. It passed the house. It could pass the senate if Mitch Mcconnell would get out of the way. And that ultimately will be the result. Clearly it will be exactly as you have described it. What passed the house, which is more difficult place to get everything through, and now youre in the senate. Thats amore, lets say, secure statutory body in many cases. Lets say it passes. What doboth sides get to walk away saying . Each of claim victory. Andthat victory will actually be the attention they got on the debate. Isnt attention annoying everybody though . The people who are trying to save the trees, theyre saying youre being like a tree racist. Its a very interesting phenomenon. This will be a nationwide bill that would hold colleges more accountable rather than just the perpetrator after assault. It could reach 100,000 and the bill would give students more resources to report their campus for not taking an assault allegation seriously enough.
