The giants need to get about 10,000 signatures before july 6 to get the measure on the ballot in november. A veteran Gilroy Police officer is under investigation tonight. Thats after his stepdaughter accidentally shot herself with his gun. Kpix 5s devin fehely is outside the Gilroy Police department on exactly what happened. Devon. Reporter investigators say that this officer was off duty and at home at the time of the shooting. Now the Gilroy Police department is in the somewhat uncomfortable position of having to investigate one of its own. 13yearold with a gunshot wound. [ inaudible ] its a known address to our com center. Reporter because this house belongs to a veteran Gilroy Police officer who was at home with his 13yearold stepdaughter when the teen somehow managed to get her hands on the gun. It was not a cityissued firearm, not a duty or Service Weapon that we provide to the officer. Its a weapon that he owns that he carries and chooses to carry off duty. Reporter investigators say all the evidence suggests the teen accidentally shot herself in the leg monday afternoon. She was rushed to the hospital but police say thankfully the gunshot wound wasnt life threatening. She is in stable condition and expected to recover. Reporter there is an investigation to find out how she got the gun. A Department Spokesman says that all gun owners whether Police Officers or not have a legal responsibility to safely and securely store their epps especially when there are children their weapons especially when there are children living in the house. Its a legal firearm. Its up to him to secure the weapon whether its a safe or a safety mechanism or some other device. Reporter the d. A. s office will determine if there is an unfortunate accident or a crime. The Police Department says that this investigation is likely to hinge on the interviews that they still have to do with a 13 yearold victim and their veteran officer figuring out war that gun was, how it was stored and how it ended up in the teenagers hands. In gilroy, devin fehely, kpix 5. San jose police are fighting back tonight over an arrest video that some call a glaring example of excessive force. They tell len ramirez the video doesnt tell the whole story. Len. Reporter thats right, liz. Police say that the suspect in this case threatened officers with a bottle. Thats before the recording started. That will be part of the internal Affairs Investigation which will now have oversight from the independent Police Auditors office. [ sirens ] reporter the video showing a man on the ground held down and surrounded by at least 8 san jose Police Officers who are trying to handcuff him will be a key piece of evidence in the Police Internal Affairs Investigation. But the incidents in eases san jose inside was witnessed in person by several people some of whom have filed misconduct complaints with the independent Police Auditors office. We look at the investigation to see whether or not the department conducted a thorough complete investigation into the complaint of misconduct and this would be excessive force. No excuse. Reporter it was called unjust and barbaric by the Mountain View family who recorded and uploaded the video to facebook where its been seen 157,000 times in one day. The Police Watchdog group d bug called it disturbing. It looked similar to some of the other videos we have seen across the country where the result was loss of life. Reporter the suspect survived. 22yearold juan lopez was treated at a hospital for cuts and scrapes and then booked into county jail for assaulting an officer, resisting arrest and a drug charge. Today a San Jose Police spokesman admitted the video may be tough to watch but he said thats police work. Anyone looks at a video where you see multiple officers in a fight with one person, you know, it does look it is what it is. Reporter police say it started when officers on routine patrol in an area known for drug dealing saw lopez walking and may have tried to hide something which aroused their suspicions. Police say he first ran then confronted officers. That part is not shown on any video that ive seen. Reporter Police Say Two of the officers involved in the incident were injured one injured his ankle, the other injured his hand. Fireworks outside a pleasanton courtroom as angry family members confronted a drunk driving suspect blamed for two deaths. This is his second arrest for dui. Jones pled no contest to charges in 2003. A small group of protestors waved American Flags outside a morgan hill today. They called it a stand for free speech. About two dozen people said they are defending the American Flag on cinco de mayo. This is the second year they have demonstrated at Live Oak High School stemming from an incident back in 2010. Four students with American Flag tshirts were told to turn their shirts inside out or go home. Administrators were worried the shirts could spark a fight with latino students. Live Oak High School administrators say since the 2010 incident student relations have improved and they have lifted the ban. Oakland city council is set to take a final vote tonight on a hotly debated highrise project. 24 Story Building would be built on a plot of public land near lake merritt. Apartments would rent for an average of 3,100 a month. Opponents say the land should be used for Affordable Housing since it currently belongs to the taxpayers. Reporter its no surprise to richard. He got tired of prices being jacked up every time a refinery goes down for repairs so he bought a prius. Hey, we can its going down we can put the price up if we close something down and make less fuel and the price goes up. Supply and demand. Thats all it is. A lot of it is definitely going into profit. But that doesnt mean the firms are actually doing anything wrong. Reporter this person with ucberkeleys Energy Institute says california has made itself vulnerable to gas price increases by requiring a special blend that few refineries produce. If you happen to be selling a product at a time theres a scarcity and the price goes up you make a lot of money. Reporter the question is whether the scarcity is intentional. The Watchdog Group admits it doesnt have any proof that the refineries are shutting down just to boost their profits. But they are urging the state legislature to get involved and make the process a little more transparent. State lawmakers today rejected a proposal that would allow police to use breathalyzer tests to identify drivers who are high similar used for alcohol. It would test drivers for marijuana and other drugs. Sponsors of the bill are not happy. They say failure to pass it takes california in the wrong direction to keep roads safe. A San Francisco supervisor is pushing a bold new plan to address the citys Affordable Housing crisis. In one neighborhood at least, david campos is proposing a temporary moratorium on all market rate Housing Developments in the mission. Only projects made up entirely of below market rate units would be exempt. The goal is to keep lower income residents from being squeezed out. Reporter marie biologists want to understand what killed it. They will do a necropsy but they cant do it today because of high surf and high tide. Its too danger to approach. They will have to wait for tomorrows low tide. People are scratching their heads over the second whale to wash ashore on this beach in three weeks. Its rather strange to have two dead whales on this half mile stretch. Reporter experts however are not surprised saying this is the height of the whale migration along the coast and its natural for some to die in the pacific. Whats unusual is the strong onshore wind thats blowing the dead whales to shore. What is it about pacifica and whales . I dont know. Its cool, though. Its, you know, interesting. Reporter and then theres sharp beach. The California Academy of Sciences Says that this beach also seems to collect slightly more debris from the ocean. They dont know exactly why that happened. In pacifica, don ford, kpix 5. Humans are threatening peregrine falcons on mount diablo so state park rangers are cracking down. For the first time rangers are writing 500 citations to people who enter the castle rock area. That area is closed for the next few months while the falcons are nesting. What more can we do . state water board leaders say we saved less than 4 in march compared to last year a far cry from the governors target of 20 savings. Overall savings is only about 9 since last summer. The state also said water districts arent doing enough to limit that water waste. Today was the last chance for water districts to plead with the board to cut back even less. A Southern California representative tried to argue that keeping greener lawns helps fire prone areas. Reducing this irrigation to meet our goal not only puts Public Health and safety at risk but also creates a Financial Hardship to all of our residents. Were beyond the worst case in our area. Reporter the board listened to hours of discussion but it wasnt swayed. The board plans to move forward with new water restrictions in june. Cities will have to cut back water use anywhere from 4 to 36 . The water board is going to hand down heavy fines if that does not happen. Now, tomorrow it the board is going to consider an amendment in support of desalinating ocean water as a reliable supplement to traditional Water Supplies and that amendment would affect the construction and operation of all the desal facilities in the state. Sources tell Bloomberg News that salesforce is working with two investment banks after being approached by wouldbe buyers. Microsoft is one of the two prospects. Salesforce has a market value of almost 50 billion. Its stock jumped today after reports surfaced of microsofts interest. Stocks were down today following two days of gains. Investors raised concerns about higher bond yields, mixed domestic data and renewed concerns over greece. Google Search Engine has hit a new milestone. More searchers are now being done on smartphones than on personal computers here in the u. S. The Mountain Viewbased company says its an indication of how peoples behavior has change. Google processes 100 billion search requests worldwide per month. The city of los angeles is suing wells fargo accusing the San Franciscobased bank of opening unauthorized accounts for customers and then forcing them to pay bogus fees. This has gone on for four years. I have had 20 accounts maybe and 15, 20 each month. Maybe they reverse a tenth of them. Wells customers have been victimized by tactics designed to maintain high levels of sales. The wells fargo says it will fight these allegations. The banking giant blames the problems on a few rogue employees who have since been disciplined or fired. We have all heard the warning, this call may be recorded. But a bill written by a south bay assemblyman may allow some companies to record you without your knowledge. On our consumerwatch, julie watts is here with details of that controversial bill. Reporter its one step closer to law. Right now companies have to tell you before they record you. But this bill could exempt any company you have ever done business with allowing them to secretly record your call. Now, consumer groups protested outside the capital today. They argue if consumers are recorded without their knowledge, they may reveal personal or Sensitive Information they otherwise wouldnt like Social Security numbers or bank records. Information that could be vulnerable to hacking. Who knows where in the United States or overseas that call might be stored. Calls are also recorded to be used against a consumer should there be a dispute later with that business. Representatives claim the bill was never intended to allow secret recordings. They say the bill is being revised but didnt say how. Groups say a 2006 Supreme Court ruling upheld the ban on those secretly recorded phone calls in california law. Between diseases and insects there are hundreds of things that are on the states list as being serious potential pests. Reporter yolo county deputy ag commissioner bill lyons says insects like these fruit flies found in guavas from florida could devastate california crops. If they become too widespread it becomes very expensive and difficult to eradicate them. Reporter but since using detector dog teams, yolo county intercepted up to 25 packages a day. A program so successful, the usda is giving it another 50,000 to add more dogs like dozier. Its a needle in the haystack and dozier is the needle finder. Citrus producers in fresno sawed off large portions of their trees because theres not enough water to keep the dense canopies alive. Reporter Shaun Livingston never got the chance to live up to the expectations placed upon his shoulders when the clippers took him fourth overall out of Peoria Central High School in 2004. We warn you, the reason is graphic. Hes hurt. Reporter eight years later, livingstons career is still defined by that horrible injury. To this day he said he never watched the tape. It harms more than helps me. Reporter it changed him from nba prospect to pariah. The warriors are his ninth different team. But his career in a way has come full circle in oakland. Its one of those things that will probably go down in history as one of the worst knee injuries. Reporter johan is the head trainer for the warriors. In 2007 he was working for the clippers that night and rode in the ambulance with livingston to the hospital. For how bad the injury was, shawn was shawn was calm with you i dont know he thought it was so severe but we downplayed it on the ride to keep his, you know, emotions at bay. Reporter but emotions soon ran high at the hospital after hearing the worst. Theres artery in the back of your leg that controls blood flow and so if that was damaged, then gangrene could set in and i could possibly have to amputate. So thats where amputation came in and thats all i heard. Reporter he still has his leg but the work to keep it in shape is ongoing. Wang helped start his rehabilitation in los angeles and continues the process here in oakland. Am i surprised that he has been able to propel himself back up to the top . Absolutely 100 . But he is he just perseveres through everything and i think at the end of the day this has made him a stronger athlete. Reporter Shaun Livingston is healthy. The warriors are healthy.
