The levels in the hetch hetchy Regional Water system are already low and the population is only growing. It wont be that long before if things do not change, we start to seriously consider higher levels and consider mandatories. The sfpuc says they will know in a couple of months if they have to make water cuts mandatory and in the worstcase scenario hetch hetchy has water for a year. Other agencies in the same boat. Marin municipal Water District called for a 25 cut from its customers. Santa clara approved a 10 voluntary water reduction. Do you want to be in a Tall Building during an earthquake or in the bottom of a bay in a tube in a train with a great big ship drawing a 30ton anchor your way. That kind of happened today. A container was trying to tie up at the port of oakland when it lost power. It dropped anchor to kept from drifting. The coast guard determined it came close to the bart tube leading into and out of the west oakland station, the anchor, and took the precaution of calling bart. Bart was shut down and crews were dispatched. I can tell you nothing has happened to the transbay tube. Reporter barts jim allison says crews walked through the tube at the anchor location and saw nothing. He also says instruments designed to respond to water and other problems did not set off alarms. But what if . A ships anchor can weigh tons. What if one dropped on top of the tube . From the beginning the tube was designed with earthquakes, anchors and the harsh Marine Environment in mind. These sections being floated into place back in the early 70s are made of threeeighths inch steel plate surrounded by three feet of concrete. They were lowered into a trench at the bottom of the bay and remained there surrounded by mud. Bart says it cant be sure the anchor even struck the tube. I dont want to go on record and say it didnt hit it. But the bottom line is that its safe for train traffic. The demolition of the old span of the bay bridge is really starting to ramp up even though its still months behind schedule. What to do with all that scrap metal and steel . The cantilever section alone involves nearly 45 million tons of steel, steel that to the contractor is gold. The contractor will sell it and that allows us to keep the bids low and save the taxpayers money. Reporter most of the old bridge will come here to a recycling plant in oakland. This amount of steel in this condition has sparked a lot of attention. Its sent to steel mills all over the world domestically and internationally. Reporter recast and forged, it will go back to work as new bridges and buildings worldwide. Some local artists want a piece of that action, too. Here at the American Steel studios in oakland, the founder feels theres enough steel to go around to honor the bridge with public art. Rather than scrapping this historic structure and all that it represents, it should be preserved and allowed to move forward through the next several generations. Reporter karen knows big art. She is the artist who designed and built several large metal sculptures for San Franciscos embarcadero and burning man. Caltrans says the art idea is interesting. He is one of hundreds of people either of charged or convicted every year of shaking babies to death. For years, doctors have used the diagnosis in child abuse cases. In a separate case, kpix 5s linda yee talked to one bay area father also wrongly accused. Nine 101 reporter a parents anguished call. He is still breathing but went limp. Reporter christian slipped and fell dropping his 3month old baby on a hard kitchen floor. Their arms and legs are not moving and he feels limp in his body. Is he still on the ground . He went silent from had been crying and i fell into shock. Reporter and so began his nightmare. 15 hours after his baby was rushed to emergency, he was accused of child abuse, of violently shaking his baby, not dropping him. The doctors had told us that or at least to me that they thought the injuries were inconsistent with my accounts. Reporter the baby had bleeding and swelling in the brain and behind his eyes. Doctors insisted it was shaken baby syndrome. They were asking me, do you know if he has ever shaken the baby before . No. Reporter doctors told them johan was dying and then the cops came to arrest him. And christian tried to lean over and kiss the baby and they said, sir, step away from the baby. Reporter he was in jail for a week before making bail. Did you ever see your son again . No. Reporter he died while you were in jail . Yes. [ crying ] i broke down. I cant describe in words. Reporter looks pretty violent. Its hard to watch this nanny cam video of a woman violently shaking a baby in her care. Clinical forensic medical specialist says its abusive and can cause injury but shaking alone is not enough to cause the bleeding. He says there are other reasons. These things are nonspecific findings that can occur in impact injuries, birth trauma and complications, theres a number of medical problems that result in increased intracranial pressure and pleading around the brain. Reporter the American Academy of pediatrics agrees there could be other problems besides shaking that can cause brain injuries. But it also emphasizes thats not in every case. San francisco prosecutors decided evidence in this case did not prove abuse and dismissed the murder charge against him. An Attorney Says the Northern CaliforniaInnocence Project is relooking at cases nationwide helping people who may have been wrongly convicted. The danger is that people have been convicted based on faulty science. Science that is wrong. So how do we deal with that . How many people are in prison based on an incorrect hypothesis that was never proven . Guess who is coming tomorrow . Reporter he was banned from living with his family while working to prove his innocence and forced to sell their home to raise money for his defense. 2. 5 years later, the case is now over. As kpix 5s brian webb tells us, they also show he was a potential suspect in the killing of a 75yearold tiburon woman. Reporter the notorious max wade daring teenaged car thief convicted wouldbe murderer inspiration behind a music video. [ rap ] reporter and there may even be more. The Tiburon Police department had known max for some time. Reporter tiburons police chief tells me wade is one of several people investigated for the murder of joan rosenthal, the 75yearold tiburon resident shot to death in her front yard back in 2009. Theres no apparent motive for the crime. Theres no burglary or assault. And to this day we dont know why it was committed. Reporter the chief says investigators looked at wade because he was a tiburon resident too, had a violent past, and for what they found on his computer after it was seized. They found that eddies played an unusual interest in the rosenthal case. He had actually done a number of searches on it on his computer. Reporter no physical evidence ever linked him to joans murder. Her case remains unsolved. It still haunts the chief to this day. Its the greatest professional disappointment of my life. I have been doing this 40 years and if thats one case i would like to close, that would be it. Reporter wades tern said, quote, max wade is not connected to the rosenthal case, a statement by investigators unsupported by fact or evidence dignifies no further response, unquote. The attorney is also planning an appeal on behalf of max wade. Reporting from san quentin, brian webb, kpix 5. Wade was convicted of attempted murder and numerous charges. Hits Attorney Says it could be at least 15 years before he is eligible for parole. A clerk is nursing a head wound after being beaten tied up robbed just after opening his store. This happened this morning in campbell. Police are looking for a man in his 30s wearing black clothes. I think he had a gun in his hand and hit me with it and then i was a little bit unconscious then he tied me my leg and hand and mouth. The store owner says that he has seen the suspect in his store before as a customer. The clerk was checked out by a doctor and then sent home. Fire torched this home and car in santa clara this morning and tonight, police are investigating this as a case of arson. Police believe a woman who lives here with two roommates set the fire. The flames woke up neighbors, who tried to help those inside the burning home. It was a small fire in front of the van and then i woke my husband up to call the police. And we came out, we started throwing rocks at the window. But no one came out. Smoke detector woke the people sleeping inside and saved their lives. The suspect was hospitalized. Other bay area headlines. 16yearold arrested in november accused of setting a transgender teen on fire pleaded not guilty today. Richard thomas is facing assault and hate crime charges for allegedly lighting sasha fleischmans dress on fire while riding an ac transit bus. Fleischman identifies himself as agender. He suffered thirddegree burns. A wanted felon who tried to run from police ended up having to be rescued by the officer chasing him. He jumped into san fransesquito creek at the palo alto baylands. He went under and didnt come up for a while. An officer jumped in for the rescue but had trouble getting up the side of the levee. The Palo Alto Fire Department came in and used a rope system to get the suspect lee james daniels, there he is, and the officer out of the water. Some of the people signing up for Health Insurance through covered california gave personal information to excons some of whom were even charged with financial crimes. Reporter court data provided to us by covered california of the nearly 4,000 working to sign up people for new policies, 31 counselors have convictions, one for harm and injury to a child from the early 2000s, another convicted of two counts of forgery in the 80s, and a third with burglary and forgery convictions spanning from the 80s to the 90s. Still, they are allowed to access personal information of the people they are enrolling. Is there reason to be concerned . Well, we dont believe that there is any heightened reason for consumers to be alarmed. Reporter dana howard with covered california says all approved applicants go through thorough scrutiny to make sure the counselor has changed his ways. Why take the risk . Why allow these people any access at all . Well, its just part of civil rights act. We cannot just wantonly say we are not going to to hire or or certify, uhm, an individual just because he has a criminal background. Reporter indeed, employment attorney john kennedy says there are a number of laws to protect people from being automatically denied work because of criminal histories. But at the same time, hiring convicts could lead the Insurance Exchange vulnerable. If you exposing yourself, you better be comfortable that these people can have our certification. Reporter officials with covered california say it bears repeating that the certified counselors only have had access to those they have enrolled.
