The valley fire continues to burn out of control in napa and lake counties and a live look from middletown which is at the center of the devastation, this foundation and burnt out homes and chimneys as you can see there. Cal firefighter richard wreath though gave a big thumbs up from his hospital bed. You can see him there. He was one of the four firefighters injured fighting the valley fire over the weekend. All four were airlifted to Uc Davis Medical Center with Second Degree burns. Now all are expected to make a full recovery. About 150 miles southeast of the valley fire, the butte fire has destroyed at least 135 homes in the sierra foothills. Cal fire says containment is now at 25 . Yesterday, the smoke was so thick that it grounded aircraft for most of the day. Forcing firefighters to rely on ground crews. More than 4500 firefighters are working on it. And in a moment were going to check in with kpix 5 political reporter melissa caen in just a few minutes, more on the impact on Governor Brown declaring a state of emergency. Its beginning to take a nosedive down in a southerly direction and you can see a little bit of light rain across the northwestern section of the state. Its going to tap into some of the lingering moisture from what was once hurricane linda brought some remnants into bay area over the weekend. And with that, thats why we have that potential for light rain here. We do have extremely dry conditions over in napa and lake county where the valley fire burns out of control. So certainly any kind of precipitation will help. This is the futurecast, you can see a little bit of light rain anything that we do see will be very shortlived. Tuesday, partly cloudy skies. Governor brown reclairing a declaring a state of emergency because of the fires in lake and naoma county. Kpix 5s legal analyst melissa caen joins us now with more on what it means. Reporter good morning. Ive been watching you guys all morning. So scary to see whats happening with the fires and its not a surprise the governor has declared a state of emergency. Butst receive i to be its easy to be don fused. We think fema going to examine but to be clear, thats not whats happening here. Fema only comes in when the president declares a state of emergency. That hasnt happened yesterday. Right now its just a governor declaring a state of emergency. Whats the point that . In this case its so the governor can force state agencies to use their resources to deal with the crisis. A state of emergency red tape is out the window. And oh well the agency only works over here out the window. It is all hands ondeck. There are something called a Governors Office of Emergency Services and it is now in charge of state resources. And it can move them around to deal with the emergency. Cutting through bureaucracy is not the only thing that happens in a state of emergency. Other things that are triggered include a ban on price gouging that goes into effect for the affected neighborhoods. Criminal penalties for looting. Normally when you steal stuff its called burglary. But when you steal stuff during a state of emergency, it is looting and a penalty is serious. Victims of a state of emergency can get extra time on tax returns and to file for unemployment benefits. And documents lost in a state of emergency can be recovered without a fee to the state. And finally depending on a persons Homeowner Insurance policy insurance policy, a loss during a state of emergency can result in quicker and greater payouts. So what the governor did here by making this declaration is pretty important. Just makes common sense really. That this try to get it done right . Right i mean weve seen it. And you know they need all the help they can get certainly. Didnt he just declare another state of emergency . The fire few of these going on right now. Just last week, he declared another one. Right now we have at least five states of emergency happening right here in california. Three are dedicated to wildfires. One is for those floods in Central Valley back in july. And one is for californias drought. Now these emergency declarations are only good for 60 days. So for example the drought emergency declaration, that was first made back in january. And every few months the governor reissues it. So well see whether these fires also require an extension. Of the state. You said the president has to declare an emergency before fema can help. Could that High Pressure here . It is not off the table. The governor would have to make a request to the president and the governor hasnt said yet whether hes going to do that. The last time was aier ago when the napa a year ago when the napa earthquake hit. Its possible. As they continue its 5 contained right now but they have a lot of work to do. Unbelievable.
