While some got relief from the heat, oaklands firefighters had to battle a blaze on the shoulder of highway 13 near the mountain boulevard onramp. Multiple debris. Lots of cigarettes along the roadways. Very difficult. But things have gotten hot. We are starting to dry out. We are into vegetation season again. And with heat also comes warnings. Officials are urging people to stay hydrated and not to leave children or pets in cars. The latest on the weather. Good morning. The heat is already starting to pick up. Not a cloud in the sky. Thats warm for this early hour. San francisco 68. A little bit cooler. As you head over to the coast cooler. We have that heat advisory. It is dangerous out there, its going to be because not only do we have the heat but we are going to see winds pick up especially out of the north. So hot, dry, and even windy. So you know that the fire conditions, a heat advisory has been extended from wednesday to thursday. That heat is going to stick around. Here is our high for the day. Temperatures are going to reach triple digits again. Warmer today than yesterday. 82 degrees in San Francisco today. 97 redwood city. 101 in concord. Red and pink. All right. The states 183 billion bunk plan has just been approved. Both houses of the legislature ratified their spending bills after completing negotiations earlier in the week with governor jerry brown. While schools get the largest slice of tax dollars, the combination of federal and state funds makes health care the single biggest function of state government. Lawmakers also added money to boost the enrollment of in state students at uc and cal state schools. And 45 million will go to one california, a coalition of legal services, Immigration Rights groups and faithbased organizations. They can be used to help immigrants fighting deportation or removal proceedings. Brown is expected to sign the plan into law before the new fiscal year begins july 1st. And the state gas tax is causing a backlash democrats in sacramento went to Great Lengths in this budget to help a senator hold on to his seat. I have literally hundreds of people in my district who have come to us and said i became aware that the petition i thought i was signing to repeal the gas tax is not that. Its to repeal you, senator newman. Reporter josh newman voted for the new gas tax and now voters might throw him out of office to force a recall election in his district. More than 60,000 signatures are required. Newman says people Gathering Signatures are lying. They are asking how to get their name removed. It is not clear under the current legislation. Reporter its a misdemeanor to lie to people when Gathering Signatures. He says that law is not enforced. Luckily for him, today the Senate Passed a new bill, sb96. It allows people who sign recall petitions to take back their signatures and its retroactive. This strikes Katherine Baker as convenient. It says we want to protect one person from one process that has been the process, applies to everyone else, we want to make a special exception halfway through the process. Reporter she says its the kind of thing that makes voters cynical. Nothing short of an abuse of power. Reporter the Senate President pro tem says its about protecting the voters from signature gatherers. He says using the signatures to mount recall votes is a power grab. This is a cynical attempt that undermines the democratic process and the voters. How does it feel to be the target of this and the senate attention . Not what i expected when i ran. Reporter now, lawmakers used a little trick to speed up the process of passing sb96. They attached money to the bill and, voila, it became part of the budget. Thats an interesting point because trailer bills are supposedly laws that come after the budget. Hence, the name trailer. They are usually used to clean things up. For example, a budget, lets say the state budget, creates a special fund or program. Then you introduce a trailer bill that lays out the rules for how the funding would work, but sometimes they do a lot more because, as melissa pointed out, a neat feature of the trailer bill is they dont have to go through the normal process of Committee Hearings. They are just voted on by the senate and the assembly and immediately become law. Sometimes they are used to push through controversial legislation without much scrutiny. Some of the bills this year include the bill to change the way voters can recall an elected official, and a bill that would restructure the entire state board of equalizations. These are big movements that are done sort of at the last minute, low scrutiny. As long as they involve some kind of money, they are legally a trailer bill. You know, it begs the question, why not pass everything through a trailer bill . So many things cost money. If thats the only definition of a trailer bill, we could get through pretty much any committee. [ laughter ] and they might want to do that down the line. It is an interesting thing to keep an eye on and we will be keeping an eye on it for you as well. Meanwhile, President Trump is waking up at camp david this morning. He is spending the weekend with the first lady and barron. He is adding a new lawyer to his private legal team. He has worked as an investigator and a defense lawyer and he is going to help defend the president against allegations of obstruction of justice and possible collusion between the president s Election Team and russia. Meanwhile, special Counsel Robert Mueller is beefing up his legal team in the russia investigation. He has brought in 13 lawyers and reportedly plans to hire more. They are looking into questions that russian interference in the election. It includes seasoned investigators who have worked on high profile investigations. Its not just President Trump who has a private legal team. Now Vice President mike pence hired a private lawyer to represent him in the special counsels russia investigation. Pences office has confirmed that former Virginia Attorney general Richard Cullen has been retained as the Vice President s personal counsel. Remember that trump hired his longtime personal lawyer mark caso wits a couple weeks two represent him. Given the rising stakes of these investigations, the former San Francisco mayor, willie brown, who has been the target of such probes, he was asked if he would be getting lawyered up at this point. I would have started out being lawyered up. Under no circumstances in this day and age when whenever you are doing can be investigated, it can be a political downside, you ought to have a lawyer on the payroll. In the 80s i had a guy outside, a great lawyer, and he was the guy that every time you went to the bathroom, you checked with him. Yeah, i dont blame him for getting a lawyer. Right now you have white House Counsel who is not looking out for pences best interest necessarily and then the department of justice. Thats also not the vps personal overnight it. He wants somebody looking out for mike pence specifically, and who can keep the confidences. So i dont think its a about you when you do that, and we into the media say that the Vice President is lawyering up or anybody else is lawyering up or they are a person of interest, its almost as if you are making an admission or at least suspect of guilt. Well, people should not think that at all. Remember in the 90s the Clinton White house, plenty of people had to lawyer up. He got in trouble when he tried to help them pay off their legal bills afterwards. Its not uncommon for a number of people to lawyer up. It doesnt mean they are guilty. It doesnt mean they are not, but it doesnt mean that they are. Except that the public thinks that you hire a lawyer, when somebody says something about you, you are trying to protect people from finding out the truth. Thats why you ought to lawyer up from the first day you get the job. Period. Pence is going to be sitting across the table from six, 12 lawyers from the department of justice, from the independent counsel. The fact that he wants somebody on his side, you know, isnt unreasonable. Even the attorney general is going to wind up sitting across everybody. Are they going to build a special building in washington . This is the department of special investigations . I dont think why you raise any questions for the need for full employment for those of us who are licensed to practice law. Thats what we do. We love the opportunity to demonstrate the skills which we have acquired. Now, some of this is serious. When you sit down in front of federal investig everything you say is subject to coming back and saying you didnt tell us the truth. You could find yourself in hot water not even knowing it. We are hearing reports that the Trump Administration is having difficulties recruiting people for highlevel positions. They say if i come on board, who is going to pay for my lawyer that i will invariably need as part of my compensation package. Youre a lawyer. When do the lawyers start getting lawyers . Thats a great idea. I am a member of the d. C. Counsel, the d. C. Bar, and i am available. All right. Meanwhile, lets take another look at a big legal issue. Bill cosby. Thats right. We have got a pennsylvania judge who has declared a mistrial in the case against bill cosby after deliberating pore for more than 50 hours jurors said they were deadlocked. The 79yearold comedian was faces ten years in prison accused of drugging and sexually assaulting ann assaulting Andrea Constand in 2004. A north bay woman claims she was sexually assaulted by cosby. She was disappointed but not surprised that the judge declared a mistrial. I am relieved it was a hung jury and not an innocent verdict. But i was really surprised that it hit me the way it did, that it made me sad and angry at the same time. And a few tears were shed. Bakerkinney says the 62 other women who says cosby attacked them were all hoping for a definitive opinion from the 12 jurors. We all hoped that it would turn out with a guilty verdict in order to feel a little bit vindication collectively. We knew it was a verdict for her, but collectively it would have been a little bit of validation and vindication for all of us. Cosby didnt say anything as he left the courtroom. The judge wants the retrial to begin in 120 days. Coming up, talking about a possible crackdown on uber and lyft. Earlier this week, embattled Ceo Travis Kalanick said s stepping a uber is trying to repair its reputation after a series of scandals. Earlier this week embattled the ceo says he needs to work on himself to become the leader that the company needs. And that came on the same day as former attorney general Eric Holders Law Firm announced a list of recommendations for the company to clean up its culture. According to a recent study, up to 15 of vehicle trips that begin and end inside the city are uber or lyft cars, and that during rush hour 5700 cars on the roads are uber or lyft. We may be forced to take draconian action. There has been talk about congestion pricing. There has been talk about maybe limiting the number of cars that go on the street. The San FranciscoCity Attorney has subpoenaed records from uber and lyft and says he may be bringing charges against the companies for allegedly creating a public nuisance. Joining us to talk more about this ridehailing congestion is aaron peskin, supervisor aaron peskin of fishermans wharf. You know, i dont know of a phenomenon that is both most popular and despised as uber and lyft in these days in the bay area. This past week we revealed a study that shows and confirms that i think everybody knew. Tive tier of the congestion is brought on by uber. Half a million miles traveled every day. At the height, 170,000 to 220,000 trips per day uber and lyft are responsible for. Up until now, they have not been willing to share any information with us. This is information that we actually gathered by looking at terabytes of data that we scraped and it confirms our worst suspicions and means its time to act. I think people in San Francisco are at the tipping point. We are getting more and more constituents tell us its time to step in the arena. About congestion . They are upset about congestion. They are upset about safety. They are upset about people double parking in bike lanes, not pulling over, crashing into cars. You see it every day. Stopping in crosswalks. Its time to teach these folks, if they want to be a part of the city, youve got to learn how to drive in the city. I am going to give you a statistic from the same report that you commissioned. On a daily basis inside San Francisco alone 283,000 people hop in uber and lyfts to get around town. It is next to muni the most popular way to travel in San Francisco. So you have a quarter of a million folks out there on a daily basis who want this service. We have a culture of convenience and most of it is concentrated in the most congested parts of town already. That is not a workable long term solution. So while its 15 citywide, in downtown, in the district that i represent, in the south of market district, its over 25 of the congestion. As mayor lee said, we are going to have to look at solutions whether its congestion pricing like london and stockholm of doing but wait. If you cant beat them, tax them . If you cant beat them, try to keep them out of the most congested parts of the city and get people on to public transit. Thats precisely what london did with great success. The most richly served part of the city is the downtown. Weve got bart. Weve got underground muni lines. We have surface lines. In the culture of convenience many people are picking the uber and the lyft. Why . Because it is so cheap. This is an organization that is losing 700 million a quarter. What are they trying to do . Wipe out the taxi industry. What will they do then . Wipe out the drivers. How will they wipe out their drivers . Selfdriving autonomous vehicles. Okay. That is one scenario. Now let me give you another one. The city itself is responsible. What is their responsibility in the congestion . Youre taking lanes of traffic out. You are putting in bike lanes that arent as used. 3 of the people use the bike lanes. We are putting them everywhere. We have construction willy nilly without any kind of planning. Its not unusual to be backed up under construction and people are just as angry about that. But it doesnt appear that the city wants to discuss that. They just want to talk about uber. Phil, there is no question that the city has responsibility. As a matter of fact, mayor lee, who is now starting to reassess, welcomed uber and lyft with open arms. We are definitely a part of the problem. Okay. Now, finally, on this culture of convenience, do you seriously think that you can make it so that it costs so much to take lyft that people are going to get back an muni . I dont think so because they are taking other transportation. I think we can make transportation better by people who built themselves with the culture of convenience. That i am going to watch. You turn muni into a wonderful ride that preempts the culture of convenience. You will see it. I am guilty. Im culturally convenient. I cant help it. [ laughter ] all right. You can see why we are dealing with the heat with the High Pressure thats building and building. We do have this ridging going on. As this lifts, thats when we get the temperatures to get higher. Even when it moves further east our temperatures are gonna stay high because its that strong. So that heat is gonna stick around. Of course, along the coastline temperatures a little bit cooler. Quite a drastic difference between the coast and the inland temperatures. 20 to 30degree difference. We are getting some northerly winds as well. There is no fire advisories or warnings in our area, but in the Central Valley there is a red flag warning that will go into effect tonight through sunday night. And President Trumps Financial Disclosure forms are being made public. The documents show the president with assets worth 1. 6 billion. From january 2016 to april 2017, mr. The Senate Intelligence committee tornado attorney general Jeff Sessions on capitol hill, but he refused to answer some of the most pressing questions. Let me state this clearly, colleagues. I have never met with or had any conversation with any russians or any foreign officials concerning any type of interference with any campaign or election. Under oath the attorney general said because he recused himself from the investigation into russian interference in the u. S. Election doesnt mean that he cant otherwise serve as attorney general and that he has nothing to hide. Mr. Comey said that there were matters with respect to the recusal that were problematic, and he couldnt talk about them. What are they . Why dont you tell me . There are none, senator wyden. There are none. Sessions also declined to discuss his private conversations with President Trump about the firing of fbi director james comey. I believe the American People have had it with stonewalling. Senator wyden, i am not stonewalling. Sessions claimed that there is a policy that prevents him from answering certain questions because the president might claim those communications are privileged. California senator Kamala Harris hammered him on that claim. The policy you said it would be shown to you. The policy is based on the principle that the president sir, i am not asking about the principle. I am asking well, i am unable you would rely on that policy. Did you not ask your staff to show you the policy that would be the basis for your refusing to answer the witness should be allowed to answer the question. Senator harris tweeted this after the hearing. Quote, its unacceptable that sessions, the top Law Enforcement official in the country, cannot name his legal basis for evading questions. Two weeks of hearing. Two spotlight shots for the rookie senator harris. Gaining fame . Possible president ial contender already . Melissa and i asked former San Francisco mayor willie brown is she coming off as prepared or two stride ent or is she scoring points here . I think she is doing exactly what she does best and what she has been trained to do. She is a prosecutor. That is her whole profession. Thats how she has been at it forever. And whenever she directs questions, they come off in the prosecutorial style. That will change as life unfolds. The senate what they call courtesy and all that stuff, it will come, but it will come with age. Meantime, shes miss district attorney. Well, also, part of the problem with giving each speaker, each member of the committee a specific amount of time is that you allow witnesses to filibuster. They get one question and then go, go, go. What she was trying to do both times she was sort of shushed she was trying to stop people from talking to filibustering her so she could get to the next question once it was clear they were not going to answer the question she already asked. Thats kind of a danger that is baked into a set time in the process and youre gonna get people going over the how much of these Committee Hearings are rigged between the time limits that go from question to question, the interruptions . How much of this is staged to not get information out . Its all staged. Its worse if you are as far down on the ask question group as she is. She is like number last. And thats it. Period. What she does know, being as bright and able as she is, she hears all the remnants of what has been said and done and she is able to literally synthetic size and break it down. Unless you are clever, unless you are wirey and you can do what sessions does, she is going to nail you to the cross. Her people are really on top of this. Within minutes of these things happening you get an email with a link to the video, a link to the audio, a full transcript. Her office is pushing it right out. And then you get a tweet and a fundraising letter as well for her or one of her colleagues. Yes, the machine in washington, everybody is getting something out of these hearings. You have to wonder if she sent in a fruit basket to mccain for making her a superstar. The same week, there was tragedy in washington as well. Representative Steve Scalise is still in Critical Condition after this weeks shooting during baseball practice. His doctors are optimistic. The representative was among five people who was shot when a gunman opened fire at a Virginia Park where they were practicing for a softball fundraiser. Scalise was hit with a high velocity bullet. The congressman has undergone multiple surgeries and faces more. Doctors do expect him to walk again. And developing news on the collision involving a u. S. Navy destroyer. All seven of the soldiers have been found dead inside the flooded compartments on the ship. They found the body after the damaged returned to base in japan a few hours ago. The uss fitzgerald collided with a container ship four times its size. Other crew members managed to prevent a bigger disaster. The ships crew, they prevented the ship from sinking last night. The remains of the seven sailors who died have been transferred to a u. S. Naval hospital nearby so each victim can be identified. Meanwhile, London Police say 58 people who were in the Grenfell Tower when it went up in flames this week are still missing and presumed dead. Thats up from the previous estimate of 30 fatalities. They are career prosecutors. They are not political. They have worked for both sides of the aisle, democrats and president s and they have been doing it for 20, 30 years. They are not publicity hounds, believe it or not, because in todays world the social media makes everybody public. But they dont seek publicity. Mueller doesnt leak. They are concentrating on what they have to do in their jobs. Lets look at what they have to do in their jobs. Its around about Vladimir Putin and interference in the u. S. Elections. Thats the starting point . Right. What are they look at . They are not going to interview him. Where do we go with it . We are pretty sure that the russians were hacking in. Somebody in russia was hacking into a lot of electoral systems. Not just the federal, but the state. And what we know is that hacking costs money. So they are gonna have to follow the money. That is muellers focus. A lot of the money in russia may tie back to the white house and the white house interests. So you get into the white house. Then people are making mistakes like flynn. Former National Security agency head michael flynn, who didnt report his ties with russia. Right. And seriously under investigation. There has to be grand jury sitting on that one. And so the white house keeps and the tweets keep tripping into this. So the focus gets broader and the coverup and then the soninlaw Jared Kushner and his business ties with russia, right . Because we dont know where the connections are. Mueller has an expert on Money Laundering who is trying to chase this out. He has an expert on Money Laundering . You have to trace the money, right . So then but then you also have comey getting fired. There is some confusion about why that happened. The president apparently said thats because i had russia on my mind when i fired him. It starts to connect back to the white house. It connects back to the white house, but we unlike watergate, which was a burglary and then expanded, and that was iran contra was an event that earp that we were looking at. We seem to be looking at an event to see if there anything out there. Thats different than past investigations. Its much broader because of this russian hacking thing in a national election. They say some 30 states may have been hacked into. Thats a massive enterprise to undertake to investigate that. 13 lawyers is not enough. The fbi is presumably involves. The other security agencies are involved. Its a sprawling investigation. And then the trump ties with russian business . Ties with russian business and see whether the ties tie into hacking and then you have what may be obstruction of justice along the way. That is always a part of a criminal investigation, to make sure that your witnesses arent being tampered with or influenced in an improper way. All right. From what you have seen and the statements here, do you think there is a grounds for obstruction of justice by the president . Did he fire mueller in order to keep him i have no idea. I really have no idea. You never know. Its like an iceberg. You are only seeing 1 of whats in front of mueller. A prosecutor is not going to indict somebody for obstruction of justice on a one witness conversation unrecorded. Thats not the political question. The political question is what would the house of representatives think may have been obstruction . What does the senate think. There you dont have the standards you do for a criminal case. If you cooperate and become a person of interest, sometimes we make it sound like they are guilty of something. What is the definition of a person of interest . Its really no more than what it says. We are interested in that person. Were still interested to figure out where they fit. Are they a subject . Are they a witness . Are they a target . Are they somebody on one side or the other on the criminal set of allegations . You shouldnt draw anything out of person of interest. It all is of interest and they all seem to be of interest. Quite a cast of characters. If you are willing, i would like to bring you back occasionally because you make sense of it all. I would be happy to. It is an incredible moving target. Reality show. Temperatures near record highs in some areas. We are talking triple digits for a lot of the inland communities and not even cooling at night. Usually we get that break, but temperatures at night might drop down into the 60s. Not really below that. Our temperatures, our sevenday forecast, which i will show you in just a bit. We will stay hard all the way through friday. Finally friday we will get that relief. Some people probably want it sooner. Here is the main reason we are dealing with triple digits. This High Pressure, this ridge is definitely strong. Its keeping any cool air well to the north of us. All the storms are being pushed aside because this has taken over even as the ridge moves east. We will get a lot of that heat. Thats why our temperatures wont drop for quite a while. A slight ocean breeze on the coast. Usually the coastline is nice and cool. Winds are picking upcoming from the north. There is a bit of fire concern out there. Central valley does have a red flag warning going into effect tonight through sunday.
