We are gathering new information about the breaking news in san jose where police say an officer shot a man involved in a fight. Officers were called at 3 30 this afternoon to cape horn drive. Police say the situation got out of hand rapidly. They say a man armed with a knife refused orders to drop the weapon and instead advanced towards the officers. When the officerss orders to drop the knife were ignored, the officer in fear of her life and her Partners Life had no alternative but to fire. Man was taken to the hospital, condition unknown. Could be connected the driver of a stolen suv killed while running from a crash on 280 this morning could be connected to a series of crimes. The man was hit by several cars when he ran across the freeway at john daly boulevard offramp at 5 30 a. M. This morning. Don knapp tells us the chp says the investigation led to an unusual discovery in the suv that crashed. Don. Reporter investigators say the actions of the man who was struck and killed were suspicious from the start. They say he took a duffel bag from the wrecked suv and when people stopped to try to help him, he broke away. It was 5 30 a. M. And dark when this northbound suv struck the i280 Center Divide near john daly boulevard. The crash left the vehicle partially blocking the fast lane. The honda civic slammed into the rear. The civic driver received minor injuries. And the suv driver was well enough to get out and walk away. Its what happened after the accident that left the suv driver dead. He ran across the northbound lanes of the shoulder on the right side of the road carrying a duffel bag he had taken from the suv, the man decided to run back across the northbound lanes jumped the Center Divide and attempted to cross the southbound lanes. He was struck and killed by one or more vehicles. People who stopped to help the vehicles were trying to get him to stay at the scene. He did assault one of those people and then flee over the Center Divide and then running into the southbound lanes. Reporter why would he run through traffic . The chp learned he was driving a stolen car. Coming from the standpoint that he was driving a stolen vehicle, it makes more sense. There could be more crimes in that as well and we are looking into those, for instance, the stolen property, the possibly stolen property were looking into. So that could be reason enough to run. Reporter a small caliber rifle and a bb gun were among items found in the suv. Nothing suspicious was found in the duffel bag. Passersby told the chp that the man who ran into traffic appeared younger than the age indicated on the drivers license he was carrying. Body parts were spread over 50 yards of the freeway. The injuries he sustained make it difficult to identify him by photo id. The coroner will make a positive identification. Reporter traffic was tied up for hours. Northbound lanes reopened around 8 00 but southbound lanes opened around 11 a. M. Officer Mike Ferguson told us it will probably be early next well before they have an identification on the dead man. Tonight he is in critical condition. Police say the driver stopped and is cooperating. The man was jogging across the street and he hit him. And he flew up in the air and he landed a couple feet away. He was unconscious. And he was bleeding. Four other pedestrians were hit in San Francisco this week. Police are now beefing up patrols on bush to watch for speeders and jaywalkers. Otters are making a comeback. They are popping up all around the bay area. Meaghan isidore is with the river otter ecology project that studies the otters in the bay area and says theres good news. We have found them in almost every watershed in the entire bay area. And that includes places like oakland and richmond and berkeley, San Francisco even. Reporter they come out during the day too, more river otters are being seen than ever before. Wherever theres water in some sort of food source. Its clear that something is happening in the waters in the bay area. Usually found eating fish or frogging. This familys kids are on the hunt. I just only have whiskers thats all i know from otters. Reporter theres only one way to guarantee seeing an otter. We went to the zoo yesterday and got to see an otter. Reporter shy but not impossible to see, he says he has seen them near his house. You see these little guys munching with their whiskers. And the waters really clear this year because there hasnt been any rainfall. Reporter its believed that years of creek cleanups tougher pollution laws and Environmental Restoration projects may be whats helped the river otter start to recover. The river otter ecology project has logged over 600 sightings in the last two years alone. There could be a lot of reasons why theres more river otters now than 20 years ago which means if you keep your eyes open, you could have a much better chance of seeing one. At lake lagunitas, don ford, kpix 5. In the past two years, about 600 otters have been spotted in the bay area. Maybe something in the water . But we sure could use more of it. A federal judge is meeting with Childrens Hospital oakland and jahi mcmaths family right now. They are reviewing the decision to let jahi mcmaths family move the 13yearold braindead teenager to another facility. Kpix 5s da lin joins us from Childrens Hospital oakland. Now, da, both sides have been in court all day. Reporter thats right. No major developments are expected out of this current Ongoing Court hearing. But earlier in the day, both sides did agree to allow the family to move jahi out of the facility. Im going to deny the request. Reporter siding with the hospitals attorney, an Alameda County judge said he will not force Childrens Hospital oakland or its doctors to insert feeding and breathing tubes into jahi mcmath. It is medically unwarranted, legally unprecedented, unfathomable to the hospital that a court would contemplate ordering surgery be performed on that dead body. Reporter the Alameda County Coroners Office also issued a death certificate today stating jahi died on december 12th, the day she was declared brain dead. But jahis family argues the 13 yearold is still alive. Both sides did reach a formal agreement in court to allow the family to take her out of the hospital. This is a victory in terms of getting us one step closer to move. Reporter as long as jahis mother takes all liability for the move, the hospital will release her and the machines currently hooked up to her. The family says they plan to hire their own medical workers to go into the hospital and transport her to a nearby facility. Thats where their own doctor will insert feeding and breathing tubes into jahi. After that, they will fly the 13yearold to a longterm care facility in new york. The drawnout battle has been devastating for the mother, who was crying in court. Even the hospitals attorney choked up and could not finish his sentence when talking about the tragedy.
