So far peaceful, no trouble on the ground, but of course the grand jurys decision has yet to be announced. But the marchs have discorrupted traffic. A lot of pro disrupted traffic. A lot of protesters marching through rows of car, all headed to the Ferguson Police station. Police are lined up to take defense of the building if they have to, well be watching the situation all night. Live update at 6 30 if not before. Thank you. All right, bringing in the legal analyst, melissa, the case before a grand jury, normally low bar for indictment. Right, looking probable cause, you have a grand jury to determine whether theres enough evidence to warrant an actual criminal trial, so not nothing, but it is low bar to just see if theres enough to actually take the person to trial. All right, we know the grand jury doesnt have to reach a unanimous decision, whats the makeup . Seven men, we know five women, nine white people on the grand jury, and three black people, and i tell you, it might be the only thing we learn because state law requires the county to withhold the identity of the members of grand jury, and they deliberate in private and we my never know whos on it or how or why they voted the way they did. And any statements the grand jury makes, theyre protected, what about the range of options, i suppose they can let the officer go with no charges leading up to murder. Thats right, and missouri is a Death Penalty state, so theres murder all the way down to manslaughter, all the way down to nothing at all. In the case the prosecutor turned over all the evidence to the grand jury, and said you guys decide what youd like to charge, thats unusual. Usually the prosecutor will say this is what we think you should charge them with, but in this case its all in the hands of the grand jury. And the grand jury has had the case now for the past three month, does that seem about right in terms of how long theyve been deliberating . Well, remember they only meet once a week, so it seems like its taken awhile, but theres also evidence that theres a lot of witnesses and experts they have taken into consideration as well. All right, thank you. Phil is live in oakland, whats happening there . Reporter well, this is demonstration going on awaiting the word from the grand jury, just like a lot of the rest of america. Protesters gathering here at 5 00 oclock, promising to go into the night. We just spoke a couple of minutes ago with a Police Spokeswoman and asked her the rules this time for the demonstrations. We want to remain fluid, we want to remain open, but the bottom line is we want it to be safe the record everyone. Reporter so the basic rules are going to be theyll allow them to go out in the street if they want to, taking over the intersection is sort after a tradition here, and then of a tradition here, but if they hit the stores, the police will move in. So far however its noisy but peaceful. Everyone is waiting for the verdict to come in, theyve already made up their minds, and theyre letting the world know about it. All right thank you. And of course heres whats going on at the county courthouse in ferguson, and if anything starts to break well go to it immediately. And mark is in San Francisco, any demonstrating out there tonight . Reporter it has just started, they started trickling in around 5 00 today, its definitely grown a little. I spoke with some of the protesters, theyre out here for one reason, and its what theyre calling an epidemic of Police Brutality, not just in ferguson, but all across the country. Now this group, this political protest, its an Organization Act now to stop war and end racism. Theyre holding the protest here in the mission, and two dozen protests all across the country comparing ferguson to grant. And police say brown struggled with the officer, but the crowd here saying brown was shot with his hands up, unarmed, and theyre calling for the grand jury to indict him. So the protest here at 24th and mission, a lot of anticipation as far as what that grand jury is going to decide. I spoke with San Francisco police just a few hours ago, they tell me theyll be monitoring this corner of the mission for the rest of the evening. Of course theres also a little bit of concern when it starts to get dark as it is right now, that some trouble could start to brew, but police are ready for anything at this point. Live in the mission, mark kelly. All right thank you. And melissa, our legal analyst is back. Now the grand jury has gotten the case, and theyve been looking eight for several month, and weighing all the different evidence and information thats come in, and even to the point of subpoenaing their own witnesses and getting people to testify, when they render their decision to charge the officer or not, what happens after that . If they decide no charges, can the county prosecutor come in and say we are going to charge them . Yes, they can. The prosecutor can make the decision to indict the officer anyway. He could also get a second grand jury to hear the case again, but they already said they dont plan to do this, so while he has the power, its unlikely well see any additional moves by the prosecution. Theres still two federal investigations going on though. What are those two investigations taking place now . The department of justice is looking at two things, the actual incident, and theyre also looking at the Ferguson Police department as a whole to see if theres issues causing violations of civil rights, so theyre both happening, not going to be effected either way depending on what the grand jury does. Whatever happens tonight, the brown family would still have the right to file civil litigation against the Police Department and officer himself. Yes, in the oj simple son simpson trial, he was exonerated, but the family still filed a suit against him, and got money. Its actually easier to prove wrongful death in a civil case than in a criminal case, and thats one reason why they might be looking to do that. How likely would the brown family for them to come, to go after officer wilson versus the Police Department, versus the state, versus the county . Well, they definitely want to go after the state and county because thats where the money is, so theyre looking to show institutional bias, and they should have known this would happen, and wilson maybe demonstrated some previous issues with a situation like this. Those are the kinds of things theyd be doing. Officer wilson probably doesnt have enough assets for him to be the target of the lawsuit. Standing by, theres a live picture in the inset there of ferguson both inside the county prosecutors officers, and outside. Probably the courthouse or the Police Department there where hundreds of people have gathered tonight to be there when the information comes down from the grand jury. We are going to monitor the situation there and cut back immediately once anything gets going. In the meantime other news to talk about, including the new bart extension to Oakland Airport. Its up and run, and it could be decades before the connection pays for itself, but Ann Notarangelo shows us if initial rider reaction is an indication it could be sooner rather than later. It was wonderful, truly wonderful. Reporter people riding bart to the Oakland Airport are gushing with appreciation for the new more convenient way to get to the airport. Im so happy that i was born in the era of technology because i love it reporter this weekend nearly 3900 passengers took bart to oaklands, up about 28 percent compared to the same time last year. All eyes on wednesdays big travel day. If they get a 20 percent increase from last year, theyre looking at 5,000 people on the threemile stretch, but with a price tag of 484 million to build it, it will take nearly 81 million rides to cover the cost. Is it worth it . Whats the airport worth to the area . Reporter bart to fso has more than paid for it. Riders fares will cover the operating expenses in oakland, and bart thinks by 2030 theyll get all the money it took to build it. Thats if it lives up to expectations. I dont know if id do it all the time. I mean, we have family that would pick us up and take us, but not today. Reporter at 20 per round trip ticket its too expensive. I have to look at San Francisco connections too because its not Cost Effective to go to oakland by bart. Reporter with two children in tow she thought it was expensive. And bart brought in extra staff to help riders get acquainted with the new system. And again were monitoring the situation in ferguson, a live picture, the grand jury will make their announcement whether to charge officer wilson tonightful thats why the crowd is outside the Police Station. For those of you watching cbs prime time programming, it will continue shortly right where it left off, but right now we are about to hear the grand jury decision in the Fatal Shooting of Michael Brown by ferguson, Missouri Police officer Darren Wilson. For the past three months, 12 st. Louis county grand jurors have been hearing evidence in the case. Wilson shot brown, who was 18 years old and unarmed, during a confrontation on a ferguson street. Wilson says there was a struggle over the officers gun and he about 150 people crowded outside the county Justice Center to hear the announcement to be part of the communitys history. This courthouse has been secured by National Guardsman and Police Officer, and they want to hear what the 12 members of their community, seven men, five women, did they find something criminal in what officer wilson did the day he shot Michael Brown, and thats what theyre here to hear, and this community is bracing for whatever happens. And heres where were expecting the county prosecutor to show up in a few memo, and i believe moments, and i believe we see him coming through. Yes indeed, the county prosecutor with the grand jurys decision. Good evening. Thank you for your patience. Sorry were late getting up here. I have a statement, the very beginning here, and then well be happy to answer some questions when were finished with that. First and foremost id like to extend by deepest sympathies to the family of Michael Brown. I know regard letters of the six regardless of the circumstances here they lost a loved one to identify lens, and their violence, and their pain knows no bounds. August 9th, Michael Brown was shot and killed by officer Darren Wilson. Accounts filled with speculations on social media, and little if any solid accurate information. Almost immediately neighbors began gathering, and anger began growing because of the various description of what had happened, and the underlying tension between the Police Station and neighborhood. The Police Conducted an extensive investigation at the crime scene, at times under trying circumstances. Beginning that day and continuing for the next three months, along with the agents of federal bureau of investigation at the direction of attorney general eric holder located numerous individual, and gathered additional evidence and information. Aware of the growing concern that the investigation and review of this tragic death might not be full or fair, i decided all the physical evidence gathered, any people witnessing any part of the shooting and any other matters would be presented to the grand jury. 12 members of community selected by a judge in may of this year, long before this shooting occurred. Id like to briefly expand on the unprecedented cooperation between the authorities. The attorney general pledged federal investigators would work with local authorities as closely as possible at every step of the way and would follow the facts wherever they take us. Our separate investigations followed the trail of facts with no preconceived notion of where the journey would take us. The only goal was that the investigation would be thorough and complete to give the grand jury, the department of justice, and ultimately the public all Available Evidence to make an informed decision. All evidence obtained by trillion authorities was federal authorities was immediately obtained by the st. Louis county investigators, and vice versa. An autopsy was performed at the request of the brown family in addition to the federal autopsy. All this information was also shared. Just as importantly all testimony before the st. Louis county grand jury was immediately provided to the department of justice, so although the investigations are separate, both the local and federal government have all of the same information and evidence. Our investigation and presentation of the evidence to the grand jury in st. Louis county has been completed. The most significant challenge encountered in this investigation has been the 24 hour news cycle, and its insatiable appetite for anything to talk about. I realize the lack of detail around the shooting frustrates the media were ask general public, and breeds suspicion all distrustful of the system. But the closely guarded details, especially of the physical evidence give Law Enforcement the yardstick to estimate the truthfulness of witnesses. Many witnesses to the shooting of Michael Brown made statements inconsistent with other statements they made, and conflicting with the physical evidence. Some were completely refuted by the physical evidence. Before the results of private autopsy were released, witnesses on social media during interviews and questioning claimed their saw the officer stands over brown and fire multiple rounds in his back, others said he shot him in the back while he was running away, but the autopsy showed he didnt sustain any wound to the back of the body, no additional witnesses made such a claim, and several witnesses adjusted their stories in subsequent statements. Some even admitted they didnt witness the event at all, but merely repeated what they heard in the neighborhood or assumed had happened. Fortunately for the integrity of the investigation, almost all initial witness interview, including those of officer wilson were recorded. The statements and the testimony of most of the witnesses were presented to the grand jury before the autopsy results were released by the media, and before several Media Outlets published reports they received from a dc government officials. The jurors were therefore, prior to the time the information was released going public, and what followed in the news cycle, the jurors were able to have already assessed the correct of the witnesses credibility of the witnesses, and those were consistent throughout the interviews and with the physical evidence. My two assistants began presenting to the grand jury august 20th. It was presented in an organized and orderly manner. The jurors gave us a schedule of when they could meet. All 12 jurors were present for every session and heard every word of testimony and examined every item of evidence. Beginning august 20th, and continuing until today, the grand jury worked tirelessly to examine and reexamine all of the testimony of the witnesses and all of the physical evidence. They were extremely engaged in the process asking questions of every witness, asking specific witnesses and specific information and asking for a certain physical evidence. They met an 25 separate days if the last three months, heard more than 70 hours of testimony from about 6 other witnesses, and review 60 witnesses, and reviewed hours and hours of recorders o. Media recordings of media and police interviews. They examined hundreds of photographs, some of which they asked be taken. They examined various pieces of physical evidence. They were instructed on the law and presented with five indictments ranging from murder in the first degree to involuntary manslaughter. Their burden was to determine based upon all the evidence if probable cause existed to believe a crime was committed and if Darren Wilson committed the crime. Theres no question that wilson caused the death of Michael Brown by shooting him, but the inquiry doesnt end there. The law authorizes officers to use deadly force in some situation, and all people can use deadly force to defend themselves. So the grand jury considered with wilson was the initial aggressor or whether there was probable cause to believe women son was wilson was authorized to use deadly force in this situation or acted in selfdefense. I detail this so everyone will know as promised by promised by me and the attorney general there was a full investigation and examination of all the evidence and presentation to the grand jury. Second, as a caution to those in and out of the media who will pounce on a single sentence or witness and decide what should happen in this case based on that tiny bit of information. The duty of the grand jury is to separate fact from fiction, after a full and impartial and critical examination of all the evidence in the law, and decide if the evidence supported the filing of criminal charges against officer wilson. They accepted and completed it in an expeditious manner. Its important to say again they are the only people, the only people who have heard and examined every witness and every piece of evidence. They discussed and debated the evidence among themselves before arriving at their collective decision. After their exhaustive review of the evidence the grand jury deliberated over two days making their final decision. They determined that no probable cause exists to file any charge against officer wilson and returned a no true bill on each of the five indictments. Physical and Scientific Evidence examined by the grand jury combined with the witness statements supported and substantiated by the violence showed a very tragic story. The synopsis of the evidence follows, please note as i have promised, the evidence presented to the grand jury with some exceptions and the testimony of the witnesses called to the grand jury will be released at the conclusion of this statement. Approximately 11 45 a. M. Saturday the 9th of august, officer wilson was dispatched for an emergency involving a twomonth old infant having trouble breathing. At approximately 11 53 while still at the call he heard a radio broadcast for a stealing in progress at a market. The broadcast also included a brief description of the suspect, black male, white shirt, who took a box of cigars. Other officers were dispatched to that story. Officer wilson remained with the infant until ems arrived. Officer wilson left the apartment complex in his Ferguson Police vehicle, Chevrolet Tahoe suv, and drove west. An additional description of the stealing suspect was broadcast about that time, red hat, yellow socks, khaki shorts, and with another male. As officers wilson was attending to his emergency call Michael Brown and a companion were in a store. The story was reported by the Stores Security camera. Video often played following its release in august by the Ferguson Police department shows Michael Brown grabbing a handful of cigarettes and heading to the exit without paying. As they left the store someone inside the store called the police. After crossing the street the two walked east in the middle of the street, mr. Brown directly behind his companion. Officer wilson continued west and encounter brown. So as we herd, the saint heard, the st. Louis county prosecutor telling us live, the grand jury decided no charges will be filed against officer Darren Wilson in the shooting of 18yearold Michael Brown. This is a live picture of the crowd outside the courthouse and we have mark there in clayton, missouri, whats the reaction been so far to this breaking news . Reporter for most of the 150 folks or so, people just sort of exhaled and sighed, but off to my left there was a man who threw three or four eggs at the building next to the Justice Center here, he was screaming some words i cant repeat on television, and now hes being led away, i thought i saw him being led away by a couple of Police Officer, but hes surrounded by cameras too. He was by far the most vocal disappointed person. The folks here clearly surprised, but no visible reaction, no physical reaction really, but clearly people are just absorbing what they just learned. And so the breaking news of the hour to repeat, a grand jury has decided not to indict ferguson, missouri, Police OfficerDarren Wilson in the shooting death of Michael Brown. The county prosecutor still speaking, but the big news, no charges filed against officer Darren Wilson according to the grand jury who determined he had the Legal Authority to use deadly force in the situation where brown was killed. We want to take a moment right here and rejoin the county prosecutor who is still speaking. Lets listen. Because of public pressure, personal agenda. Physical evidence doesnt look away as events unfold or block out or add to memory. It remains constant, and as such a Solid Foundation on which cases are built. Statements changed, witnesses were confronted with the incipit cities, and conflicts inscient consistencies inconsistencies. Some admitted they didnt see the shooting or only saw part of the shooting. Some others adjusted parts of their statements to fit the facts. Others stood by original statements even though their statements were completely discredited by the physical evidence. Several witnesses described seeing an altercation in the car between mr. Brown and officer wilson. It was described as tussling, wrestling, tug of war. Several other witnesses described brown as punching mr. Wilson while he was partially inside the vehicle. Many said they heard a gunshot while brown was still partially inside the vehicle. Others said he was never inside the vehicle and the shot was fired from an open window while brown was standing outside. The vehicle and officer wilsons clothing were examined by various technicians and scientists. Browns blood was located on the outside of the drivers door, and his blood and dna were also found outside the left rear passenger door of the police vehicle. The blood or dna was found on the inside of the drivers door, the upper left thigh of officer wilsons pant leg, the front collar of his shirt, and on his weapon. Additionally a bullet fired from officer wilsons weapon was located inside the drivers door. The shot was fired from inside the vehicle, striking the door at a downward angle at the armrest. The second bullet wasnt recovered. Regarding the gunshot wound to brown, three separate autopsies were conducted. One by st. Louis county, one by a private pathologist, and one by the department of the defense examiner. They are consistent with one another in all significant respects. Mr. Brown had a gunshot graze wound to the right thumb. The path of that bullet is away from the tip of the hand, consistent with a close range gunshot present inside that wound. Officer wilson also had a medical examination indicating some swelling and redness to his face. Almost all witnesses stated after they heard the shot fired, while mr. Brown was at the car, he hesitated and ran east. Most stated almost immediately officer wilson got out of the vehicle and chased after him. Some witnesses stated wilson fired at mr. Brown as he chased after him striking him, at least one witness saying he struck, or one shot struck mr. Brown. Others states he didnt fire until mr. Brown turned and came back toward wilson. At least one witness stated as wilson got out of the vehicle he shot brown multiple times he he stood next to the week. Another witness vehicle. Another witness said he stuck his gun out the window and fired as brown was running. One witness stated there were actually two police vehicles, and four officers present but only one officer fired a weapon. Most agreed near the conner of can field and copper creek, mr. Brown turned and faced officer wilson. Some say he didnt move toward the officer at all but was shot multiple times standing near the corner with hands raised. Subsequent interviews with Law Enforcement, many of the same witnesses iconologied they didnt acknowledged they didnt actually see the shooting. Some were running for cover, some were relating what they heard, or what they assumed. Other witnesses maintained their original statement that brown had his hands in the air and wasnt moving toward the officer when he was shot. Others said he was shot, excuse me, several witnesses stated that mr. Brown didnt raise hands at all or raised them briefly, then dropped them and turned toward officer wilson who then fired several rounds. Others stated brown stopped for a very brief period, and then moved toward officer wilson again. One described the Movement Toward officer wilson as a full charge. According to some witnesses officer wilson stopped firing when brown stopped moving toward him, and resumed firing when brown started moving toward him again. The witnesses didnt make any statements to the media. The description of how mr. Brown raised his hands or the position of his hands isnt consistent among the witnesses. Some described them as being out to the side, some said in front of him with palms up. Others said they were raised near his head or by his shoulders. Others described his hands as being in a running position or in fists. Theyre also various witness statements regarding browns movement after he stopped and moved back toward the officer. Some said he never moved toward the officer. Most said that the shots were fired as he moved toward wilson. Mr. Browns movements were described as, they said, walking, moving fast, stumbling or full charge. Like other aspects of the case, the varying descriptions were sometimes provided by the same witnesses in subsequent statements for testimony. The entire area was processed by the st. Louis county crime scene unit. Weve been listening to the county prosecutor there wrapping up what we have just now learned that the grand jury has come to a decision, no charges will be filed against ferguson officer Darren Wilson in the murder of Michael Brown. Lets get out live to cbs reporter omar live in missouri, you with us. Reporter yes, how are you doing . And youve been covering ferguson from day one, what is the reaction there tonight . Reporter actually we just had some people walking on the street coming up anxious to find out, we told them no charges were handed, they are upset, and we actually just got a statement from the brown family saying theyre profoundly disappointed the killer of our child wont face the consequences of his action, they are urging peace. Youve heard the statement all week, but heres something that might surprise you, they said join us in our campaign to make sure every Police Officer working the streets in this country wears a body camera, lets not just make noise but make a difference. Right now we understand she is in front of Ferguson Police department, and was very emotional when she heard the no true bill. You mentioned that they were some people visibly upset at the decision from the grand jury, where you are is there a lot of Police Presence or any of the National Guard people there. Reporter were where a lot of the video came from, right behind us is the Convenience Store burned one night. There are now people coming out from the residences, and we have seen dozens of police cars cruising up and down the street, and also seen helicopters, we believe a Police Helicopter circling, so 1,000 National Guardsmen, Police Officers from around the state, a heavy presence, but the protesters ive been talking to since august, and how they changed their protesting tactics said theyll be loud and boisterous, peaceful. We all know though theres an element, we have seen them before in different demonstrations, theres an element there that cant really be identified certain individuals who seem to be really bent on causing havoc and violence, and i know police are especially concerned about those people, have you seen any of those people that you might suspect are going to get into trouble tonight . Reporter well, we saw a couple i recognized from back in august, but the difference is, in august everybody was out protesting, but through several months, a lot of the protesters, theres been leaders who have emerged, and theyve almost been watching out for people not from the area, theyre trying to keep them away saying you dont have a stake in this, and keep it focused on what theyre saying is justice for mike brown, so theyre going to keep an eye on it, but one of the big things, and let me reiterate, a lot of the protesters say the big thing they want to see, they dont want escalation in the police, they want to be loud, but dont want to see office nears riot officers in riot gear. Phil, weve been looking at the protests going on in ferguson, theyre relatively peaceful at this point, what are you seeing there in oakland . Reporter well, the protest has moved off the plaza and taken over broadway, the normal course of events here. Theyve shut down broadway, protesters are roaming up and down the street and holding down 14th here as well. What theyre doing is waiting to see if other people are going to start arriving from bart, oakland, berkeley, as they have in the past, and joining in on the demonstration to see if it grows and starts to take off. As usual the demonstrations, theres different groups involved. As ken was talking in ferguson, you have the concerned people, the Church Groups over here, over in the distance the ministers and such calling for peace. Different groups over here, and people, largely peaceful, little noisy, taking over the intersection, thats it, theyre making their statement, and the police are gogo allow for that. The question is whether the black rock crowd will come, thats usually later in the evening, so it remains to be seen what will happen, but the police arent taking any chances, they have their back up vans there, the patrols are coming in, the police how far are staying in the however, are staying in the background right now because they want to keep the pressure low. And one quick question, again looking at the live pictures, we have a chopper up over this march thats happening in oakland, when the decision was made that wilson wouldnt be charged in the shooting of brown, what was the reaction . The Immediate Reaction . Reporter there was a, there were lined down lying down in silence, there was a lot of shouting and chanting, and immediately we started seeing the protesters start to move down the street in a marching fashion, then moved back up and went the other way, so they just started moving. Well see where it goes from here, but the reaction was get up, move, get loud. All right, thank you. The picture there is of oakland, you can see the demonstrators moving the plaza and move down the broadway area. Here in the bay area demonstrations already underway in several locations, kpix 5s mark kelly is at one of the places, whats going on . Reporter a little different here, everyone staying confined at this point to 24th and mission, but when that decision first came down, there was a bit of silence for a moment before the chanting started up again. Even though this isnt the decision they like, of course this protest wanted a different answer tonight, they believe theres an epidemic of Police Brutality and racism in Police Departments all across the country. A little bit about this organization, act now to stop war and end racism. Theyre holding nearly two dozen protests across the country. In their opinion, officer wilson shot an unarmed person when their hands up, and they wish that he was indicted this evening. Theres no justification for shooting unarmed people with their hands up, so there must be an indictment. If theres not an indictment there will be protests across the country and beyond. Reporter so right now the protests here in the mission definitely staying under control at this point, the chanting still continues, but the reaction when the decision first came down was actually quiet for a few seconds before the chanting began again. I talked to some store owners around here, of course the alarm belling were raised when they hear theres a protest, but theyre used to it here, and if anything got out of control theyd close up shop, but right now everything is staying under control. San Francisco Police are keeping a close eye on the neighborhood. Back to you guys in the studio. All right, mark kelly live in the mission district. So far weve seen relatively peaceful protests, peaceful marchs, and we do know at this point the grand jury has reached a decision, and that decision is that there will be no charges filed against officer wilson in the shooting death of Michael Brown, and melissa is back with us, what do you make of all this, any surprise here . Not entirely, while i think none of us knew exactly what was going to happen, its just extremely difficult to indict Police Officers for issues like this. Theyre able to legally use deadly force, so regardless of the circumstances we knew that it was going to be a big challenge for this grand jury to actually find on indictment here, so we didnt know, but this is not the most surprising result. Do you think the real turning point in the grand jurys decision is because we heard a lot of different testimony and sort of cross testimony, people see Different Things at different times, but one thing it seemed to me as i was listening to the prosecutor was one thing seemed consistent that there was a struggle, a fight of some kind, these two guys got in this. One the suspect were, one the Police Officer, and there were shots fired. There was a fight. Now, at that point, does the officer get certain rights that the average citizen doesnt have . If the officer believes he was in imminent danger he can use deadly force. The jury relied so much on the physical evidence, the prosecutor took great pains to describe the autopsy, ballistics, and when you have a series of con predicting eyewitness conflicting a witness reports, you have to rely on the physical evidence. Hes going to release most of if not all the evidence the grand jury heard, so we can look at the reports, and make a decision for ourselves. So officer wilson, his name will forever be coupled with ferguson. What happens next with him . Well, hes agreed to resign, not surprisingly, so we dont know where hes going to go, but hester a newly wed, so well assume hell move with her. And other investigations happening, federal investigation, two of them. Yes, theyre still on going, as we heard the prosecutor said theyve been cooperating fully with the department of justice. The department of justice has all of the things the grand jury heard as well, and they still could make a finding that browns civil rights were violated. Does the grand jury decision affect their investigation at all . No, theyre separate. The department of justice is looking at civil rights, less so whether or not the officer was criminally liable in this case. We spoke a little earlier about the possibility, probably the likelihood of a civil law suit coming from the brown family aimed at the Police Department, at officer wilson, at the state of missouri. A lot of people could be in line for a long time in court. Oh, thats right, and of course theyre going to be aiming at the places with the deep pockets, so the Police Department, the government, less so Darren Wilson, of course hell be named, but its unlikely he has the assets youd be interested in suing over. They have to prove whether the state or Police Department should have known it would happen and failed to prevent it, so thats a tough thing to prove as well, but everyone will get to see all the evidence theyll have access to as well. Yes, looking at oakland here, and now out to the Ferguson Police station, let me show you what it was like there just moments ago as the decision was read. Some of the protesters as you see immediately began to run down the street. There were on the move but unclear where they were going. So far no major trouble weve heard of, but the big crowd still there outside the criminal Justice Center where officers in riot gear behind barricades standing guard. Just a short time ago, browns parents did release a statement in part it says we are profoundly disappointed that the killer of our child wont face the consequence of hissings, while his actions, we ask that you channel your frustration in ways to make a positive change. We need to Work Together to fix the system that allowed this to happen, and the last thing they say is lets not just make noise, lets make a difference. They ever renewing they are renewing their call for calm, but for now its a very fluid situation, things are bound to change, well keep an eye on it throughout night. All right, allen, thank you. Sort of a branch broke off and demonstrators have been protesting along the route there, and so far again no reports of violence, phil is on the scene in oakland, tells us the oakland Police Department is definitely ready for any kind of trouble that might crop up, and theyre in big numbers out in the street there. So far there havent been any clashes we know of, and no violence or property damage. Again, just a lot of people demonstrating right now. Were also standing by for word from the president , hell be speaking addressing the nation in regards to this grand jury decision, again the decision was to not indict officer Darren Wilson in the shooting death of brown.
