It could be another two years before an Early Morning earthquake system is in place in california. State lawmakers met with emergency officials in San Francisco last week and senators are pushing to get an Early Warning system in place as soon as possible. But theres no money for in the current budget. The 80 milliondollar project could provide up to one minute warning for big quake. Can we use these signals to power down trains, to power down manufacturing equipment, to help surgeons in an operating room make patients safer before the violent shaking starts. Governor jerry brown signed the bill last year ordering the development and funding of an Early Warning system by 2016. It doesnt appear to be any closer to actually happening its an unfunded mandate. Its something sacramento does in order to get the votes on the governors signature to pass the idea they have to say does not come out of the General Fund Budget this year so they have to go out and try to find the money and talking about possible fees on your phone another things to get the money in the system. Of course everyone is in favor of beefing up Public Safety and till you need a new tax to pay for it. In oakland it measure z and top candidates for mayor gathered last week in support of the measure which would extend for 20 years a 100 dollar your parcel tax. The funding would go to police and fire and violence prevention programs. We are working to step forward in a way, this does not increase taxes but preserves and enhances vital Public Safety services in the city of oakland. It will help the fire fighters. It will guarantee that we will have officers assigned to neighborhoods. Critics say measure z would not generate enough money to add officers to the street. It amounts to more than 600 officers in oakland and Police Experts say oakland needs 900 to 1000 officers. While this would mandate a certain level of officers on staff, it is still well below the 900. It wouldnt have necessarily new officers. The idea is to keep what they have. It is doing okay in the polls the last one had of that 54 , needs 66. They hope to drive home the message that it will not increase taxes they can get it to the two thirds margin. In san jose the mayors races too close to call. Last week both candidates went throughout the area on the same bus tour. I think the issues are contentious, Public Safety is a huge is issue and the fiscal reforms of 2012 have lingered and remained as part of this race. Its a great opportunity for us to be able to engage Community Members and understand how people are feeling about jobs and neighborhoods throughout the city. Both men are lawyers. Theyve engaged in about a dozen debates so far this election season. Its boiling down to Public Safety and pensions. People want more police. But the question is can you for the salaries and the pensions . So that is what the issue and the debate will be. It will go neck and neck down to the wire. Another issue were seeing and should be brought out a little bit stronger is how to bring more young people into san jose. You see a lot of the tech field and money going to the peninsula and San Francisco rather than in downtown san jose. So that is something they touched on a little bit. And that could sort of draw a separation between the candidates. Right, but right now theyre concentrating on this issue because its grabbing voters. Gas prices have been dropping across the state, you might have noticed in your last trip to the pump. But what goes down will likely be going back up. San francisco has the most expensive gas at 3. 65 a gallon. Oakland is 13 cents cheaper at 3. 52. San jose is the cheapest at 3. 49 a gallon. Fuel suppliers are going to need to buy carbon credits in order to comply and that cost could be passed on to drivers are anywhere from 12 cents through 75 cents per gallon. But the state Resources Board isnt so sure. We want to make sure the public understands that it is the government, their Resources Board that is putting this allocation on fuel. What i can tell you is we dont see any reason for any kind of an appreciable price increase. The money from the new greenhouse rules is earmarked for Income Housing and a lot of it for californias controversial bullet train. This is becoming a theme in the gubernatorial race. A lot of lawmakers are in sacramento hoping the gas prices do stay low so that if there is a bump it wont be too noticeable. The feeling is, bumps go up and down in gas prices and maybe the public will be able to ride with that. We will see, it will be interesting when that kickstand. Especially when you see the prices lower around election season often. Pg e may not be able to temporarily raise your rates. Starting tomorrow we will have the reason and a state senator whos been keeping a close eye on this issue live in the studio , hikes tomorrow. This comes after puc and pgandes emails went publ. Revealing that the t the Utility Reform Network is asking the puc to temporarily halt pg e is gas hike rate tomorrow. This comes after puc and pg e emails went public, revealing that the two organizations were sharing advice. The pucs commissioner president will not seek reelection and is stepping down after a replacement is stepping down. Senator jerry hill has been outspoken on that puc and the gas company and he joins us now in our studio. My first question is, do you think this discussion or decision on who should pay for what should be put on hold . I think it should be. Why. Because there was one word in an email that went back and forth between brian shared and pg e and the president based on our understanding. Was that understanding. This is understanding on the rates. And as you know the puc controls about 50 billion of rates for california. What were talking about is a series of emails between the watchdog agency, the state watchdog agencies and officials at pacific gas and electric. Youve read those emails, what do they tell you about the relationship between agency and utilities in the state. The overused word is cozy, but its more than cozy its almost criminal. If you look at what we see from the emails whether its trying to change rates and trying to set rates behind closed doors trying to judge shop behind closed doors and trying to extort money from the utilities for pet projects, also for Campaign Contributions. Frankly one of the indictments against senator leland yee i find no difference with him trading a Campaign Contribution for government favor, thats exactly what we saw one of the emails. If thats true its criminal and there should be indictments. Speaking of criminals e mails separate emails revealed that attorney general is investigating the situation. Your thoughts on that . Is she going far enough. We sent her a letter of september 19 asking her to get involved and investigate. It looks as if she is going to investigate that pg e and puc e mails and the relationships. I think it should go beyond that. We sent her a letter thanking her for that investigation but that it should go further. And it should go beyond pg e and those communications. Because if those arrangements were made how extensive days ago with the other utilities in california . I cannot believe that they are just pg e. Who else tried to get around that door . Who was tried to get in the back door to make those deals . You say go round and back door, what the emails also showed was there trying to get things done. It wasnt just the commissioners other commissioners and the staffers. And for years the Public Utilities commission was seen as a donothing group. They couldnt get it together. As evidence we have by the energy brownouts 12 years ago. Where we had enron coming in and raking is over the coals on rates and such. So they had a strong leader come in and get things going again. So theres a debate about is this what were seeing just trying to get the job done . Or is it favoritism . We are getting the job done at the expense of the ratepayers and citizens of california whether its safety or the extensive amount of money. Were paying the highest rates almost in the country for utilities for gas and electricity. Theres something wrong with that and thats because of the backroom deals. And it depends on whos making the decisions. If you have the right people making the decisions and trying to control the situation the structure of the puc is such that the president have this almost dictatorial powers. Ultimately a lot of this power rests in the governor who is appointing him. Exactly. Do think the governor will go along with these reforms . I think you will be hesitant and he likes a strong leader. Hes been a strong leader as mayor and attorney general and now as governor. So but i think we have to look at it and see if there are some reforms we can make. And it all depends on who he selects as the new president of the puc. That will be the deciding factor and the changing culture we all want to see. mark does weather Hillary Clinton is coming bk to the bay. See who shes on the immediate front what do you want to see at the hearing . I want to see them put that decision on hold because i want to make sure its done at arms length and that the facts are looked at. They have to justify their rate increase. I dont know because of those backroom discussions, the understandings that we dont know what they are if theyre going to protect the public. And thats what the important part is here. Speaking of politics, two different polls show a much different results in some silicone valley congressional race. The poll commissioned by the campaign of bow, dcm the last ohmic left to suggest hes in a dead heat with mike honda on the right. It shows the two tied at 30 each. Theyre knocking on doors and doing town halls and going to every forum and showing up. And he really hasnt been present. On as people say their polls show him way ahead. Honda, who is seeking his eighth term has the support of the democratic establishment including president obama. How much do you think these polls matter . Do they really influence people of not decided . No. But they get our attention and at this point thats what it is. Its to keep the push going on both sides. Early on polls are for fund raising to show you have a shot one way or the other. So you showed around to the fund raisers and say you know the number so this can happen. But at this stage of the game everyone is out there and stories the undecided. Speaking of fundraisers ive heard anna is running out of money right now and honda still has about a Million Dollars. That is also how it goes as well because youre scrambling for the money as well. So maybe the poll is to show to give donors a second round. Alameda county voters are being asked to bump up the sales tax. Measure the be its a mega billiondollar tax package for everything from bart to buses to ferrys. 2. 5 billion would go to surface roads and over do upkeep and pothole repair. The county would build more bike lanes and paths. The availability of the neighborhood people want to live in and give people the option of getting out of the cars at least for some of their trips. There were as nearly an identical measure on the 2012 ballot and it fell short by more than 700 votes, which isnt that many. They were very close to that two thirds majority which is very difficult to get. And thats why they put together this coalition bikes, buses, bartz. But whats missing in that equation is highway money and you know traffic on 880 say you know were spending all this money. Because you cannot make 880 any wider. Their feeling is whether its here or San Francisco, its time to get people out of the cars. They cannot afford to build more highway lanes. Another report, another 220,000 down the drain. The chp just finished an investigation into whether or not whistleblowers who alerted caltrans to problems on the thre nd dollar new span of the bay bridge faced any repercussions for going public. The answer was no. The investigation focused on employees and contractors who complained about issues with the welding work. Some of which you may remember turned out to be faulty. The report did contain criticism for caltrans saying poor consideration and documentation cause distress and confusion the project. The investigation cost the state 823,000. Thats a lot of money. That is a lot of money, and a lot of it was over time. Im just blown away by the cost of the report. The bay bridge is going to be interesting because we have it up and are still maintaining and that will cost as well. Thousands of Senior Citizens in San Francisco cannot leave their homes. It is aimed at raising the p on some medical malpractice lawsuits. And one of the big issues coming up in next months election is proposition 46. It is aimed at raising the cap on medical malpractice lawsuits and work required doctors to be drug tested. Joining us in the studio is mike kelly and he is a lawyer very familiar with prop 46. We are asking the voters to decide on three separate things. One is making it mandatory for doctors to check a database if they are prescribing narcotic drugs. The second thing is it they want to drug test doctors. And the third thing is raise the cap on pain and suffering from medical malpractice suits. It seems like three things shoved into one package. Why. I will tell you why. I actually represented bob packten years ago when his twins were killed and bob was really a victim of two of these things. Which was the woman who ran over his two daughters had been sequentially getting prescriptions, and his daughters deaths had been treated really as unimportant, as the cost of doing business at 250,000. So he is tried and ive talked him over the last ten years to try and change this. And along the ray various consumer groups approached him about including with his initiative the notion of random drug testing of physicians. Because the estimates are something on the order of 15 20 of physicians who have access to Prescription Drugs abusing them. So theyre actually not that dissimilar. One is to try two and doctor shopping for people to get drugs. Correct. To make use of the mandatory database. The second is to make sure your doctor is clean and the third is to make sure you know where to midthis is put together by lawyers to try to increase what they can get as settlements. Thats about the most cynical thing of ever heard. Over 35 years i will tell you my work involved in about 25 of this. This cap operates to make injuring and killing people the cost of doing business. It has eliminated accountability and responsibility. So its not about the lawyers. Lawyers dont commit malpractice, doctors do. And when you can simply buy off the claim with 250,000, theres no longer any accountability or responsibility in the system. If we were going with that alone why not just put that on the ballot . Say more accountability through the system and raise the cap. I think this started with bob packs and the death of his children. Ive been working on this for ten years. This came as a package. If we have the database in there about prescribing narcotics, this is an idea to put doctors accountable for doing that by increasing the pain and suffering. The third piece of it, testing doctors. That was actually the product of focus groups that found people like that idea, correct . Im not aware of that. I cannot agree or disagree i wasnt involved with any focus group. I do know that was brought to the legislative package by various consumer groups. And that is whats driving part of this in the polls. There was a move to try to get that cap lifted through the legislature, right . With the lawmakers. I was in a meeting a year and a half ago to talk about this entire package of legislation. And yes there was none there after negotiations in the legislature. Some people said if it had come to a resolution there the initiative wouldve backed off. I dont know if that was possible. At that point the signatures have actually been put in. But i know there were 11th hour negotiations. Which essentially not so much the doctors, but the Insurance Companies for the doctors said we dont want any part of that. So we have a failure to reach a deal in sacramento on some of this. Now are going to the ballot. Is this the right way to be doing something of this magnitude . Ive done this work for 37 years. This is the only way its going to get done. The legislature is essentially paralyzed for whatever reason, the various lobbying power of the cma. And more than the doctors, i have to tell you this is about the doctors Insurance Companies really driving the unwillingness to make any changes in any of these laws. But that is because they say the rates are going to go up because youre going to start getting asking for multimillion dollar damages. Again thats the kind of thing theyre throwing darts at nonexistent monsters. There is plenty of data that has been done by independent folks that say this has nothing to do with raising rates. And at the end of the day, dave jones is the insurance commissioner has to approve any increase in rates anyway. What is the purpose of raising the pain and suffering cap . The purpose of raising the pain and suffering cap is to stop marginalizing moms and dads who lose their children. People who suffer disfiguring injuries and people of a loss of quality of life and restore accountability and responsibility. Because right now there is none. Hurting someone has become a cost of doing business at 250,000 per injured person. I want to thank you for joining us.
