Active in the labor negotiations. But should he . Not necessarily. I dont think the governor has ever been part of it. Whens of mayor of oakland he was part it because as mayor of San Francisco, he and i and a couple of other people worked together to convince the parties that they should not disruption the transportation for people in the bay area and they did not. Reporter if workers walk off the job on monday bart has a lastditch card to play. Bart can impose a contract but there are several steps before that can happen. First, bart has to offer the unions its last best and final offer. The membership votes and if they turn it down, the bart board will have to meet before imposing a contract. The governor could also order a coolingoff period. The governor will consider all his options. Reporter well, the city of San Francisco has a no strike clause for transit workers. Senator day son yai who is head of the Transportation Committee is looking into state law that will prevent future bart strikes. Linda yee, kpix 5. No progress to report in those negotiations. Kpix 5s ryan takeo has been at bart headquarters all day long. Ryan, hows it looking right now . Reporter no moves. Its tough to tell, though, because there is a gag order on both side. Both side have not talked generals. Were talking about the big issues like salary and benefits. But they are throwing plenty of punches. If i have an issue with you, im going to tell you what the issue is and what it would take to make it better. Thats negotiating because then you know. We have put that forth to your team. Were not getting that in return. They have a tough package. They havent been coming forward and saying their package is 23 . They havent been saying they dont want to pay anything on pension. They havent been saying they dont want to change on medical. Okay . I understand thats not a real popular thing. So trash the other side if you can. You have chosen to bring a chief negotiator. He has negotiated 400 contracts and all he wants as he settles before the end of the negotiations. That is a great track record if you are trying not to finish negotiations, if you are trying to bring this to a strike for a second time thats what you done. Great job. Hear from the units that you are a union buster and you are looking for a strike. I would tell you that as far as you know, i have never busted a uniwhere and if they have something that says that i have, id like to know because thats something i have missed out on. Reporter did you put it on your resume . No. You never thats never the intent regardless. The intent is always to reach a settlement. Reporter both sides are going to be staying here throughout the night at the caltrans building in downtown oakland. And they are prepared for a long weekend here, liz. Ryan, how far apart are both sides in the negotiating process exactly, then . Reporter were not talking 1 or 2 . They are going line by line on periphery issues not even talking about the big issues. So were talking about the economic issues, the pensions and healthcare and those raises, because bart workers they havent had a raise in four years. They want one now. Ryan, thank you. So where do nearly half a million bart riders stand tonight . With just more than two days left to reach a deal, some say they feel like hostages. Irritating because then it makes peoples life harder when barts not running. Now that its looming and, you know, i might have to get caught in that next week, its really upsetting. They have had plenty of time to negotiate, figure things out. Yet here we are again. We have new poll numbers on who is winning the public sentiment battle. The workers or management. Some of the teams aviation equipment is grounded thanks to washingtons sequester. Kpix 5 reporter mark sayre is at Moffett Field where the elite unit is based. Reporter the California Air National Guard is called to the absolute toughest rescue missions. It goes to fight fires. It responds to hurricanes. But right now, it is the federal budget situation that is its biggest challenge. When you need help in an emergency, every second counts. The California Air National Guards 129th rescue wing is often called in for rescues that are too complex or too far away for civilian crews like in the open ocean. But the budget sequestration is now slowing down the unit on two fronts, equipment and personnel. Colonel steven is the wing commander. This is unintended consequences and no one in the congress or in the senate ever anticipated that this would be the outcome. Reporter the wing is authorized for six highly specialized helicopters. One was lost in afghanistan and while a replacement has been approved, it is now not known when it will alive. And two others are undergoing heavy maintenance at facilities impacted by department of defense furloughs so right now, only half of the rescue wings helicopter fleet is in active service. Our combat rhett skew helicopters are continuing to fight fires and to perform life saving rescues here in california. Were right in the beginning of the fire season. And Hurricane Season is also kicking off nationally. Reporter the National Guard unit also has about 100 air force technical employees who are impacted by the furloughs, like Staff Sergeant troy wilkinson. It makes it difficult, definitely does. It makes it a difficult job even that much more difficult. Reporter Sergeant Wilkinson helps ee equipment and maintain the guards helicopters and combat shadow planes through his work in the logistics squadron. He and his colleagues are all forced to take one day off a week. Not only does that potentially slow down missions, but its also a significant personal hardship. The bay area is not an inexpensive place to live. I dont know too many people out there that have 20 extra income they can just budget out. So you know, its tough. Reporter so when will all this end . Well, nobody really knows at this point. But the latest word from the department of defense is that these furloughs will last at least through the end of the federal governments fiscal year, elizabeth. That is september. So still a few months to go. Thats the best estimate. So mark, can the rescue units still get off the ground in a hurry . Reporter yeah. They say they can. They really are committed to the mission. They are committed to getting the work done when called. They have half the helicopters, obviously. They can issue orders to bring people in if they need to but obviously their capability is reduced and they would like to get it back to full strength as soon as they can. Thank you. The city of richmond is now suing chevron for last years refinery fire. Probably remember when this toxic smoke filled the air threatening the health of thousands after an explosion hit the refinery. Kpix 5s don knapp has more on the talks that went nowhere and chevrons response. Reporter allen, mayor mclaughlin says the inability of regulators to hold chevron to strict Safety Standards left the city with no recourse but to sue. The city of richmond blames chevron for negligence in the 2012 explosion that blanketed much of the east bay with a dark cloud of toxic smoke. Richmond claims the refinery willfully disregarded Public Safety as a matter of corporate policy. The decisions that we believe created and set up what happened on august 6 of 2012 are decisions that are made in board rooms and those decisions deal with how much money are you going to budget for safety . Reporter 15,000 people were treated at hospitals for smoke related illnesses. Richmond is seeking an unspecified amount of damages for the costs of emergency response, environmental clean up, loss of value to city loss of value to City Property and harm to public health. One system is filled with gaps where the Petroleum Industry has the upper hand. After talks with chevron broke down, richmonds only recourse he says was a lawsuit. So the responsibility here and what this lawsuit is all about is Holding People responsible and accountable for decisions they make and the city of richmond cant make those decisions. Thats the purpose of this lawsuit. Thats what accountability is. Reporter chevron said, the lawsuit is without merit. Then took a shot at city politicians, saying the baseless allegations against chevron are plainly intended to divert attention away from a dysfunctional city council. But what richmonds responsibility to make sure the refinery is safe . The answer none, since the city is not involved in board room decisions according to the lawsuit attorney. Mayor mclaughlin blames predecessors for failing to get tough with chevron and promises a new start. We are saying right now that we are expecting the highest of standards of safety and thats the first step that we are at here today. Ironically, bart management is saying if there is a bart strike, think you will make available the bart parking lot at the station for casual carpooling so if you want to set up your own carpool among friends, you can rendezvous at bart parking lots open for free parking and then carpool in.
