Again, were told that were going to be given a warning when brock turner is supposed to walk out of the main jail here out of the front doors. We have not been given that warning. As you can see, deputies are in place. So any minute now brock turner could be released. Well be keeping a close eye on those fronts doors live in san jose, maria medina, kpix 5. Meanwhile, Colin Kaepernick is defending his decision to kneel during the National Anthem before last nights game. He got support from some of the fellow players, not the fans in san diego. [ loud booing ] [ singing of the National Anthem ] kaepernick has vowed to indefinitely continue his protest against what he claims is oppression of minorities in america. He was also joined by his teammate eric reid. After the game kaepernick addressed the criticism he received. I think its a misunderstanding. You know . The media painted this as anti american, antimen and women of the military. And thats not the case at all. The message is that we have a lot of issues in this country that we need to deal with. We have a lot of people that are oppressed, we have a lot of people that arent treated equally arent given equal opportunities. You know, Police Brutality is a huge thing that needs to be addressed. Kaepernick also pledged to donate the first Million Dollars he makes this year to community organizations. Seattle seahawks cornerback jeremy lane sat in solidarity with kaepernick last night. Lane stayed on the bench during the National Anthem before the game against the raiders. A trip to the Golden Gate Bridge, dont expect to find parking over the weekend. So looking good through the south bay and heres a look at your bay bridge toll plaza. Carquinez bridge to the maze westbound will take but 20. And then a look at your Altamont Pass cars coming out of tracy 30 Miles Per Hour just about 205 to Altamont Pass will take but 17 minutes. To the dublin interchange, 15 minutes. So a little slow traffic through the commute direction there but thats nothing new for us. If you are taking bart or any kind of mass transit in the bay area you have no delays on that, as well. Two bay area mayors want to tax sugary drinks. Mayor lee and schaaf want to make sure ballot measures get passed this november. Kpix 5s anne makovec is live in the newsroom with more. Reporter the tax is proposed in San Francisco, oakland and albany to charge distributors a penny per ounce of soda they sell. So for this size thats 20 cents. Berkeley has a similar tax right now. The first city in the country to do so. Advocates say it will have people thinking twice before they buy sugar sweetened drinks like soda, iced tea and sports drinks. That could help fight disease. Those against this tax say charging the distributors is a tax on their businesses. The grocery tax is going to hurt my customers. Theres a limit to how much they can spend. It doesnt help the people are suffering the most the lower income earners. Reporter thats one of many ads running on tv against the new tax and there are plenty running in favor of it, as well. San francisco voters rejected a similar tax in 2014. And they will make that decision again in november. If voters in San Francisco already rejected this tax, whats different this time around . Reporter a key point. In 2014 it needed twothirds approval for a dedicated tax. This time backers are going for a general tax which only requires a simple majority. Thank you. This is a live look outside Santa Clara County jail where we are expecting former Stanford University swimmer brock turner to be released. We think thats him lets head over to maria medina live outside brock, can you tell us how you feel . [ reporters screaming ] reporter that was brock turner being released from the Santa Clara County main jail as the sheriff told us just before 5 00 during a news conference, he would be walking out the front doors just like every other inmate. He wouldnt be treated differently. A huge presence of media a lot of us asking him questions as he walked out of jail. He did not answer any questions. An suv was waiting for him down the street. It pulled up as soon as we were given the fiveminute warning. He walked into the suv, didnt answer questions and drove off. Where he is going after that, nobody knows. But we are told he does plan to go back to ohio where he is from to serve out the rest of his probation. For now back to you. Thank you. Brock turner left Santa Clara County jail a minute ago. Maria touched on we dont know where he is going at this moment but he is going to end up back in ohio where his family is. Once he is in ohio, he will have five days to report to his probation officer. Then his probation will start. That requires him to take regular drug tests, he will get some counseling. [ simultaneous speakers we are looking live at chopper 5 right now. This is a car carrying brock turner. And we are going to go back to the jail right now where the sheriff is now talking. Lets listen in. They would have released the property that he came with. But i dont know what it was that he had. Did he say anything before he left . Did he do an interview . No. He was just processed out. He left. I wasnt downstairs. I dont know what happened. I dont suspect there was anything said. Do you know his movements at all no. Do we know his movement at all times when he is in the jail yes . But not now. We dont know who picked him up or where he is going. But were done with him. He should be in prison right now. But he is not in our custody. Sheriff, how do you think the release went . Um, i just saw it from this angle but im sure everything went we do this for a living. We have great staff. They do a good job. I think everything went as planned. Are you in contact with the sheriff in ohio to see where he is headed . I dont know where he is going. No, were not. Have you ever seen a scene like this . I have not. I appreciate you covering it. I think it really brings to the attention of everybody that we need to change the law. The law has to be that if you rape someone who is unconscious and intoxicated you go to state prison. And that bill is on the governors desk right now and were urging the governor to sign it. I think its a great law for california. When you heard six months, what was your first reaction . Outrage. Outrage it was a rape conviction. It was a rape conviction of a woman who was unconscious and drunk and, um, should not have done time in our jail [ inaudible question ] changing the definition of rape to exclude [ indiscernible ] it already is. But im the bill thats on the governors desk is to make it mandatory state prison. We are done with him. He is gone. He should be in prison right now. The deputies work with tough people all day long. They do a great job. We work in a custody environment. We have 200 people in custody right now for murder. So they do it and they do a great job and if they ever need assistance we certainly are available for them. I know you dont agree with the actual three months that he actually served. Correct. I do not agree. Can you talk about that . Yeah. He should have been in stated prison. It should be a state prison sentence. Its a felony. Its a rape. Six months where you only do three is not correct. Its not right. Um, and thats why im hoping that this bill will change that. [ inaudible question ] thank you. Thank you. Reporter the Santa Clara County sheriff just wrapping up another press conference outside the jail here. Again, she used this moment to talk about that bill thats now in the governors hands to make state prison mandatory sentence for anyone convicted of Sexual Assaulting someone who is drunk and unconscious. Brock turner just leaving jail here a few moments ago walking right out the front doors down the stairs into a waiting suv. Its interesting to note that the sheriff, she did not mince words. She is very open on how she feels. She says were done with him. She believes he should be in prison now but says he is not in our custody. Not their problem. She said shes outraged. She said that the sentence is not right. He only served three months out of a sixmonth sentence. Certainly, um, this caused a lot of debate as it sparked a lot of debate across the country about whether the sentence was too lenient for a person who sexually assaulted an unconscious woman. A lot of people questioning whether the Justice System treated Sexual Assault victims, um, rightly in this case. A lot of people saying it was too lenient. Sheriff laurie smith talks about and also maria medina did too about the current law which is if someone is convicted of Sexual Assault on an unconscious victim they can receive probation. Now the Assembly Bill 2888 is on governor jerry browns desk right now and that will require the minimum sentence for convicted rapist of unconscious victims is 3 years mandatory prison. People are saying its a slap on the wrist. Kpix 5 spoke to our legal analyst who says, you know, he does have this probation where, um, there are certain conditions of his threemonth probation where he will have to take random drug tests, drug and alcohol counseling and will have to register as a sex offender for the rest of his life. He is 21 years old. He is in his 20s and for the rest of his life he will have to register as a sex offender. She called him a marked man. We expect him to return to dayton ohio where he is from. This is a live shot from chopper 5 following the white suv where brock turner entered into that car just shortly after he was released about 5 to 10 minutes ago from Santa Clara County. We saw the helicopter shots. A lot of people out there, members of the media down there. No protestors. We did hear from a group called ultraviolet. They advocate for women. They were supposed to be there. Not a crowd as we thought. We know that Law Enforcement was stepping up security in that situation because all of the national and International Attention this case has had. Certainly a lot of attention on this case. During this entire coverage of the former Stanford University swimmer brock turner this morning we have not yet mentioned the victim in this case. She wrote a 13page letter to the judge, judge aaron persky, um, asking and urging the judge to ignore the probation officers recommendation which was a sixmonth sentence and probation. Prosecutors in this case wanted a 6 year prison state prison sentence which would have been much different than the county jail sentence that he served just three months. Sure. And you remember judge persky, he issued the sentence and now a lot of people have asked for him to step down from the bench. We know that just a short time ago last week or the week before he voluntarily stepped down from hearing criminal cases in palo alto moving to the Civil Division thinking that would take some of the heat off of him but protestors want him gone. Persky defended his sentence shortly after he sentenced turner to that sixmonth sentence saying he followed the probation departments recommendation based on two things, one, turners lack of criminal history and, two, he said that turner showed a, quote, sincere remorse. And that of course is what protestors were having issues with shortly after the sentence. If you are just tuning in, we are following chopper 5 is following the car right now where brock turner is he is in that white car right there. He was just released we believe he is in that car he was just released from the Santa Clara County jail just a short time ago. He is the stanford swimmer convicted of Sexual Assault. Judge persky said the state prison sentence would have a severe impact on brock turner, a college student, swimmer, athlete at Stanford University. Once again, a live look at chopper 5 as we continue to chase the white suv which left the Santa Clara County jail just a short time ago. We have been following this story all morning. We heard from the sheriff from santa clara laurie smith. They say that at this point, their job is done. He has served his sentence. He will go back to ohio where he is from. She said he should be in prison and she actually thanked the media while she was out there saying that she is glad we are bringing attention to it, she is urging the governor to sign the law on his desk. It was just a few minutes ago that brock turner walked out of the main jail as a free man. The sheriff told us, you know, earlier this morning that he wouldnt be treated any differently than any other inmate. He would walk out the front doors and thats what he did. He walked out the front doors down the steps into a crowd of media. Several of us, of course, yelling questions. He didnt answer any of those questions. He walked down the stairs right into a waiting suv. Again, this is a huge story because he faced several years in prison for Sexual Assaulting an unconscious drunk woman outside a frat party last year. Again, he faced several years but he was given six months in jail by judge aaron persky. And now he is again released a few months early. He served 3 months in jail. The sheriff says she doesnt believe he should be given the light sentence. Heres what she said. Oh, no. We dont know who picked him up or where he is going. Yeah. But were done with him. Thats it. He should be in prison right now but hes not in our custody. Reporter so brock turner is expected to return back to ohio where he is from where he will complete his probation over there. As far as judge aaron persky, there is a campaign to recall him. Protestors say they planned to be here to protest the judges sentence, sixmonth sentence for brock turner. Back to you. Meanwhile in florida meanwhile in florida hurricane hermine has brought winds up to 70 miles an hour and hundreds of evacuations. 50 counties are under a state of emergency. Businesses are closed and people have stocked up on supplies. Some residents were roaming boardwalks to take in the unusual weather. But floridas governor is warning people that the hurricane is lifethreatening. Have to be careful. We just saw thats cars in deep water. Thats a nono. Right. Exactly. Never do that. Turn around, dont drown. I was just speaking with our managing editor. Her father is in jacksonville. She said that the gaters are out. Oh, no. They are hiding under cars. They do that. Dont they . It doesnt have the warm water to keep its momentum and strength going so its been downgraded to a tropical storm. It continues to lift into the jacksonville area. The examiner reports acting chief Toney Chaplin says he graduated from Colorado State university but none of the csu campuses have records he attended. Chaplin is among 60 people who have applied to be the citys permanent chief. Two bay area mayors are teaming up to tax sugary drinks. They are pushing ballot measures this november. Reporter the proposal means a distributor selling a bottle of soda this size would be taxed an extra 20 cents on the sale and that money would go to health programs. Advocates say it will have people thinking twice before they buy sugary drinks like soda, ice tea and sports drinks to help fight obesity and diabetes. But those against the measure say charging the distributors is basically a tax on their businesses. They are calling it a grocery tax saying that they would spread that extra cost throughout the rest of the merchandise. Supporters are crying foul. The soda industry is lying to people. They are telling people that local shops will be taxed when they wont. We need to push back on those lies and make clear that taxing distributors of sugarsweetened beverage assist about protecting public health. San francisco voters rejected a similar tax in 2014. Joining us now is kcbs radios financial reporter jason brooks. Reporter the u. S. Economy is cruising right along. Solid hiring although slowing down a little bit in august. The Labor Department reports a gain of 151,000 jobs last month. That was weaker than expected. About half the gains that we saw in june and july. The Unemployment Rate stayed steady at 4. 9 for the third month. Wages barely higher. This report is key as the Federal Reserve is seen by many as close to raising Interest Rates again and if this report would have been Strong Enough, it could happen this month but the report is being seen by investors as not quite Strong Enough for that to happen. And the likelihood that the fed will wait a little longer before raising rates. Bad times for samsung. The company is pushing a global recall for its brandnew galaxy note 7 phone. It shipped 2. 5 million worldwide. Strong demand, supply shortages, but the batteries exploded the company confirmed it has a battery cell problem. It doesnt know how long its going to take to fix it or how much it will cost. The timing could not be worse for samsung or better for apple [chuckling] as apple will launch the iphone 7 at an Event Next Week and could get a boost from this problem for samsung. Investors like that jobs report. They are hoping that the Interest Rate will get moved a little bit further down the road. The market off to a good start this morning. The Golden State Warriors are facing a lawsuit claiming that the teams app has been recording private conversations. The Complaint Centers around the apps beaconing technology which uses a smartphones microphone to determine a users location. It does that by continuously recording audio and listening for unique sounds. The lawsuit says users were also having private conversations recorded without their knowledge or permission. A lot of people are traveling for the long holiday weekend. But we dont know exactly how many people will be on the road because aaa is not releasing their usual report. The agency says it is the least traveled holiday of the year so they arent spending money on a survey. Aaa did release the latest weekly gas report though. It indicates that prices will continue to go up towards the end of summer driving season. Good news, the National Average is at 2. 22 which is lower than its been in the past three years. Thats good. Again, the reason why this is such a big deal is because brock turner faced several years in prison for Sexual Assaulting an unconscious woman outside a frat party last year.
