Saw the fire coming up over the hillside, and was watching people just scatter, and we helped get people loaded up and unhooked and helped them get out. 350 firefighters are working this fire aided by three helicopters and four tanker planes. Theyve been trying to build control lines around those residential areas. At the same time crews are getting a handle on another fire in napa county valley. Its been holding at 4300 acres for a couple days now. The fire is now 80 contained. Cal fire says flareups are still a problem. The fire started on tuesday, spread rapidly wiping out two homes and seven other buildings. The power is back on in an east oakland neighborhood this morning after a deadly 4th of july accident. Police arrived at the 1900 block of 89th avenue and discovered a teenager had been electrocuted by a downed power line. Another man was also shocked and is hospitalized in critical condition. Pg e says holiday revelers shot down the power lines. There was so much gunfire on the street repair crews had to wait until the area was safe before they could restore power. Two people are recovering from minor burns suffered during a mishap while cooking a steak at a San Francisco hotel. They told the Fire Department they were using butane when there was an explosion at the heartland hotel. The explosion took out part of the room next door, and the fire did some damage to the ceiling of a store below. Theres new video of the worlds most wanted man. The riots subsided this morning but today several jewish suspects have now been arrested in the killing of the 16year old. An israeli newspaper says six suspects are in custody. Israeli authorities are implicating jewish extremists saying the motivation for the murder. Nationalistic. If you are concerned about volatile crude oil being transported through the bay area by rail, theres a public hearing at about the plan on thursday. Valero wants to bring in up to two 50 car trains a day from crude in north dakota to its refine are in veiny sha. That is 70,000 barrels per day. Some lawmakers say it has now place traveling through densely populated areas. Valero says the costs outweigh the risks saying it would benefit the economy and environment by creating jobs and reducing emissions. A couple of lawmakers have proposed bills to control this. Thats right. Mainly what theyre saying is this oil is going to come into the state and its going to come into the state by rail. Previously weve had it come in by tanker truck. Weve had funds set up for emergency responses. If theres an oil spill like we saw with costco, there is money available for responders to get throughout and clean it up. That does not appear to be the case with it coming in by rail. If there is a train accident our local Emergency Responders would have to step up to the plate. We dont have enough money for a huge disaster far that. That is what is going on in sacramento now is to come up with a fee to help pay for local responders to get in and take care of an emergency if it happens. It is now up to the Oakland City Council whether to approve a controversial deal for the as. Last week the joint coliseum Powers Authority approved a lease extension that could keep the as in oakland for ten more years. As kpix 5s da lin reports the play by play is on going drama. This is the first of what could be many hurdles. Vice chair reed. Yes. Six yeses. And two noes. And the motion passes. Major League Baseball had everything to do with the passage. Initially all four oakland leaders on the board were planning to strike down the lease extension. A late night email to city leaders warned if the lease is voted down major League Baseball was ready to play hardball. We will immediately be allowed to seek a temporary or Permanent Location outside the city of oakland. The mlb confirmed the threat this morning and that was enough to convince councilman larry reed to change his vote from no to yes. I think major League Baseball is very serious. I dont think they were setting up smoke screens, i think they meant what they said. Before the the vote, everyone councilman noel gallo came to the meeting to urge his fellow Council Members to vote yes. Many angry raiders and as fans stormed out of the meeting after the vote. They yelled at the commissioners for rewarding the baseball owner whos been trying to move the team. This is wrong. I feel comfortable with my vote. I dont feel that i was bullied. Im da lin kpix 5. The deal still needs approval from the Oakland City Council and alameda board of supervisors. Adding to the drama, san jose is by no means out of the picture. The as have an out clause which would make it easier for them to move if theyre allowed to pursue a ballpark in downtown san jose. The San Francisco giants have being trying to thwart such a move. So major League Baseball has gone years without approving the as move. The city of san jose is suing major League Baseball and that lawsuit is making its way through the legal system as well. We have a lot of powers at play in this debate. Its complicated. It basically comes down to this, lou wolf would like to move the team to san jose. The giants dont want them there. Major League Baseball has yet to make up its mind. The idea was for oakland and Alameda County to come up with a tenyear deal to have him stay there. Instead theyve come up with a deal that he could stay and he could go. Everybodys upset. You have so many different politicians with their own interests working on this. Speaking of interests and politicians and things possibly getting messy weve got a tough new regulation on Car Sharing Services like uber and lyft thats going to be going through the state public utility. They want to expand insurance requirements. It wants 1 million in primary commercial Insurance Coverage for drivers. The goal is to close an insurance gap that came to light last new years eve after a driver hit and killed a little girl in San Francisco. Friday is the deadline for a controversial mobile app to cease and desist or face a lawsuit. That was the threat from San Franciscos attorney to monkey parking. That app allows people to auction off Public Parking spaces theyre using to other nearby drivers. The tech startup is based in italy but began operating in San Francisco in april. The City Attorney is also asking apple to remove the app from its app stores. One puts a soda tax on the novemb this week the Berkeley City Council lived up to us progressive reputation by approving two measures. One puts a soda tax on the ballot. It would levy a 0. 01 tax on sugary beverages with the proceeds going towards nutrition programs. Another measure makes high quality medical marijuana available to the poor for free. It requires dispensaries to set aside 2 of their cannabis for low income patients. We want to get to a sense of where things stand on these two measures because the first www. , one, that sugar one is going to be spreading across the country and what a soda tax could mean to people. Basically this would put a 0. 01 per ounce tax on sugar drinks right . On sugar sweetened beverages. What started out, we were looking at a soda tax but we actually discovered diet sodas will not be taxed because the issue is the calories and the fattening impacts leading towards obesity. Diet soda doesnt have that impact so we shifted from a soda tax to a sugar sweetened beverage tax. The idea is to what . You put a correct tax on per ounce. Wheres the money go . The money goes into the citys general fund. I think many people hope that the city council will say well since we got the money from here, well use it for Nutrition Education and supporting the gardening in the schools types programs. But theres not an official restriction on what the city council could use the money for. Why not . Why arent you designating it and saying to the people this is where the moneys going to go . I think some people wanted to keep flexibility, and one of the practical things is if you say all of this money is going exactly here, then it requires a twothirds vote. Politically it was smarter to put it in the general fund because that made the passage level easier for you with the public correct . I would like to think our city council is being progressive and practical at the same time. The second part is who pays the tax . Its not a sales tax. Its a tax on the distributor for the pleasure of doing business in the city of berkeley. Okay. So does the distributor then have the pleasure of passing a tax on to the consumer . In theory they could pass it on and certainly in the alarmist campaign against it, it will be argued that it will all be passed on. Usually these sort of fees and taxes are passed on to the consumer. Its youre billing it as berkeley versus big soda. I can understand that because big soda is an easy and attractive target. In effect, its going to be pay more for the city council to have more money; right . The goal is not for the city to have more money. Thats not entered into anybody on the City Councils reasoning as to why were doing this. Were doing this in response to a coalition of latino, african american, white, asian parents, teachers, health experts, you know, theyre saying this is a big health threat. But if it is, we opted for political reasons not to include that in the measure, that the money was going to be going to these programs. Well, we do have an expert panel that will be making recommendations but technically it is a general tax and thats a practical decision. Its berkeley versus big soda. Were seeing this around the country. If you really think youve got support for fighting obesity, why not say an extra penny to make the kids fitter. Why not and the public to help out in something versus make it into an attack. Well, i wasnt part of deciding the campaign strategy. I basically dont attack my opponents, but in this case the coalition the Healthy Child Initiative coalition decided that that was the most effective strategy. Effective strategy. Medical marijuana available to the poor for free is it a cone deal . A dole dean . Well, the first vote was unanimous and it was so unanimous that it was moved to want consent calendar. So berkeley were going to tax sugar, were going to have free pot. Youre staying at the forefront. The free pot is one sentence of a 24page regulatory scheme to make medical cannabis regulated, taxed, public safety, fire safety. Product safety. The San Francisco public press wants to residence rex the paper resurrect the paper boy and it raised tens of thousands of dollars to make that dream a reality. For reporters theres a thousand ways to write a news story and in todays modern world seems to be a thousand devices to deliver the news too. When the San Francisco public press settled on bicycles, executive director Michael Stoll admits the pitch had its critics. Delivered so slowly on a bicycle is really just a throwback in nostalgia and its not really going to amount to anything. But stoll isnt afraid of a challenge. He turned away from a commercial newspaper career to launch this nonprofit newspaper in 2009. Its mission, dig up Untold Stories and hire a team of freelance reporters to interact with readers from story pitch to final product. At the public press we really love to engage them right from the start of the story, tell them what were up to. Tell them what were working on and to bring them in to all of our plans. And to reach more readers, bicycle delivery is the next step. In six months, public press plans to double its distribution. Its the return of the paper boy. Lila lahood is the papers publisher. It is a disturbing combination of concerns about illegal immigration and a humanitarian crisis. More protests in the city of marietta in southern california. One of the places where the government wants to process undocumented Migrant Children from Central America. More than 52,000 of them have come into the u. S. Through mexico so far this year. There is a 2008 law in place signed by then president bush that requires the u. S. Provide certain protections for minors fleeing violence and poverty. I spoke with congressman Eric Swalwell about the issue on the Homeland Security and are last week attended a field conference in texas. He wants parts of the law repealed. What is happening is the smugglers or coyotes as they call them, go to these small villages in honduras, guatemala, el valva door, they promise the parents the children will have safe passage through mexico and have safe harbor in the United States. The parents pay 4 to 8000 to take their children. Why the influx . The influx i believe is related to economic and personal security and stability in those countries. Those three currents have the high countries have the highest murder rates in the world and theres no Economic Opportunity right now there. The parents parents are faced with few choices to provide for their children or to keep them safe are turning them over to smugglers. It seems like we need a long Term Solution of Border Control and immigration and also short term. We must change that law and give more discretion to the Border Agents so they can look whether this child has a Family Member they can go to in the United States or we can have arrangements to send the children back. Applying pressure to these country, could be dicey. What would that look like . We provide trade incentives, foreign aid to these countries. I think using diplomatic and economic measures is the first option that we should explosion. Also, again, we cant ignore that mexico has essentially given these countries a green light to pass their children through mexico and into the United States. Lets talk about the situation right now in marietta. We have protesters not wanting these children to be taken to their city to be in a processing facility. Because of the 2008 law, we cannot simply send these children back, and i believe thats the misconception that youre seeing in places like marietta. You see all these signs, send them back, send them back. If only it were so easy. I think its shortsighted to just put our head in the sand and say were not going to help other states in need, especially when youre dealing with children. Talking about the broader immigration debate we dont seem to be close to a compromise in washington d. C. About how to secure the borders. What would it take to come up with something. Speaker boehner told the president last week that Immigration Reform is dead and he will not give a vote for this conference. I think we can address security on the border and what to do with the 12 million undocumented individuals in our country through policies. This is not an issue of us not being able to catch the children. In fact, its just the opposite. The children run to the Border Agents. Doubling the Border Agents on the border would only double the amount of arms that receive these children. I think we have to do this in a smart way, not just put more boots on the ground. It is really a sad situation. It looks like a longTerm Solution isnt far from happening. Swalwell does believe this Week Congress will make action in repealing the law. Well see what they do. And where the votes are. Speaking of votes, a big step towards a tech deal that could evict dozens of tenants. The current tenants are going to be forced out. Pinterest is a popular crafting and do it yourself site that wants to house its offices at the design center. Right now the building also isnt zoned for office space. Tomorrow San Franciscos Landmark Designation Committee could vote to change that. The push is on in san jose to gather 100,000 signatures to keep marijuana dispensaries open. They campaigned against strict new rules and gather signatures. The city regulations would force many of the businesses to close or relocate and redistrict to locations where the pot can be grown and manufactured. With the citys regulations it would be virtually impossible to continue to operate. Were doing a referendum to change what the citys doing. If advocates gather enough signatures a referendum to change the new rules will be on the november ballot. Such a piecemeal. You know youre absolutely right. Efforts in sacramento to make it uniformly regulated up and down the state have gone nowhere either. I think in part because nobody really knows where this legally lies. And of course everybody has their eye on colorado. I mean should it just be legal and you know, my conversation with gavin new and a few months ago he thought we were moving in that direction and well be there in a couple years. And well see whether we can regulate that as well. They cant seem to so far. We always have something to keep politicians busy. This would be a thirdparty so its not amazon or google or facebook who you have an agreement to. When you go on their site you agree to their terms. You may not read it but at least you have a relationship with them. These are thirdparties you have no interest in. You dont know they have your information. They have your information or access to it, what do they do with it . They sell it to anybody who will pay them. The actual idea for the bill came from a constituent being harassed by a couple of men who didnt know her but got her personal information and started following her around. What other examples are there of the data brokering . According to Law Enforcement who supported the bill, theres a lot of abuse the in elder field where they can get your personal information, if youre old, you trust them they know how much equity you have in their house. Those kinds of information you could get, but this makes it very easy. Then youll get more information. Were confused on the data brokering. Ever since the internet was invented weve had this discussion about people like the amazons of the world or the googles collecting information on you. They use it for marketing purposes. You google something, an ad pops up. How is this different . Theyll turn that around, you agreed to their terms and conditions, and then theyll sell them to anybody who will pay a price. These are thirdparty individuals or companies that then put it on the internet and allow you to buy personal information. I should have looked you up today, and theyve got this personal information. And you may have no relationship with them. So all this bill says is that you can go on their website and opt out from them selling the information. As it stands right now you or i could go on the internet and for 50 or 100 bucks get personal information on anyone we want. Criminal elements are taking advantage. They can get information from going on the internet. Why such opposition on sacramento. Ive been watching this go through the hearing process, and basically it passed the state senate after some work. Went over the state assembly where they just said no way. Well the Tech Industry has become the big lobbying force. The new big lobbying force in sacramento as it has been in washington for some time. They take an approach that ive warned them is not dissimilar from the Tobacco Industry or pharmaceutical industry which i think will turn around and hurt them. If you dont trust them with private information youre not going to use their product. Their act is the language is vague. Were going after these nefarious groups. You could wind up going after the regular marketers. That was their argument all along. We worked with them, tried to narrow it down. Then the bill was held in committee and the committee offered amendments which were verdict amendments which they tried to get me to take a couple months earlier. I understand theres another fight going on many sacramento about information from your car.
