A california lawmaker is turning the tables on texas. He was fed one the lone star politicians trying to lure companies away from here so this week, state senator ted gaines is visiting austin, texas to keep california in the running for a massive battery plant that tesla motors is looking to build and he is competing for other jobs, too. There has been an improvement, but were not up to a position where members and the public should have confidence if the system. Radio glitches began two years ago when the system was upgraded. A longtime Livermore School employee is arrested on sexual abuse charges. 30yearold jason quero is charged with sexually abusing a 14yearold girl at the Livermore Valley charter school. I think what we saw today was five men rule that discrimination specifically against women is not discrimination in their book. Reporter the lawsuit is another battle stemming from the Affordable Care act. Specifically, the laws man dade that forprofit companies provide their employees with insurance that covers contraception, according to the laws mandate. Today, hobby lobby and a cabinet making Company Effectively won the fight. The u. S. Supreme court ruled for the first time that essentially companies have the same religious rights as people. But not all companies. They claim its a narrow ruling but what they have effectively done is say womens bosses have a right to determine our personal healthcare decisions. In fact, according to one law professors estimate, 90 of corporations are closely held. The scope of todays ruling has president obama calling on congress to act. I additional branch. The Supreme Court also dealing a blow to a north bay company today. The justices rejected an appeal from the Drakes Bay Oyster Company which is fighting to keep its lease. The secretary of the tyne yor refused to renew the lease for the business which operates on National Park land. The agency wants the estuary to return to a more natural state. Despite the decision owners will continue to fight. Today was a disappointment. But not really a setback. Today we learned that the Supreme Courts not going to weigh in and so we need to evaluate other options but that we do have more to think about. We have a lot of reasons to fight for this farm. The company has been allowed to stay open pending the appeal but some 30 workers will lose their jobs if it ultimately closes. Eight million more. General motors is adding to its already long list of vehicles recalled over faulty ignition switches. Kpix 5s Elizabeth Cook in the newsroom with details. Liz. Reporter allen, the latest recall involves mostly older midsized cars dating back to 1997. It brings the total number of recalls for gm this year to 29 million. Thats well beyond 22 million vehicles recalled from all automakers last year. The problem with the faulty ignition switches is that they can cut off power while driving. Gm now acknowledges 16 deaths from 61 crashes related to that very problem. The expanded recall comes on the same day gm presented its Compensation Plan for People Killed or injured because of those faulty ignition switches. One example, four Million Dollars for a 25yearold who is married with two children earning 46,000 a year. Attorneys say there is no cap on the amount of money the company will spend. Victims families say however money is a poor substitute for their loss. It was quite frankly really difficult to hear, you know, like amber being reduced to a dollar amount. It was a whole lot harder to do this than i really, you know, really anticipated. Gms ceo said we are taking responsibility for what has happened by treating them with compassion, decency and fairness. The attorney hired by gm says claims can be filed beginning august 1. Drivers, passengers, pedestrians and even a second vehicle involved in a crash with a gm car that may have had ignition switch problems are also eligible to file claims. He blamed them for what he called an Immigration Crisis and said if they wont do anything about it, he will. America cannot wait forever for them to act. The president says the influx of more than 50,000 unaccompanied illegal alien children across the borders has complicated the issue. He will ask congress for broader powers to send them back but he is also asking the department of Homeland Security to give him recommendations on what other steps he can take without congress. Tomorrow 140 Illegal Immigrants are scheduled to arrive in the Riverside County town of murrieta north of temecula. As reporter tom waite tells us residents are worried about the strain the people will put on resources. Theres been a lot of talk and we have accomplished nothing. Reporter frustrations are boiling over in murietta where 140 undocumented immigrants are scheduled to arrive tomorrow. The mayor of the town says the group is mostly women and children who crossed the border into texas. The plane will land at 11 00 in san diego. They will go through a screening process in san diego tomorrow at 11 00. After they are done with that, they will be bused to the local Border Patrol office here in murietta. Reporter after the group is processed, they will not be sent back to their home countries. The mayor says immigration officials will see to it the individuals take transportation to stay with family or friends in the area. Based on what Border Patrol told us if they are going to process 140 without incident and these people reach their destinations thats the best case scenario. Reporter locals worried Law Enforcement here will be overwhelmed. Its scary. They said every eight hours they process 25 people. Its like do the math. They are bringing them in every 72 hours. But what about local Industries Like oil here in the bay area we are constantly being reminded to spare the air. What about local industries especially Oil Refineries . Kpix 5s Christin Ayers found out when it comes to one of the most dangerous kinds of pollution, air quality managers are letting them off the hook. Reporter as the bay areas biggest and busiest refinery, chevron is mandated to keep careful tabs on air emissions. We do monitor through a variety of ways particulate matter from the facility. Reporter the project manager says the refinery has kept well under its permit limit and is in compliance. Since the 1970s, we have reduced emissions from the refinery by over 87 . Reporter but deep in this 2,000plus page Environmental Impact report for chevrons proposed modernization project, theres an emissions inventory and the numbers are different. Air district engineers conducted a test on the refinerys main gasoline making unit in 2009 and recorded emissions of more than 1,800 pounds a day. Thats 343 tons per year. More than three times higher than the permit limit of 92 tones. The monitoring shows that they are emitting this stuff. Reporter the communities for a better environment, a nonprofit group, has sued chevron over a previous modernization plan. He says the numbers are higher because they include the finest particles coming out of the stacks, 20 times smaller than a strand of hair called pm2. 5. Most can only be detected using a condensing device something chevron doesnt use. They are letting it continue. They have for five years now. Reporter but we found out its legal. The air district doesnt put limit on condensable pm even though experts say those fine particles are the most dangerous part of air pollution. When you inhale this fine particulate, it makes it all the way down into the deep lungs. And if its small enough it might be able to cross into the bloodstream. Reporter ucsf and uc berkeley Professor John balmes is an expert on the Health Impacts of air pollution. There are linkages from many studies between p. M. 2. 5 exposure and Heart Disease. Sudden death from Heart Disease and hospitalizations from Heart Disease. Reporter why isnt the air district cracking down . They refused to talk to us so we took it to the board of directors. The belief is that they overestimate the condensable portion particulate matter. There were flaws in in in the methodology. So therefore, the data isnt isnt reliable or credible. Reporter have any chance that chevron will take the lead on reducing fine particulate matter . What i can say is that because theres no endorsed or accurate methodology for monitoring for fine particulate matter, uhm, that isnt anything we can do at this time. So in the meantime we just wait .
