And we are expecting anything could happen as well tonight in the oakland mayoral race. 15 candidates want the citys top job, all are trying to unseat current mayor jean quan. Oakland uses rank Choice Voting where people list first, second and third choices and because there are so many people running, it could be days before a winner is declared. When the san jose mayors race key issue is Public Safety. But for the two men running to replace mayor chuck reed, they cant agree on what to do about it. Kpix 5s len ramirez on a race that has been quite heated at times. Len. Reporter it has been a tough race, ken. Thats because this has been one of the most important recent elections in san jose history. Two candidates are vying for the office of mayor. Two very different approaches to how to solve one of or two of san joses major issues. And thats Public Safety and its longterm financial health. Both candidates have very different views on how to get there. Consequently, this is shaping up to be a very close race. Now, city councilman sam liccardo has bond council for the last has been on the council for the last eight years a big supporter of measure b backed by outgoing mayor chuck reed the pension reform issue. He also pushed for more economic development, transportation issues and ideas on the homeless problem. We started this race 20 points behind. We have had a lot of momentum and are virtually tied and hopefully tonight well find out who is over the top. Reporter county supervisor dave cortese is a former San Jose City council member. His major push throughout this campaign has been Public Safety. He says there are 400 fewer officers on the streets today than when he left the council. He says he can stop police from leaving the scene and restore better working relationships between the city and its workers. A lot of energy here around the campaign office, literally hundreds of volunteers have been out for days now getting people out to vote. Thats been the big issue. Reporter cortese has been ahead in recent polls but both candidates are confident as we head into now less than two hours of voting left here in san jose in this very important mayoral election. The cortese supporters will be gathering here in san jose at the marriott. Hope it turns into a Victory Party later but sam liccardo supporters are still on the job at this hour. We know that. Interesting enough, its not the governor race attracting big spending or the attorney generals race. Its the down ballot race for secretary of public instruction. It pits incumbent Tom Torlakson against marshall tuck who is outsider coming in to try to shake things up. Torlakson is supported by the teachers union. Tuck is supported by the Charter School group. Together they have sent about 30 million in the race so far. And i have to tell you, politicians across the state are watching this one because if the California Teachers Association doesnt win this one, it could thank change the ee division in sacramento. Thats a lot of money. Reporter but it pales compared to whats being spent on another initiative. This is the lawyers versus the doctors. We are talking about proposition 46. And it is basically got everybody slamming each other over the idea of malpractice, whether doctors should be tested for drugs and whether you should have to go to a database before you issue certain prescription medicines. Lets listen to some of the sounds you have pummeled with in recent weeks. Its all about Big Insurance Companies in california who dont want to pay victims anything for the death of a child or stayathome mom or when someones maimed. They get a loophole in the law an outdated law that allows them not to pay these victims. And its very unfair. The clinic i work at Asian Health Services where we treat indigent patients in oakland we are against it because it takes money out against the care. Reporter on the flip side this is one of the ads for 46 that youre seeing here, the money like i said, up to 50 million so much, it is an incredible somebody is making a lot of money off this. One consultant said they will retire on this one. One issue you wont retire on but jerry brown hopes to get re elected on are props 1 and 2, the statewide water bond and the rainy day fund. The governors campaign. He didnt buy signs for his own reelection. He has been pumping these two propositions. They look like they will win and looks like the governor will, too. He is only spending 5 million. The timing is perfect because people know what its like to be in this drought situation and they are worried and a few years ago, the state was going upsidedown. Things settled down because of another measure that got passed. And it all works into his image of steady as you go, be responsible and work it down. You wonder why he picked them . Thats why. The governor voted thursday with his wife in oakland and polls show the governor has a significant lead ahead of his republican challenge erika kashkari. 41yearold kashkari is a former us treasury official from Orange County and making his first run for elected office. Heres what he said after voting today. Theres so many issues that unite you was. I think in republicans focus on those we can make big changes if we focus on that we can make changes and be better off. Nine of those considered to be tossups right now. The latest cbs news Battleground Tracker shows the gop could pick up the six seats it needs to win a Senate Majority. We may not know which way the balance of power will swing. Theres a chance of a runoff in louisiana. Theres a libertarian candidate on the ballot in georgia, as well. The bay area has two chances to make history tonight by taxing soda. Prop e in San Francisco would add a 2 cents per ounce tax on sugary drinks. In berkeley measure d would add one sent per ounce. Supporters say sugary drinks are fueling americas obesity epidemic and driving up healthcare costs. The powerful beverage industry, on the other hand, is pouring millions into the no campaign. Similar efforts have failed more than 30 times all around the country. Voter turnout was expected to be extremely low for this general election. Some polls predict only 46 of registered voters would cast ballots, a record low for a general election. San Francisco City hall was one place with a larger number of voters and lines were expected to get longer tonight as more people began to get off work and head down to the polls before they closed at 8 00. The rest of the bay area not as busy. Walnut creek voters trickled into the polls at the rossmoor location. The Contra Costa County elections chief predicted a 55 turnout there. And for some coco voters wanting to head to the polls they might have had a little trouble this morning. The election website crashed just after the polls opened up so voters were not able to look up their polling locations. That problem has been fixed. Voters in daly city say they have some trouble today, as well. They say the electronic Voting Machines werent working at several polling spots. Regulations on pot clubs. T city council m ding thousands of people in san jose want the city to mellow out. On the tough regulations affecting pot clubs. City council met today deciding when the measure will be on the ballot. Kpix 5s mark sayre joins us live from san jose. Voters will get their chance at the polls to change the rules but not just yet. Huh, mark . Reporter indeed, they are going to have to wait a little bit, ken. The city of san jose just implemented some new rules to regulate pot clubs here in the city. But thanks to a successful voter petition drive over the summer those rules could soon be change. Could soon be changed. The citys new rules on marijuana collectives regulate where they can be, how close to schools, residences and where it can be grown and used. But pot clubs say they are too restrictive and closed some dispensaries so they gathered 25,000 signatures to qualify a measure for the ballot to change the rules. This initiative would undo that and have a system thats essentially a loosey goosy regulatory system where even if you sell marijuana to a child its only 100 fine. Reporter but under state law, the city council only had three choices when it met today. It could immediately approve and implement the voter initiative, call a costly special election for next year, or else put the measure on the ballot in june of 2016. Which was the ultimate choice. This motion carries. Reporter in the meantime, the city is trying to implement its existing rules to crackdown on a few dozen clubs that havent complied with the new regulations. Everybody deserves due process. We need to balance the due process of the people who are not complying with our law with the laws that we have and build an airtight case so when we shut them down, they dont re open the next day. Reporter susan landry lost her brother to cancer and feels sensible medical marijuana laws would have very much helped him with his pain near the end of his life. When youre dying you should not have to worry what youre smoking, drinking, eating when youre dying. You should be able to do what makes you feel comfortable. Reporter now, the group that qualified all those signatures to get these laws changed is called sensible san jose. The cochair of the group told us on the phone today in his view the city really didnt have any choice. They expected that it would go to the voters in 2016 as he put it well, what else are they going to do . They are not going to implement the rules they dont favor. By having the four images it can detect flickers and developing smoke calls. Reporter its first of its kind in northern california. This 200,000 system is a gift from pg e. You this sue its aallege as a result. This adds a safety component for is safe and facilities are safe. The system will detect fires from lightning strikes, accidents, and yes downed pg e lines, too. Anything that causes smoke or flames. Until a few days ago, firefighters relied on this nearly 70yearold device called the osborn fire finder. In the tower, someone would see a fire, take a bearing, and call it in. Dispatch would plot it but to be accurate it required two lookouts to be able to see each individual smoke. Incumbent mayor jean quan was out campaigning today. She said she thinks turnout will be higher than predicted. Polls show she is trailing candidates Rebecca Kaplan and libby schaaf but quan has trailed before and won. She has a reputation as a tenacious campaigner and today she was out she told us her strategy has been to cast a wide net targeting communities that sometimes get neglected in the voting process. Young people i talked to are voting today and, you know, at a much higher rate than people are predicting so im hoping they will call on me to serve again. Reporter she says she was the only candidate to send out mailers in both chinese and spanish targeting nonenglish speakers today. She also told us that she has a sense of confidence that is certainly something we are hearing a lot of candidates saying today. And the breed of choice happens to be beagles because they are so friendly. Our betty yu found a group thats saving these beagles. Some of the video is disturbing, be warned. Puppy, puppy. Reporter life has not always been so carefree for these beagles. These dogs have spent their lives in a cage. We were told directly by the people in the lab that they have never been outside. That they had never seen sunlight. That they had never had a toy. Reporter the beagle freedom project changed that. The organization is dedicated to saving beagles like these used in Research Labs often for chemical and pharmaceutical testing. Since 2010 the nonprofit has rescued more than 300 beagles across the country. 3yearold riley is one of them. He first met his bay area family in july. He was looking at the cheese and the sky and we got in the car and i dont know what he was expected but it start moving and all he wanted to do was run around our car. Reporter at first, riley showed some signs of being a lab dog. On a walk down the street he suddenly laid down to rest. But he quickly learned the robes around his piedmont home from the ropes around his piedmont home from his brother freddie. He taught him how to play. Riley didnt know how to run around and play with another dog. So it was great. Reporter even though these dogs are used to their new lives, there are still reminders of their old ones. They all have tatoos from the lab and spanky here cant bark. He had his vocal cords cut. Its a common procedure in many labs. What goes on in many labs is rarely made public. This video from an undercover peta investigation shows a worker forcefeeding a beagle oxycontin. Another investigation revealed beagles going crazy after being confined for years. I think its really important to note that there is no experiment on dogs thats illegal. Experiments have to be approved by committees within a laboratory. But nothing is against the law. So they are put through all kinds of cruelty. Reporter peta says most dogs end up euthanized. Its rare for beagles bred for a life in the lab to end up here. Oh. Reporter the laboratories dont want to release the animals to us. They simply dont want the information out there.
