Ever since i was younger, id love to football. I loved playing the game. Joy lost over a hundred pounds playing football. He also lost his beloved grandmother this year. A concussion two seasons ago cap joey on the sidelines, but he never missed practice and suited up for every game. Heart and soul player of our team. Joy got the green light to play, even ran the ball twice during the first half. Everyone thought was it. Until the coach from the opposing team heard the crowd chanting his name and realized get a special opportunity. His players who had won a game all season agree. Went over to the officials and wanted to alert them that this young man needed to score, we were on board with it. Once i got in the end zone, my emotions came out and i got on my knee and pray for my grandmother. I miss her so much. Probably the greatest football moment ive ever been part of. It will be forever affecting my kids as well as him. I will not forget that play. Against all odds, joey was most valuable player in a game where both teams were winners. And despite the winless season, several players for the san jose bulldogs asked the coach to go back in the game that they wanted to be part of that memorable play. Company lawyers are warning about threats to the openness of the internet and the economy as a whole. An executive chairman says he is angry about recent reports of alleged spying by the nsa on googles overseas data centers. For more on the reasons for the current backlash, we are joined by nate cardoza, a staff attorney with the Electronic Fund here foundation. What is this tugofwar going on between the government and google . Google has a lot of data about all of us. They know where we are, we are talking to come and the content of our communications. There are cases where the government wants that information from google. Currently, it is over security. Thats correct. Thats correct. There are some things are not allowed tell us. Google is a lot to say the number of warrants and subpoenas they received from Law Enforcement but not allowed to tell us anything about requests they get from the nsa or cia. We have it from security now. Is there any fewer or thought or moves being made by other government agencies, lets say the Internal Revenue service or any other entity to start trying to mine information from the internet of personal accounts . Indeed. The nsa is passing that data off to the dea, the irs, local Law Enforcement and is essentially wandering the data. Nsa is getting the data over to irs and irs takes it, looks at it, and issues a warrant for the same data said never know they got it from the nsa. So you dont have knowledge this is actually going on with your account . Thats right. Parallel construction. Thats what they call it. What does that mean . The nsa gets it, passes it off to irs, and the irs goes to the front door and the same data. This is a question about technology and a lot keeping up with each other. Was this done when we use of the wire lines and such, or is this just new with the internet . This is new. When there were wire lines, when Law Enforcement wanted to get your communications, they had to get a wiretap on you directly. Now they get it on us all the time. They started out in the Big Data Center in utah and they do it at their leisure. When we were on the Wire Networks in the days, there are still private Companies Operating these services. What changed to allow the government to lift this information and keep it around for whenever they think its convenient to look at it . Storage has gotten cheaper. The communication channel have gotten bigger and offense and smaller and offense. All of your communications go through a very small number of companies. At t, level three, verizon, things like that. Once they get on a wire, they can get everything. We are talking about the government. Is there any indication of the next step might be for Credit Card Companies or someone involved in civil litigation will just go to google and ask for that information and pay for it . That is certainly possible. You know, your data is held by google, and your data is controlled only by the contracts that you have with google. If you have read your privacy policy, you are probably unique among your viewers. Is there unlimited access by google and ownership of everything that goes on in the past in google and the same for twitter and facebook and all these others . Do they own it all . No. Theyre pretty good about it. Their policies say that you own it all. Those could change, but right now they are pretty good. Who do you think is going to become the outcome of the tugofwar between google and the feds . Google is doing the feds right now. Getting permission to talk about requests they are getting. I am a privacy advocate, so thats my belief that they will win and they will be able to tell us about it. We are leaving here really quickly. They are suing them in secret court . Thats right. In the foreign Intelligence Surveillance court. So we have a secret spy agency and a company suing each other in secret court room locked behind closed doors . Thats absolutely right. The Electronic Fund your. These are not good times to be a democrat on capitol hill. Coming up, should we be worried about the healthcare problems jeopardizing our chances for reelection . The spartans were upset. 3816 and nevada. The bears have a 110 record this season. But in basketball the warriors did pull off a win against at home against utah 10288. Should capitol hill democrats be worried about the rocky rollout of obamacare . Many are up for reelection next year, including several in california in those borderline districts which could go one way or the other. Thats why we sat down with willie brown and ask, how is obamacare going to play out with the democrats in the future . Nervous isnt the word. Serious is the word. What happened to no drama obama . You have to understand something. Anytime theres a major shift in the american policy in this democracy, you are going to have these kind of challenges and these kind of growing pains. It literally requires people with a lot of courage earning the right to be evaluated as if their profile , and some of them will chance the risk of losing their job. But democrats are calling it obamas katrina. They are saying, how many times has he come here to pick up money from the Tech Community quest wreck is coming later this month. Could you said, help me out . Unfortunately, we have open bids. Anyone can show up and make a bed, and whoever offers the lowest price usually get the assignment with some limitations. In this case, some Canadian Companies probably use their radioshack equipment, stepped up and said, we can do this so cheap that will blow your mind. They were right. It did blow his mind. But you know in any political event, even if its a fundraiser, they do a run through and say, are the lines working . Did nobody do a run through in the Obama Administration . Based upon his other terrible press conference, it appears as if it wasnt included if there was a run through. Ive got to believe you just threw everybody under the bus. I think he just handed those rightwingers who said government cant do anything right a storyline. Not by a longshot. If you go district by district and doortodoor, you can explain away the negatives. If everything is going to be fine, then why are so Many Democrats publicly nervous and calling for a change . Because they are all way on everything. Politicians are amazing. They all want to be in their mother s arms fulltime. And that is a fact of political life. Yes, you do want to be, as the mayor said, in your mothers arms mean you want to be safe. You dont want controversy, especially in an election year. This has caused several levels of controversy because we have a drama with the website. There are so many practical concerns as to if this Program Going to work if you dont have the younger, healthier people signing up. Thats a big part of the push. We have a picture from obamas personal website telling people to have a conversation during the holidays, trying to get parents to talk to their kids about signing up for Health Insurance. You have the full generation thinking they are invincible. So how to convince them to sign up. Can this program self sustaining . Thats the big question. Can it sustain without more tax dollars . Its going to make the website rollout look like a distant memory as we go into this. This is the real challenge. We will continue to follow that for you. Also coming up, a woman dead after a deputy involved shooting in Santa Clara County. What the woman did that prompted the deputies to open fire. And robberies manhunt in San Francisco. Replace the San FranciscoInternational Airport last night carrying medical supplies as well as sanitation equipment. Team members come from all over the bay area and some have family in the philippines. Robberies all too common in San Francisco. We spoke with San Francisco police chief greg surtout explain. How quickly can this happen . You are walking down the street. Theres a lot of other people around you. I tell you, how safe could you possibly feel when you are looking down walking forward . Think about how many times you have to walk around someone because they are so engrossed in their phone. Sometimes they still the phone. Other times theyre crime partner will return it for an award. What makes the stealing of the smart phones such an attractive find . They are so easily transition to secondary market. Essentially, its tuner box. What these guys do is they turn them in. Our last homicide victim stole cell phones. He was capital cell phones. There is technology that will turn the cell phone into a brick was it stolen. Why is that not helping . Its huge. They had a tremendous drop in cell phone theft. They have them in the united kingdom. Same thing. Apple and samsung have put activation Lock Technology on the phones which will help going forward, but right now theres millions of cell phones out there. In San Francisco i dont know but nationally, but here at least two out of three robberies involved smart phone, and it is epidemic. So many of these phones find their way overseas. Again, we believe that the reason there has been such a dramatic drop in streak narcotics crime is because right now everybody is trafficking cell phone and so on property from auto burglaries. Wife that customer if you think about it from a business perspective, the risk is lower because characters you are dealing with are sometimes not even they are. Overhead is nonexistent. Now with the legalization of the sale of medical cannabis, marijuana market one way. So weve heard all the warnings, keep your eyes up, keep your phones down. Its not really happening. How else can get this message through to people . We just have to keep having this conversation. As we head into the holiday season, i thought, phone down. Nobody is stealing anybodys books, so people would just be conscious of whats going on. We are making arrests. We are almost at 1500 robbery arrest this year. Talking about the technology , apples iphone has fingerprint technology. As we see more of that in the market, do you think this will go away . A complete game changer. As soon as there is the capability to have these phones, it should make them not worth stealing. Ive got a question. We had the interview with the chief. He said repeatedly over and over , dont look down, keep your cell phone out of your hands. Im being called out. How long did it take you before you were doing it again . I did it a few hours later. I feel like ive got a tight grip on the phone. As i was doing i was saying, i just heard from the police chief not to do this. Its amazing. A few years ago we didnt have much. Now we are a nation addicted to it. Your whole life is in their. We move onto another thing sort of interesting. Is the bay area about to endure another transit strike . Coming up, the mistake that could potentially lead to bart shutting down once again. And hillary was in town, but is she going to make another run . The reasons why she may or may not succeed. ,,,,,,,,,, opened friday. But high winds prevented fisherman fm hauling in their catch. Calr weather is expected to prevl today. A new state law goes ect this year for crab boats are headed out to see this morning hoping for a more bountiful catch. The season opens on friday but high winds prevented boats from going out. , weather is expected to prevail today. A new state law goes into effect this year that limits the number of pot fishermen can have on their votes. The law is intended to give smaller boats a chance at catching more crap. A snake has created a new element of uncertainty involving the family leave policy. Manage said it has included by mistake. The bart board is telling the general manager to go back to the bargaining table. The unions are saying, no, deal is the deal. The white management so concerned about a clause in the contract . How much will it cost . Joining us is zachary malay. What is the concern . Why not just let it be . Its going to cost a lot of money. You know, based on initial cost estimates, if 33 percent of our workforce use the six weeks of paid family leave, it would cost in the range of 44 billion additional dollars over the fouryear contract. Thats quite a number. As a member, my first reaction was, how did this happen, a 44 million mistake, misunderstanding. That just doesnt seem logical. The long story short is that miscommunication and misunderstanding between staff and contracted parties resulted in this inadvertently being tied to the ta. None prior to staff signing it, they did not catch that mistake. You paid an outside negotiator how much to oversee this deal . Approximately 400,000. And this mistake is the result of that . In part. With the fate of your outside negotiator . He is no longer with bart. So one head has rolled over this. The question is, where does it go from here . On monday, the unions have said that they are not interested in taking this clause out. They say there was always an understanding it with their. You guys say you cant approve it. Where does it go next . If the unions do not agree to have their membership revoked, that would force the board if we want to go back and negotiate this to vote down and have a nonagreedupon contract. That would happen later in the week. The unions have a first packet saying that we will open negotiations. If you vote it down, happens . Then it forces negotiations to resurface. Does it force negotiations or do they take it to a vote . Thats up to the unions if they want to do that or not. So they could be right back to where we started by the end of next week wondering if were going to negotiations and a possible strike. We hope not. This is an isolated component of the contract. Its really up to the unions. Anytime you have something that has been given even for a minute valued at possibly 48 million, the unions are going to say, we will give it back but on the condition you give us something out. More than likely thats correct. If i had to make a bet, the 67 million isnt going to grow. We will be asked to compensate for removing this from the contract. Any idea what you might agree to give them in return . This is so bizarre. You give them more over something you never intended to give them in the first place. Possibly. I have already publicly committed. I have publicly committed to voting no on this contract that we thought were 67 million. Regardless of what comes out of this, i am still voting no. I cant speak for my colleagues about how much more they are willing to give. One of the questions i hear is that the contract expired. Why not just put a no strike clause in effect and keep talking until you have feel customer. I heard that a lot. We have a no strike clause during the life of the contract, but unlike San Francisco, which is an agency of the city and county of San Francisco, so the city consent laws, we are a special district. We cannot make laws. Once our contract ends, state laws take over. Has there been any discussion or given any indication about what you folks are willing to give the unions in return for them taking this out . I cannot disclose that even if we have spoken about it. But those are discussions that will be coming forth and we will be setting the parameters if we do need to go back to negotiations. Monday negotiations start again. Thursday give folks decide what it is you do. We take it from there. Heck of a way to run a railroad. Thank you for joining us this morning. Okay. Here is elizabeth. Good morning. Thursday through saturday we even see a bit of a warming trend. Thats your kpix 5 weather forecast. Still to come, a sneak peak of 2015. That is if she decides to run. We will be right back. ,,,,,,,, whether to run. I discussed mrs. Clintons strengths and weaknesses. H former San Francisco mayor willie brown. And Carla Marinucci of the san francio well, theres some indication of the 2016 president ial election revolving around Hillary Clintons decision whether to run. We sat down with her strengths and weaknesses with the former San Francisco mayor, willie brown. One of the questions was her relationship with the media. I mean, i think what you saw in San Francisco was a good preview of the two styles of these people. Hes out there talking to everybody and everything, calling people idiots, if you want, but he is authentic. Hillary is so control. She doesnt even let the media in even to a fundraiser where she would get nothing but good price. It is very clear that for some time now there has been an issue with hillary and the press. The only thing he has going in order to disguise all of his policy is to entertain. Thats what hes doing. Hes doing a good job of entertaining the press. As a result of that, he gets better acceptance than hillary. I am not getting why so early in the process she has just locked it down. Is she worried about too much coverage already . She does not wish to have to explain in some dumb statement that shes made that is inconsistent with good judgment, so she is going to stay away as long as you possibly can. It is absolutely orchestrated. Every step of it is orchestrated. Believe me, i hope it works. Good luck with that. We are in the multimedia age. You cant go into hall with 7000 people and say, no videos. But journalists are literally the most forgiving collection of people. The minute she gives you an exclusive. Your colleagues go under the bus. She can do that all over the country at the right time. Would you want anybody running on obamas record . I dont think mr. Obama has much of a record. I think it would want people to run on the optimism to improve life in america under the current set of circumstances. Hillary can do that as well if not better than anybody. In her trip in california, she hit all the major buttons. She was awarded as a patriot here. She really did cover the bases here, so the strategy there. She is a first round draft choice. A firstround draft choice for sure. She is. As a matter of fact, shes probably the only choice at this point. I will tell you that some democratic operators that i talked with say they are concerned because sometimes she does not move the polling numbers the way they thought she would. Theyve also brought up chris christie. Is he looking like a first round draft pick . Does it look like a running candidate for the Republican Party . Listen, right now with all media contraction. We have a whole primary system. What made it interesting is when the clintons reemerge and they come into the bay area. By the way, we also see president obama as well. They are all coming here to talk but mostly to get money. Lets keep our eyes on it because we will all have a front row seat in the no matter what. We hope shes going to do start going to start doing more talking. Her images pretty decent right now and you destroy yourself under the hornets nest when you open your mouth in front of a microphone.
