Tonight marine biologists are trying to figure out what killed a humpback whale that washed ashore near monterey. 45foot long whale was found this morning no obvious signs of trauma but it appears to have been dead for a while now. Experts say it was in the beginning stages of decomposition. The carcass was seen floating offshore last night. It washed up this morning at Sunset State Beach. Biologists say its not uncommon to see one on the california coast. It comes in waves. Last year we had one, a few years before we didnt have any and some years two or three. So humpback whales are a little more unusual. And the experts say that monterey bay has often been a feeding area for humpbacks almost year round. A necropsy was performed today. Neighbors have been doing everything they can to stop it. New at 6 00, kpix 5s da lin is in the berkeley hills. It all comes down one specific kind of tree. Da. Reporter thats right. Eucalyptus, veronica. And just when you think this 10 year battle between neighbors is over, its not. Some neighbors filed a lawsuit this afternoon trying to stop fema from cutting down this eucalyptus trees. Eucalyptus trees are all over the berkeley and Oakland Hills. They are next to the Historic Claremont hotel, behind homes and they are even on streets named after that. But this nonnative species can pose a huge fire danger. Some blame the trees for fanning the 1991 Oakland Hills firestorm. Any eucalyptus is a candle waiting to be lit and the heat up and then like artillery shell, they explode. Reporter some neighbors asked fema to cut all the eucalyptus and other nonnative trees but other neighbors want to save the eucalyptus. They say thinning the hills like this is the way to go. What we want is real five risk mitigation, not native plant restoration. Reporter fema spent tens of thousands of dollars and 10 years and finally released a decision yesterday. But no one is happy. One side says it only removes most of the eucalyptus and not all. The remaining trees that are there will create debris and will create a fire danger. So this is not going to solve the problem. Reporter the other side compares the fema plan to clear cutting. We would lose, you know, well in excess of 100,000 healthy mature trees. Reporter the Hills Conservation Network filed a federal lawsuit to stop the plan. Both sides admit they are tired of this prolonged fight. Goodness gracious. We have to continue you know, its not over. We have to do more of it. Reporter this fight turns neighbors against each other. They live on the same street. There is no end in sight w this new lawsuit, we dont know how long it will last. Live in berkeley, im da lin, kpix 5. The plan fema released yesterday would cost taxpayers close to 6 million. Thats in addition to the more than 100,000 who received inaccurate forms. In all, at least 13 of all the forms sent out. And those numbers still dont include people like jeff, who was just told he had to file a dispute to get a form and wait up to 60 days, well past april 15. Wasnt it covered californias responsibility to get these forms out over a month ago . Sure. It is our responsibility to get the forms out on time and accurately. This is the first time that tax forms and taxes have been intertwined with healthcare. Reporter dana howard says they got the vast majority out on time and they are working through the procedural issue us with the other delays. No consolation for people like jeff who worry it will cost him. I owe money. I dont want to have to pay interest or penalty on top of that. I want to file on time. They send their alcohol 65 miles away to their distributedder in morgan hill and then a third party buys it and it comes back to alameda. 130 miles roundtrip so the bottles can be sold 10 feet away from where theyre made. Thats why some state lawmakers introduced a bill allowing customers to buy three bottles at spirits tastings rooms and into the hands of the distilleries best marketers. They are going to take those home and they are going to invite their neighbors over to sip those. Thats part of the fun of tasting and immediately getting to buy what you like.
