We had oakland pd in riot gear come out 10 minutes ago and they are preparing right now behind me for those protesters from 0 gala plaza to headache to make their way to this intersection. We talk to mayorelect libby shaft were going to have a new mayor in the new year. We asked her the horrific vadalism we saw in oakland last night once shes mayor what would she do differently. Three days until the biggest shopping day of the year and olli doesnt have a thing to sell. These looters took about everything he has. Copycating the vandalism in ferguson, missouri. Its sad to see the democratic process get tan ished by anarchy but thats the state that we live in. Trashing of oakland was completely unacceptable. Reporter mayorelect libby shaft didnt agree request the grand jurys decision in ferguson but equally appalled by the vandalism in her hometown. We are absolutely committed to making sure that not only do we prevent it but that people who engage in that type of destructive behavior get called to task. Reporter at least 10 businesses vandalized and 43 people arrested. At times officers resorted to tear gas just to maintain order. Police chief called the crowd quote very confrontational. Throughout all this our First Priority is always safety of people whether that be our own staff, protesters themselves or innocent people happen to be caught up in a protest. The top priority is preserving human life. Reporter to prevent more chaos tonight. Oakland plans onramping up the number of officers, even requesting more help from chp. Now store owners are bracing for a possible round 2 of unrest tonight. I hope the businesses feel as a city we will double our commitment to ensure they remain open they remain undamaged. Reporter so back here live in oakland were at broadway and 7th. You might be able to make out behind me we have a row of Oakland Police officer in riot gear right now. The protesters i assume they are the ones coming from franco gala plaza. They are making their way in our direction getting closer to oakland pd right now. Police officers right there in riot gear ready for them. The police chief today said officers showed tremendous restraint in their behavior last night. Looks like tonights just starting. Were going to have to wait and see what happens veronica. Mark, we saw you speak with incoming player libby shaft there. I was curious where was mayor calm quan and what did she have to say. Reporter she talked about being there along with the Police Officers last night, experienced what they were experiencing, the fireworks, the pyrotechnics, the bottles being thrown at them. So she definitely spoke in terms of being embedded with the Police Officers last night. Veronica im not sure how long she was with them, but she spoke to what they were up against, and hopefully we dont see that same kind of may have tonight. Mark, thank you. Mark kelly live for us in downtown oakland. Last nights protest left a trail of destruction across a four block area downtown. In all, 43 demonstrators were arrested for crimes ranging from burglary and vadalism to assault on an officer. One officer suffered a concussion after being hit in the head with a brick. Two others had minor bumps and bruises. Heres a live look at the area near 24th and mission where about a hundred protesters have gathered, signs up. They are not marching. They are stationary there right at the intersection of 24th and mission. They were protesting there as well last night. Although most of the action, most of the violence happened in oakland here in the bay area, did not happen in San Francisco with a few minor exceptions, and were keeping an eye on this as well in case it starts to flareup. Were monitoring other cities across the u. S. Ive heard it being referred to as thousands of fergusons across the nation. Reporter it truly has become a national protest. Police in many cities right now are dealing with these street demonstrations. Were going to begin with a live look at the crowds in boston, hundreds of people have gathered to block an entrance to a major freeway there. Police are allowing them to protest in this intersection. So far its peaceful. Lets go to new yorks times square, crowds were clashing with police there, a Massive Group of protesters blocked the entrance to the lincoln tunnel. Of course a major roadway leading to new jersey. They tried to march through the tunnel they turned around went back to the streets. They surrounded buses and cars. Now in philly crowds started protesting about 3 00 this afternoon. And what started out as a hundred people quickly more than tripled in size. They marched through the city taking over streets there. Let me show you a busy intersection in los angeles. Traffic at a complete stop as crowds blocked the streets. Protesters chantsed, they held up signs some even were lying down in the road. A group of couple hundred started marching just a couple of hours ago. We will continue to keep watch on the demonstrations bring you the latest up dates. Allen, thank you. Attorneys for the family of Michael Brown are vowing to push for federal charges against officer Darren Wilson. Today they criticized how the grand jury process was handled calling it rigged from start to finish. We object publicly and loudly as we can on behalf of Michael Brown, jr. s family that this process is broken. In this case a lot of that frustration with the process has focused on the grand jury itself. As Elizabeth Cook shows us, going to that grand jury was a choice and it might have contributed to the backlash itself. Thats right. The prosecutor had options. He could have charged officer wilson with a crime and taken the case toward a trial. He also could have dismissed the case entirely. But ended up going in a different direction. One that is defined by secrecy. Lets say i never had any of my clients being fed that self defense gase. Reporter law students at Santa Clara University gathered to discuss the Michael Brown case. The conversation back to those two words. His office controls every bit of evidence that goes before the grand jury. Reporter the grand jury one piece of the legal system most of us never see. When you have a grand jury process, it is by definition secret. Reporter a retired judge and now the independent Police Auditor for san jose. There are a number of theories about why prosecutors choose to go that route. They dont have to, they can home a preliminary hearing. Reporter you may remember the preliminary hearing in the o. J. Simpson case. Three steps leading to you the front entrance. Reporter think of that as a mini trial. The judge can decide whether this is enough evidence for a real trial. But it also gave everyone with a television a chance to watch the case unfold in a familiar courtroom setting. In public, open to the public where the accused has an attorney, there can be cross examination and explanation for the evidence and the rules of evidence apply with the judge deciding if theres probable cause. Reporter another big difference with the grand jury it is conducted entirely by one person. The prosecutor is the key person in a grand jury proceeding. Its his or her show from beginning to end. Reporter in this case, the prosecutor was already the target of intense skepticism in some parts of the ferguson community. People trust the system when it is transparent, when they know whats going on when there are no secrets. Reporter a federal grand jury could take up the case. This is no double jeopardy in play here because the officer wasnt indicted. But so far no indication that that will actually happen. The big difference here i guess the prelimb would have been open to the public. You would have more scrutiny from the public. If youd like to more of officer Darren Wilsons grand jury testimony we have posted it on kpix. Com. Stay home for the holidays instead of spending it from behind bars thats the offer for certain criminal offenders. Reporter its rare to get a break from the criminal justice system, a Second Chance if you will, but thats exactly what the Santa Clara CountySheriffs Department is doing for the month of december. Tens of thousands of people will be eligible for this program, but past experience shows that only a small fraction will actually take advantage. Every day people with arrest warrants come to the Sheriffs Office to self slender. Many times they get handcuffed on the spot and taken to jail. But now operation Second Chance is offering an amnesty of sorts. Nonviolent nonfelony offenders can turn themselves in and get a new court date instead of getting caught and spending the holidays behind bars. Its giving people an opportunity to deal with some type of crime they committed and deal with it without having to go to jail. Reporter right now 70,000 people in Santa Clara County have warrants out for their arrest. This rotating file has all of their names. Last year only about 200 people took advantage of operation Second Chance. Thats just one out of every 285 eligible. Theres a lot of people out there that could be taking advantage of this program. In my past i found myself in situations i was afraid to even go to court. Reporter home designer Keith Williams had his runins with the law as a young man says fear and ignorance of the system keep people from doing the right thing. They got some trouble behind them looking behind their shoulder the police is following them. They dont know if they are going to be stopped and go to jail. You can put that behind you and move forward. Reporter the sheriff calls it a win, win. It saves us jail space it saves us money. Reporter we also need to talk about who is not eligible for this, and that is anyone with the a warrant involving violence Domestic Violence anyone who has a warrant for using a firearm, resisting arrest or giving false information to a Police Officer. But many other people involving duis and infractions where they did not show up in court now have a bench warrant those types of people will be eligible for this. It starts next monday and runs the full month of december. Reporting live in san jose, kpix5 news. The Sheriffs Department has been doing this for the last 10 years. Dubose triangle for years it was a crummy neighborhood 20, 30 years ago. Now its gentrified like much of the rest of the city. That made things better but now theres talk maybe the bad guys have figured it out and gentry fix brings with it a lot of money and lot of things you can steal. They dont think its going to happen someplace like here. Reporter but it has. Early monday morning 22year old Michael Marquez was killed during a mugging by five robbers. They took his companions backpacks and cell phones then they shot him dead. It was a cell phone. How could you do this to someone over a cell phone. How could you destroy friends and family and anything for what, a piece of plastic . Reporter another man who were gay was killed in the summer what is thought to be a hate crime. Any time you have two People Killed like within a five block radius, i think something needs to happen. Reporter but even before all of that the neighborhood blogs were talking about a flu influx of homeless and gangs who may be targeting the area because of its newfound wealth. They are driving them out of the mid market area and everybody is coming this way the homeless. Thats pretty much a general feeling. Obviously no neighborhood is immune from violence. People do travel, suspects do travel around other neighborhoods where typically not accustomed to see Violent Crime. Reporter while Violent Crime is down 33 in the entire Police District surrounding the area, such figures arent broken down by neighborhood. I think its gotten worse. I think there are problems in any neighborhood in the city. I think thats just goes handinhand with living in an urban environment. I think its a very safe neighborhood. Reporter a couple of minutes ago homicide investigator came up to me and said can you get the word out they are giving out fliers a homicide detail, we need your help looking for the murderer of Michael Marquez. The city of San Francisco says it is getting help from the much maligned tech workers who have organized work parties to actually go out and clean up the area on weekends. Want to get you back out live to oakland weve been watching the situation there. Protesters again on the move. This is a second night, a second night where it appears demonstrators are blocking the freeway again. This is the 980, 980 freeway at castro street. Again its a repeat of tactics from last night. When they were targeting traffic on 580 heading both east and westbound, were looking at live chopper pictures there it looks as though traffic is at somewhat of a standstill you see the protesters walking across the street. Last night they have climbing on to the freeway barriers and march together in solidarity. This is of course after the grand jury reached its decision not to indict officer Darren Wilson in the shooting death of Michael Brown. You see that the traffic is slow going, but again this is 980 at castro street. Your ticket to a better nights sleep ears the. Take you out right now live to oakland. We have breaking news. Protesters are once again on the move. You can see a line of Police Officers there. These are pictures that are coming in live from chopper 5, and what weve been able to show you is that the interstate 980 freeway has been blocked at castro street. Now, its 6 30 the height of rush hour and people are not able to negotiate the freeway. Same thing happened last night on 580 that affected thousands of commuters well into the evening hours. The chp says about 300 protesters are in the lanes of traffic right now. Of course, when youre driving in Something Like that, you have to stop because there are people going in between cars, makes it very difficult for anyone to move at all. And its just a messy specially if youre trying to get home. Joe vazquez is in oakland live on the phone. From your Vantage Point what are you seeing . Reporter im sending back live pictures here. What were looking at right now the intersection of 19 did he castro which is an entrance ramp to 880 is a tactical retreat by the demonstrators. A large chunk of them got on to the freeway before police could block it off. And one big chunk of them did not get on and they are now retreating trying to get to another area as the police have effectively blocked the entrance ramp of eastbound 880 right here at castro. But not before a whole bunch of them got on the freeway and were dodging traffic for a while. Cars were having to dodge them as well. Ive lost track of that mob that was on the freeway maybe you can still see them with chopper 5. But i can tell you this is a large Police Contingent now deployed at the entrance ramp and pushing demonstrators back a couple of blocks. What weve seen here ken over the last half hour or so is a demonstration that was on the move that didnt really seem to have any direction, but you could tell they were poking at the freeway they have seen to have gotten quite a bit of mileage yelled, lot of publicity from getting on to the freeway yesterday. We could tell they were trying to get on here trying to get on there, and they found this opening, and as quick as the police are as much as they have been paralleling them, that is driving on parallel streets and keeping an eye on the group of demonstrators about 300 total , they were not able to get to the entrance before this group. I think weve seen in the past, this is a tactic that weve seen almost exclusively in oakland. It doesnt happen too many other parts of the bay area, but joe, to explain to people, sometimes how do the police not get there . They know where the crowd is. Well sometimes the crowd actually goes up the onramp backwards they will go into the freeway the wrong way where Police Cruisers cannot follow them and they start as to inundate traffic lanes and it stops up. Reporter in this case theres actually a row of bushes that are not along a road if youre getting on the onramp, and youre halfway on to the freeway, theres a row of bushes able to cut through the bushes and get on the onramp on to the freeway before the police could, you know race over here and stop them. Were talking about a matter of 2 or 3 minutes before the police were able to stop and block off the freeway entrance. But by then a whole bunch of crowd got on. Were looking at these pictures that youre sending back. Its veronica, by the way. We do see some of the demonstrators carrying signs. What is their message tonight are they chanting anything . Reporter it is more of the same from yesterday. A message about ferguson some of the signs are saying talking about dont shoot. But also you see a couple of journalists here. Chronicle reporting wearing a helmet i is what its come to. It is a similar message from yesterday that they are standing in solidarity with the demonstrators in ferguson. They initially tried to collate at the Oakland Police department but they quickly started roaming the streets. What were seeing is about half of the contingent of Police Officers blocking there entrance starting to mobilize and move to a different direction presumably the crowd is regrouping and regathering and so will the police. Joe, give us the high of the land. Where are you exactly . Okay. So, right now this is the eastbound entrance ramp to 980. See these bushes right here. Well, right over here theres a little patch where they are able to get in. As you can see thats already sort of halfway down the ramp. So thats where they will sneak in and they got on the highway right over there. Looks like that tick off ramp is going to be cleared by police. They are moving now toward the south. And it almost looks to us like traffic is moving southbound right there. But im not sure about the eastbound lanes. As you walk across we can see a little bit more of it. A lot of emergency vehicles down there. So im assuming traffic is blocked up. Reporter the eastbound lanes of 98 or on. Im being told they have to move back here. The eastbound lanes of 980 are still blocked off. They have now evacuated this area but still along the highway hoping to keep anyone else from getting on the highway. All right. Well stay with it as long as you want to. It looks like that area is being cleared with protesters and traffic is moving. Emergency vehicles starting to move now the ramp is clear now. And it looks like that crowd has moved on now to another location. Reporter yeah were going to catch up with it if we can. Well continue to monitor their situation there. Joe vasquez reporting live from oakland with firsthand account whats been going on with the freeway blockage on 908. I would caution anybody who has got to drive home tonight be aware of the fact there may be people if youre going through the oakland area on 580 on 980 this has been the pattern last couple of nights. Take an alternate route if you can. Absolutely. For the first time we are hearing from the ferguson missouri Police Officer who shot and killed the unarmed teenager, cbs reporter chris van clief joins us live from missouri with that report. Whats the latest . Reporter we have just been able to get down back where the police have shut the street down as you would enter ferguson, what we saw there armed members of the National Guard in body armor and assault weapons along with state and local police turning people around residents of ferguson are surprised how calm things have stayed. Generally thats the story. Things have stayed generally calm. We have some reports of a few issues here and there but generally speaking so far tonight nothing like what we saw last night. This as were hearing for the first time from officer Darren Wilson. Officer Darren Wilson told abc news he used his training on august 9th the day he shot and killed 18yearold Michael Brown. Some of the eyewitnesses said he turned around and put his hands up. That would be incorrect. Reporter wilson said brown threw the first punch while wilson was in his car and grabbed the officers gun. The grand jurys decision not to indict officer wilson sparked mass outrage in ferguson overnight. Rioters destroyed several businesses in town and vandalized many others. The mayor said help did not arrive in time. The National Guard was not deployed in enough time to save all of our businesses. Reporter missouri officials are promising think will be different. We are bringing more resources to ferguson and other parts of the region. Reporter the governor activated more than 2200 National Guardsmen in the region. They are working in shifts. Michael browns father has been calling for peaceful protests but did not speak at an afternoon News Conference his lawyer criticized the grand jury process. We object publicly and loudly as we can on behalf of Michael Brown, jr. s family that this process is broken. Reporter officer wilson is still on administrative leave and a federal investigation is ongoing. Today president obama announced in light of whats been happening here in missouri the administration will begin a series of regional meetings focused on the topic race and the police. Ken. Chris van clief reporting live for us from ferguson, missouri. Thank you very much. Lets go back out live to oakland where we were just talking to joe vazquez. He had gotten some demonstrators on film. He was following a couple of protesters who were on the 980 freeway, the interstate 980 around castro street. They are marching down a city street. Were going to stay on top of this developing story and bring you more after a quick break. ,,,,,,, n franciscos. Moments ago we were just looking at live pictures out of oakland. We want to show you some photos that are coming out of oakland as welch this is oakland. Group of protesters there marching along what i believe is the side of the freeway. These are the surface streets now. Moments ago they were on interstate 980 around castro street thats where we caught up with joe vazquez who showed us some live pictures of demonstrators who had gathered about 300 of them to march across the freeway there. It looks as though they have been removed off that freeway and now they are on city streets. We also have some images coming out of San Francisco. Live from chopper 5 weve got pictures of demonstrators not sure exactly what street this is. It could be mission. They have been around 24th and mission is where a group of about a hundred people actually gathered near valencia as well. They seem to be following up in one of the intersections. San Francisco Police of course right there monitoring the situation. We havent had any reports tonight of any vandalism from this group or the group in oakland. That of course is subject to change even with close Police Presence things can get out of hand rapidly. Thats why we will stay with this and well be back with more right after this. ,,, every day is a new opportunity to help make life better right here in San Francisco.
