Starting january 1st, the states 6 Million Public School Students can choose restrooms and locker rooms based on their gender identity. Detractors say the law could raise privacy concerns for students. California Supreme Court ruled today School Employees can give students with diabetes insulin shots. Its the final say in a Long Court Battle pitting parents of children with diabetes against the nurses union. Cbs reporter ron jones on what has been an emotional legal fight. This is absolutely a winwin for the kids. Reporter dr. Francisco of Sutter Medical Group is singing the california Supreme Courts praises. They ruled unanimously today School Employees can now administer insulin shots to diabetic students if a nurse is not available. Kids with diabetes have a disease that needs care 24 hours a day 7 days a week. Reporter the ruling reverses a Lower Court Decision that only allowed licensed professionals to administer the shots. But theres a School Nurse Shortage in california. According to the American Diabetes association, an organization that supports the ruling, there is only one nurse for every 2200 california students. The doctor who volunteers tort ada says School Nurses need all the help they can get. There will be someone trained, a volunteer, trained who can help them with it. I dont like it because you dont know if they dont know what theyre doing. Reporter some families are concerned the ruling takes Critical Care out of the hands of medical professionals and jeopardizes the lives of kids. They dont want teachers giving shots. Somebody thats trained to do it that you know has a license to do it. Reporter the American Nurses association also believes the ruling is putting more children at risk. They released a statement to cbs saying, the california Supreme Court has essentially stooded that state healthcare licensing decided that state healthcare licensing laws meant to protect patients can be ignored to the detriment of vulnerable populations. The Obama Administration filed a brief in the case supporting the broader policy allowing School Employees to administer the shots, as well. Chinatown groups and restaurants have found a powerful new ally in overturning californias shark fin ban. It was just over a month ago that restaurants here served their last bowl of shark fin soup before the law went into effect. The department of justice has filed an amicus brief saying the states ban is unconstitutional and that the law goes too far by banning all possession and sale of shark fins caught in federal waters even if sharks are caught legally. The justice departments motion will be heard this wednesday in the ninth Circuit Court of appeal. New details about last nights deadly party bus crash. So just because electric cars dont burn on gasoline and they dont have a tailpipe doesnt mean theyre zero emissions. You have to think about the emissions that come from the electricity that goes into charging those vehicles so you can drive them. Reporter all vehicles also have what researchers call a carbon debt from the manufacturing process at the time they roll off the showroom floor so factoring in that initial carbon debt and the ongoing source of power from the electric grid researchers have put it all together to analyzed the longterm Environmental Impacts. So in states that have really clean forms of electricity or low emissions forms of electricity like hydropower, Nuclear Power in places like that then electric cars are a more Climate Friendly option than the best gas powered cars. Holder says low level drug offenders will no longer face long mandatory minimum sentences in the federal prison system. Kpix 5 reporter linda yee tells us about the new reforms. Reporter attorney general eric holder is telling federal prosecutors less prison time, more rehabilitation for some drug offenders. He says nonviolent offenders who are not connected to gangs or drug cartels do not need excessive prison terms. By observing the most severe penalties for serious high level or violent drug traffickers, we can better promote public safety, deterrence and rehabilitation while making our expenditures smarter and more productive. Reporter charles houston believes he is more productive because of rehab. He was busted for drug possession in San Francisco four years ago and faced a five year prison term. But a Drug Diversion program that included classes and weekly drug tests helped him. He believes if he went to prison, he would still be using today. I would probably be in jail still or, you know, really getting out doing the same thing i was doing before probably. Drug addict, you know, the life in the streets, you know, homeless on the streets doing drugs. Reporter San Franciscos District Attorney says the feds can make the changes by omitting the quantity of drugs an offender may possess on a criminal complaint and then prosecute cases as misdemeanors rather than felonies. I think it makes sense. We need to keep moving away from this war on drugs that hasnt necessarily made us any safer. We know what makes us safer and we know what doesnt. Reporter attorney general holder says his next step will be to work with a Bipartisan Group in congress to change the law so judges have greater discretion in sentencing and not be hampered by the mandatory minimum sentences for some drug offenses. This is starting at the top the federal level. Local prosecutors bringing it down to this level complicated, isnt it . Reporter it is more complicated. The state laws on drug offense are all over the map. Depending the drug sometimes meth possession or crack possession, one or not other could be a longer sentence. San francisco District AttorneyGeorge Gascon would like to make it, you know, just even, lets just change the laws, lets make some of them misdemeanors because he thinks most of these offenders are people who are just abusers, not sellers. Thank you. A federal judge ruled today stop frisk a key part of new york citys crimefighting efforts is unconstitutional. In her decision, the judge said the nypds policy unfairly targeted young minority men for stops. She also appointed a lawyer to oversee the program. Mayor Michael Bloomberg said the ruling ties the hands of police officers. We have to give the members of our Police Department the tool they need do their jobs without being micromanaged and secondguessed every day by a judge or a monitor. The mayor also cited the benefits of stop frisk crediting the tactic for making the city safer and getting thousands of illegal guns off the streets. The tactic has drawn criticism and praise here in the bay area. Some in the San FranciscoPolice Department say that it would work. Its also been used in oakland. Former l. A. And new york police chief bill bratton who is now a consultant for Oakland Police says that stop frisk is invaluable. Im sorry but any Police Department in america that tries to function without some form of stop frisk or whatever terminology they use is doomed to failure. The u. S. Supreme court has ruled if an officer has reasonable suspicion that someone is break the law, that officer can stop and search that person. A tiny mouse may be putting the brakes on a Flood Control project in the palo alto area. The multiMillion Dollar project is supposed to protect homes in the palo alto and menlo park areas. But our Patrick Sedillo tells us the area is home to an end dangered species. San fransesquito creek regularly floods and on the north side of the creek the city of East Palo Alto has a community that is below sea level thats been flooded several times. Reporter right here in this video shot seven months ago because of this the san fransesquito creek joint Powers Authority wants to widen the creek for flood protection but the saltmarsh harvest mouse an inch tall lives on the north side of the creek channel this area of the bay.
