President trump signed the Emergency Declaration to bring federal funds and resources into the area. Thousands of evacuees are returning home. But as kpix 5s joe vazquez reports. Reporter people who are grateful a mandatory Evacuation Order is lifted. Im relieved. I can go in there and make my bed and relax. We have concluded that it is safe to reduce the immediate Evacuation Order currently in plagues to a warning. Reporter that means keep a bag packed, another evacuation could be ordered at any time. The emergency spillway was severely damaged when Lake Oroville got too full. On sunday the runoff that poured over the top of the top of the emergency spillway dug a gash in the hillside. It was creeping backwards and if it had grown significantly under the wall toward the lake it could have caused the emergency spillway to collapse. Officials believe folks who live downstream are safe for a few reasons. First, they have drained a lot of water from Lake Oroville using the main spillway and that seems to be working out all right. They are ahead of schedule in repairing the broken emergency spillway. Presently we are about 40 truckloads and hour about 30 tons of rock per hour being put in place. Police are confident they found the man who killed an indian immigrant in milpitas. The 30yearold is from fremont. Police believe the suspected carjacked a woman on friday and shot and killed the 27yearold man who was in the garage at the time. After a brief Car Chase Police caught up with the suspect who now faces charges including murder and robbery. The city of San Francisco is suing a massage parlor for running a brothel, allegedly. They want to shut down the Queens Health center on kearny street in the financial district. The lawsuit says that the business has been operating a brothel for seven years. They also hope to build an eightfoot berm to stop the material from falling on the road but repairs have limited drivers to one lane in each direction. Well, hundreds of oilfield waste water wells have to be shut down today. A federal audit found that california illegally allowed them to inject contaminated fluids into protected water supplies. But as Christin Ayers found out its not stopping the state from backing another oil companys request to inject waste water in the bay area. Reporter you would never know it but in the shadow of windmills that surround the livermore valley, theres an active oilfields. Started seeing major problems here. Reporter two wells are on phillip marshalls property. He says problems started when the oil company e b Natural Resources removed some old tanks uncovering contaminated soil. It was intense petroleum smelling odor coming from the site and we looked at it and saw that there was obviously contaminated soil under where these tanks came out of. Reporter the county cited them for failure to provide an immediate verbal report of the contamination. In another incident involving their tanks on a neighboring property, alameda countys d. A. Sued the company for improper transportation and disposal of hazardous waste. They are very sloppy message operators that just really dont have any regard for the property theyre on, the Community Around them. Reporter marshall is one of dozens of livermore residents who showed up at a recent public hearing to protest the companys request to expand its waste water disposal boundaries. Some worry about ground water contamination. Surrounding this aquifer is 15 Domestic Water use wells within a quarter mile. Thats extremely close. Reporter others about the nearby greenville earthquake fault. I dont see how anyone can guarantee that another earthquake cant create new pathways for this waste water to escape. Reporter contaminated water from the Oil Extraction process has to be reinjected into the ground for disposal. It can also be used for oil recovery. But either way, it can only be injected into a water table exempted from the federal safety Drinking Water act. The aquifer currently doesnt serve as reporter officials with the department of conservations division of oil and gas that oversees Oil Production in california told the packed house that a portion of the water table under the oilfield in livermore is already exempted and that expanding its boundaries is appropriate because its way too dirty to ever be used for drinking or irrigation but this man says, not so fast. Unfortunately, its part of a larger pattern of the state rubber stamping these exemption applications on behalf of the oil industry. Reporter the scientist with the center for biological diversity. We are not going to be able to rely on epa in the future so it heightens the responsibility of our state to really serve as a check on the oil industry. Reporter e and b resources turned down our request for an interview but said when they bought the oilfield here a decade ago the equipment on it was in bad shape so they invested more than 500,000 to improve it. In the process, the company says a small amount of dry oil stained soil was discovered under one of the older tanks. E and b acted immediately to clean it up and in full cooperation with the county tested the ground water which confirmed no impact whatsoever to any ground water. Ars for the d. A. s complaint, they say they inadvertently shipped a small quantity of sludge from a storage tank as nonhazardous and subsequently discovered a classification error, corrective action taken. But phillips says on his property the cleanup still isnt over. They started on that plan back in april of 2015. And they are still not complete.
