Reporter sometimes that even backfires. Recently protesters attacked a bus in San Francisco. People are angry at how new tech jobs are driving up rents. Cities have to do a better job in planning, what they allow to come in and if their infrastructure is not set then you have problems and then they try to put bandaids on things and that doesnt work. We talked a lot about the boom in San Francisco and how its affected housing prices here but it is really a bay areawide problem. Seems like it needs a regional approach. For years weve been looking at reports and studies about how to manage growth. Then you look at the reality and they just dont match up. Face it. Its San Francisco, for example, experiencing probably a population surge that it has not seen since the great flight out to the suburbs post world war ii. People are coming back into the cities. A family of jahi mcmath is now forming a plan to take her out of Childrens Hospital oakland as soon as possible. The 13yearold was declared brain dead aft month after suffering complications during surgery. The coroner even signed a death certificate but her family believes shes still alive in some way and wants to keep her on a ventilator. They also want a feeding tube in her stomach but the hospital said no saying it wont perform surgery on a dead body. The legal wrangling has been going on for weeks. The hospital has been corporate ordered to keep her on a ventilator through tuesday evening and the family hopes to move her to a new facility before the deadline. What happens when a hospital and patients family disagree on the definition of death . Should we consider the person to be alive if the heart is still beating even if theres no sign of brain activity . These are questions being asked at the hospitals and courts. Chris dolan joins us, the family representing the family of jahi mcmath. First, how did you get involved . A random phone call in the the middle of the night by an uncle who told me his niece would be killed in six hours. That sounds a bit frantic. Weve this is in a hospital setting. A surgery that went bad, now were in a situation where theres a question about whether or not the girl is healey dead. Correct . Legally dead. Theres brain death and cardiac death. Legal definition was really designed so that the prosecution of a homicide can go forward when a heart was still beating or so that a family could take someone off life support if they so chose, not for a hospital to move aggress leavely to do in essence, take away what theyve done wrong and take away a life. A lot of the questions being asked are what the hospital did or didnt do. Yet the hospital is barred from giving their side of the story. Could you allow them to speak . Thats a ruiz. Theyve filed ruse. Theyve filed declarations in court about jahi mcmaths medical condition. We asked the pr guy why dont you tell them what happened. They said we dont know. Its just a pr technique. We can give them information, allow them to talk. The family would like to be told first what happened before going out and telling the news media. People on the streets, their question is this the girl, tragic it may be cant live on her own and wont live without the ventilator. What are we trying to accomplish . There are two things. Isnt is future, cant is present. The only thing jahi is getting you have to know they have not given her food for 26 days, if it was someone on death row it would be inhumane. But this hospital withheld food. She has not had the nutrients to see if they can regain the optimum brain activity. There are a lot of people on ventilators . Who decides . The parents or the hospital . I am on the side of us deciding especially if there may have been negligence by the hospital to begin with. Correct me if im wrong, the court has given permission for the mother to take custody, for someone to come in, put a ventilator in and move her. Where are we in that . Were in motion. Until friday there were roadblocks after roadblock. I would move forward, the hospital would say you need to do this. We didnt have a clear path. When you have a clear path you can begin running especially when the time is ticking down. The time ticks down until tuesday . Tuesday 5 00. Do you have a facility to take her . We have what we need right now what does that that mean . It means i have everything in place. I just have to get it moving. Does that mean yes, we have a facility . Yes. Do we have a doctor or someone to come in and do the procedure . I have the medical staff. Facilities, transport, we just need to get it in motion. When do you think it will happen . Before tuesday at 5 00. So jahi will be moved to another facility and put with a tube in and ventilator by tuesday. Come hell or high water thats what im going to do. What is the what does the family want to happen next . Even if you accomplish that what do they think is going to happen . What do you think is going to be served . They are realistic. They understand a miracle is a long shot. They understand jahi coming back fully is a long shot. That mother said i felt that heart beating in my body before she entered this world. I feel her heart beating now. My daughter after 26 days is having her heart beating. That girl is fighting, im a mother. Im going to fight for her. They need to get her to a place where she can get care, to be treated as a person and not a bad body. That not a dead body. Therein lies the question, are we living with a person that is going to live or are we dealing for someone who for all intents and purposes passed . Shes not passed. Her heart beats, kidneys function. She regulates body temperature. Shes moving more now than ever and its not just involuntary twitching. Its a real human being, not a dead body. Its been very callous that the hospital wont use her name. This is a person. If you get her to another facility what then . What then . The best optimum care to see what her recovery can be. This mother is a realist. She says if i see my daughter suffering or deteriorating, im a mother, im going to stop. That right now that is not happening. And by tuesday youre going to have her in another facility . By tuesday with the grace of god and the help of some people that the media have brought forth were going to have her moved to a better place. Then were going to be keeping an eye on this. This brings into a lot of questions, ethical, legal, moral, religious, just about everything that a lot of people are talking about. One thing i would say, it was the holiday season. There are 3 4 of the world that thinks jesus was a miracle. Is it real or a bedtime story . That is for you, the courts and the hospitals to see in this day and age what would happen. Thank you for joining us. Were going to take a break and well be right back. Actually im going to give you your Weather Forecast before we go. It is cool around the bay area now, 25 degrees in santa rosa. A very chilly day up there. A wide array of temperatures around the bay area but were all going to end up eventually in the 60s. We could even see record highs today, in oakland and in san rafael as well. 67 degrees, atypical nor january and heres a look if he 7day forecast. The only chance of rain is coming tuesday. The legal wrangling has been going on for weeks. The hospital has been ordered to keep her on a ventilator through tuesday evening and the family hopes to move her to a new facility before the deadline. In the last halfhour we spoke live with the familys attorney. Jahi, the only thing shes getting from assistance and you need to know they have not given her food for 26 days, if that was someone on death row it would be inhumane. This hospital has withheld food. Jahi hasnt really had the nutrients to see if her brain can get in the optimum place to see if she can regain that. A lot of people are on ventilators. Do we pull them all . Does the hospital decide or does the parents decide . Im on the side of us deciding especially when there may have been negligence by the hospital to begin with. The hospital brought in a lot of experts, they say once its clear that someone is declared brain dead theres no chance of them ever coming back from that state. I spoke with the hospital lawyer friday. Its horrible this child has died. Its also horrible that its so difficult for her family to accept that death. And i i wish and i constantly think that wouldnt it be great if they were able to come to terms with it, this terrible tragic event and i didnt have to stand in here in front of you all time after time . You can see the hospital lawyer there choking up at the end. Its been such an emotional issue that has been going on, again, for several weeks. Could be coming to a head tuesday evening. The lawyer in fact told us that he has a facility lined up. We dont know where. He doesnt want to say because any time he mentioned a facility the media descends upon that facility and the facility backs out of the agreement. Well be following this. Thats the plan. The price to park at bart station going up. Starting january 13th the cost to park at most stations at alameda and contra costa will go up. Extra revenue will be used for station improvements. Parking fees at eight other stations including richmond, bay fare and mill bray will not change. The parking fee hike coincides with an increase with ticket prices on bart as well. They went up 5 on new years day. Joining us to talk about this and more is joel keller, newly elected president of the the bart board of directors. My first question, did anyone else want your job . I think that is probably why i am the president. There was no a second in line. Because the publics impression of bart is not favorable right now. They like the service, like the rides but are not happy about how things are being managed. What do you think is going to change this year . Or anything . I think youre right. I think weve had a hard year, the brand has suffered. I think its important that the board and staff rededicate themselves to focusing on what we do best; that is provide world class transportation. We have to work with our employees, weve had a tough negotiating period and theres a lot of hard feelings. We have to make sure we revisit our employees needs and try to ensure that the service that the public is accustomed to continues in the future. One of the questions that riders i talked to ask, is what price. The cost of this transportation is continuing to rise but most people say if it was cheaper i might take it more and i might take my family on weekends but its not. Its not a cheap system. No. Its a good observation, phil. The world has changed in transportation funding. So in order to qualify for state and federal moneys to restore the system we have to have, come one about 25 local match. So all the money from this cpi fare increase will go into a dedicated fund to help pay for new rail cars, the new Maintenance Facility and new train control system. It seems like a catch 22. As you increase prices arent you afraid people are going to take it less . No, transportation prices are elastic. Theres a point beyond people will not pay any longer but were seeing conditioned ridership growth. Continued ridership growth. Our continued ridership over the new years celebration was the highest in history. Were continuing to see support for the system. As long as we provide a service that is equivalent in price and time to taking a single automobile i think well be fine. Lets go with the parking. Mentioning automobiles. One of the big exaints people have complaints people have, they want more parking at bart. I understand theres a debate about the cost of parking and Environmental Concerns of people driving cars. People said they would take bart more if they could get a parking space. Its a doubleedged sword. We have to work with our communities and try to find ways that people can get to our stations without using a single occupancy vehicle. Because theres an unlimited demand for parking that. The congestion around our station, the environmental damage it would do is significant. We have to find alternate ways of getting people to the station either by walking, bicycling, taking a bus, carpooling, kiss and ride. You just approved this contract. Two questions i get from people out there watching are one, is anybody going to get fired on what happened . Yes or no . Weve already separated ourselves from the chief tboashtor. The negotiator. The general manager is investigating the circumstances and once its fully understood shell take appropriate action its a maybe then. Its a maybe then. Ok. The second question i hear is bart workers are actually in line for bonuses, if ridership goes up . Are you rewarding them . No, i think what has happened is, you are aware of the mistake that was made during the negotiations on the 4. 8, paid medical leave. So we went back to the negotiating table. The riders the workers will be eligible for bonus but only if ridership grows by 1 . So 1 growth in ridership will generate about 1. 5 Million Dollars for the district. The bonus is equivalent to about 3 4 of a billion dollars. This will only be available to the workers if the ridership growth occurs, and it will be from new sources of funding, not existing budget. So they are in line for a bonus. Yes. Thank you for joining us. And back to you. Lets look at our sunday morning forecast.
