Family members say the driver of a charter bus that crashed in Merced County had little sleep the night before the accident. Relatives of Mario Vazquez say he had only 3 to 4 hours of sleep. The charter bus had a pole yesterday killing four people and injuring more than a dozen. Chp says the bus driver is in the hospital but would not comment on his injuries or whether he was fatigued. Michael smith is charged with battery on a Police Officer and resisting arrest. The incident caught on camera here at the embarcadero station last week. Bart police say they were responding to reports of a possible armed robbery. Smith is accused of kicking one officer in the head and throat, biting a second officer and spitting on a third.
