jose where a crash has killed a pedestrian. san jose police say it started with a collision between two trucks. the force of the impact knocked the truck over on its side on to a woman in a crosswalk. it happened on lincoln avenue around 9:45 this morning. >> when the delivery truck turned over on its side, there was a pedestrianing crossing in the crosswalk. the pedestrian was struck and was pronounced dead at the scene. both drivers are cooperating. this is the 17th pedestrian fatality in san jose this year and morales says that's six more than in the city had in all of last year. police say a minor fender- bender ended in a fatal shooting in oakland and now police an distraught family are looking for answers. it happened last night in the 5800 block of market street near stanford and north oakland. sue kwon has more on the victim killed an hour before his birthday. sue. >> reporter: this accident happened here at the intersection of market and san francisco. this is the fly that his relatives are passing out this morning. he worked at a shipping company. his first job after graduating from university of oregon before into a student at sacred heart prep. his uncle is offering a $5,000 reward to find the men who killed him. grieving parents visit the scene in the silver suv their son was driving. shortly before he was shot and killed. he was heading down stanford avenue stopped at the intersection of market street when a silver four-door sedan rear-ended him. >> he was enjoying himself. he was a recent graduate and happy to have a job and happy to be home in the bay area. he was a happy guy. he's always been quite and friendly. his parents always joked around with him, don't be a hero whenever there's trouble, you know, just stay away from it. >> the victim is a 23-year-old male. today is his birthday. we do know he did attend college up in oregon. he was up at cal, playing basketball at one of their gyms. he was on his way home and that's when he was involved in a vehicle accident. a suspect vehicle collided with his car so he pulled over to the curb. he did the right thing. somewhere in that interaction was some type of confrontation where our victim was fatally shot. >> all i heard was one gunshot. like i sad, gunshot appeared like a firecracker or something like that. >> it's sad, you know? it's really sad. i hate to -- i hate to see anybody lose their lives especially innocent people over petty things if that was the case, you know, but that's -- all of us have to be careful out here. >> this is really important for the family and the reason why is this is a good young man doing all the right things and unfortunately, he was shot and killed, for what the reasons were we're still trying to figure out. but the family really wants to push the information out to the community because somebody may recognize him. somebody may say hey i saw that young man last night. i saw what happened. and help us move this case forward so we can identify the suspects responsible for this homicide. this is an unfortunate tragedy for anyone. >> reporter: when he didn't show up for dinner, his mother traced his steps and found the accident here at the intersection in oakland. it's just a tragic story and police are looking for the suspect vehicle which is described as a four-door silver sedan heading southbound on market street at around 11:00 last night. live in oakland, back to you. >> feel for that family. okay, sue kwon live in oakland, thank you. san jose police are dealing with the city's 24th homicide. officers were called to checkers drive around 12:30 this morning where they found a 56-year-old man with stab wounds in front of a home. he died at the hospital. police are still investigating the motive and if the murder was gang-related. san jose had 19 murders by this time last year. and san francisco police are dealing with a double murder overnight in visitacion valley. two men were gunned down near the intersection of brookdale and blithedale south of john mclaren park. police are looking for three suspects in a white truck. our cameras were rolling this morning as san francisco riot police forcefully removed protestors from a community garden. >> whoa! did someone just fall? >> someone did fall. a tree sitter fell backwards from a branch during the raid. he only suffered minor injuries though. protestors claim the man was pushed by the officers. but sfpd says he jumped on the foam cushions that were below. demonstrators were trying to save this community garden the city's hayes valley district. it's been cleared out to make room for new condos. construction is set to begin next week. >> in the past week now, we have been giving notices coming out talking to the folks let them know they were trespassing on city property. we worked with homeless outreach and dpw to ask them if they wanted to store their property if they couldn't take it with them at the time. >> we'll have concrete trucks moving in and out of here all in the name of the city making profit off public land. >> 44 people were living inside a camp in the garden. 7 people including three tree- sitters were arrested. hearts are heavy at the 49ers new stadium in santa clara. construction crews got back to work this morning following the death of an elevator technician. anne makovec shows us how he will be remembered. >> reporter: as workers arrived back at the job site this morning they were greeted with a quote from abe lincoln delivered by the boss. >> the strongest bond of human sympathy outside the family should be the one uniting the working men. >> reporter: 63-year-old donald white an employee of schindler elevator was killed when he was hit in the head by a weight in an elevator shaft where he was working on tuesday morning. construction halted immediately until today. >> you have to do what you have to do. you have to still come to work. >> reporter: there was a big meeting here this morning before everybody started their work for the day. it was a reminder about safety and a chance to pass around these stickers memorializing donald white. >> in 49er colors his favorite team and an american flag. >> reporter: there are also plans for a memorial tree and plaque on stadium property to honor the 43-year union veteran of the elevator industry. >> you truly are the pillar, the foundation, of what makes the country what it is today. >> reporter: the cal-osha investigation into how this happened could take up to six months and there are workers in that same elevator shaft today. >> we continue our buddy system and that we look out for one another. you know, we are working with heavy hearts. everybody out there. >> reporter: in santa clara, anne makovec, kpix 5. >> there will be a public memorial for donald white next week. the details are still being worked out. traffic is finally back to normal after a big rig fire shut down highway 24 in lafayette this morning. the chp says a truck pulling a load of cars caught fire around 4:45 this morning. the trucker said he heard a loud pop and by the time he pulled over his rig, one of the cars was already burning. at least 7 of the 9 cars on the trailer were a total loss. nobody was injured. the fire, though, did shut down westbound highway 24 for hours making a big mess out of the morning commute. the highway though is completely open right now. a massive wildfire in colorado just became the most destructive in the state's history. the black mountain fire near colorado springs has charred 15,000 acres since it began on tuesday. the el paso county sheriff says the latest survey shows at least 360 homes have burned and that number could rise even higher. officials say so far, there is zero containment. about 350 homes burned in the same area in a fire last year. checking some bay area headlines now on this thursday, a smartphone summit to stop rampant cell phone they have been under way now in -- cell phone theft under way now in new york. george gascon and other law enforcement are trying to create an industry standard to discourage cell phone robberies. this week apple announced going fast, eddie. >> reporter: linda gregory and her husband became foster parents to little eddie when he was just 10 months old. >> it's just a great experience to be able to be a parent and to love a child and help them through their hardest times. >> reporter: one of the first steps linda took was to join the marin foster parent association, a grassroots volunteer group that offers support services to foster families and caregivers. but more importantly it offers community. >> there's a lot of support. it's not easy all the time. and all these kids have experienced trauma in their lives. >> reporter: that was four years ago. since joining, she has adopted eddie and she has thrown herself into volunteering for the association. just ask barbara who fostered 10 children over the years. >> she just makes it a point of knowing every member of the association. and i think that's a big part of the support that people come to the association looking for. >> reporter: for the last flee years, linda has been president of the marin foster parent association volunteering her time 7 days a week to help children in need. >> fantastic! >> reporter: much of her spare time is spent in what looks like a closet in san rafael surrounded by racks of donated clothing. it's the association's new distribution center, a project linda proudly points to as a great collaborative success. >> we've got clothing for all ages. >> reporter: all of it is new. >> most kids when they come into foster care really have nothing. they only have the clothes on their back and so having clothing to be able to get some toys, stuffed animal, just really makes them feel loved and safe and cared for. >> reporter: the small distribution center serves 25 to 40 families a month. debbie moss is with marin county children and family services. >> it's easily accessible for the caregivers and for the social workers and it makes such a big difference for our families. it really does. >> reporter: under linda's leadership, this tiny dedicated group raised money for tutoring, after-school programs and a new internship for youth to get job skills and mentoring from people who care. >> there are so many amazing people out there taking in kids and doing such great work. >> reporter: so for volunteering her time to give foster families the support they need to thrive, this week's jefferson award in the like plenty of sunshine all the way to the coast. breezy at the beaches but not like yesterday and then tonight should be mostly clear, cool in the north bay valleys and more clouds and cooler temperatures as we head in toward the weekend. the jet stream is south of us now but holding on to mild temperatures outside. high pressure building in tomorrow, meaning we'll see more offshore wind kicking in warming up the temperatures. today you're looking at 80s and 90s into the central valley. looks like most of the fog is going to stay away. we'll keep things clear overnight tonight and into tomorrow. so i think tomorrow probably the warmest day of the week. then we'll start to cool down some of those temperatures. 70s and 80s in the south bay, 50s and 60s at the coast. east bay should be up in the 70s and also the 80s. and then it looks like inside the bay we'll keep you in the 60s and a few 70s. looking out over the next couple of days, going to heat things up before cooling down on saturday and sunday. as a matter of fact those temperatures staying below average through the middle of next week. it's a great day, lots of sunshine outside, roberta gonzales is out
