But so far, apple is unwilling to budge. Inside these cupertino offices apples ceo tim cook is making his stand on the apple website today posting a message saying why he will not help investigators hack into the iphone of San Bernardino mass killer syed farook. Quote, the u. S. Government has asked us for something we simply do not have and something we consider too dangerous to create. They have asked us to build a back door to the iphone. In a recent 60 minutes interview cook said. The reality is if you put a back door in, that back door is for everybody, good guys and bad guys. Reporter no one knows for sure if farook and his wife had help from worldwide terrorist organizations when they planned and murdered 14 people, why they picked the target or if more attacks are planned but investigators think farooks iphone found inside this suv after the couples fatal shootout with police could hold the answers. We still have one of those killers phones that we have not been able to open. Its been over two months now. Were still working on it. Reporter a federal judge has already ordered apple to help the fbi break into farooks encrypted phone. Apple would have to write special code that would disable a security feature that erases the phone if too many incorrect passwords are tried. That would let the federal government launch an attack in which every possible password combination would be used until the phone is unlocked without losing data. Some apple customers side with the company. Everywhere were being forced to give up more and more in the name of security. Where do the lines lay . Whats the future for him . Reporter while others say apple should make an exception for this one phone. Nobody wants to be in a position where were giving away private information. But here we need to know who this terrorist was in touch with. Reporter len ramirez, kpix 5. Phil matier joins us. The fear is if apple complies it will open up a can of worms. Reporter or open up your cell phone. Lets take a look at this. That cell phone could hold a wealth of data. Reporter but according to this former fbi special agent and Security Consultant jeff harp, while the u. S. Government has been able to hack the phones of germanys chancellor Angela Merkel or even the president of brazil, the fbi lacks the tech know how to open a common iphone. A device is more complicated to get into than just simply listening over a wire. Reporter this Technology Analyst says the complications start with the thousands of possible combinations for the four digit code to open the phone. With enough brute force and enough to super Computing Power they probably could do it. But whether they could do it on a given phone in time to actually have useful information is very doubtful. Reporter but heres the real problem. If you dont crack the phone within, say, 10 tries, the phone reacts by wiping itself clean. Thats what the bureau doesnt want to do. They are trying to preserve the evidence. Its very possible that they are working on how to break that encrypted device but it makes more sense, if you know somebody that has the key to a lock to ask them for the key to the lock rather than working on try to make a new key that may or may not fit. Apple said it doesnt have the key. They say that they dont have it and they dont want to create it. The worry is that that software could get into the wrong hands. First of all, it could be misused by government. And second of all it could get into the hands of others who might use it for criminal purposes and apple has a lot riding on saying that we have secure phones. Not only to its customers in the u. S. But all around the world. Reporter how vital is this information, do you think, to the investigation . Well, its unknown. Right now we havent been able to determine, you know, what was the cause for this person to go on this shooting rampage for him and his wife. They would like to try to figure out, were others involved . Really interesting. Really is. We could go a lot of different ways with this thing. What do you think is the next step . I think the court battle between apple and then the u. S. Government that goes all the way to the Supreme Court because apple is going to want to be told what to do in this case. Its not going to volunteer. Also two other issues. One theres a lot of money involved. Because apple sales are worldwide. They are not just in the United States. Yup. And not every Police Department in the world is as friendly or constitutionally conscious as ours and once that system is out there, who gets it . The second one is the Global Nature of todays technology. Like i said, iphones arent just americans. They are all over the world. And its a world market that not only wants a phone that works but one that stays secure. There are a lot of cynics out there who would say, what stops apple from going ahead and doing this and then next week changing their encryption and oh, by the way, were selling everyone a new phone. Ill put you one better. What happens if they wind up with a cell phone before the attack happens and the phone might have information about an upcoming attack . Is that going to be argued in the courts . Well see. Whole new world here. Yeah, all right, phil, thank you. The legal case over a brutal beating caught on video has gone quiet. There was outrage last fall when two Alameda County sheriffs deputies were caught beating a suspect but since then, no word on any charges against the deputies. New at 6 00, kpix 5s joe vazquez on what is going on in this case. Joe. Reporter thats the question public defender jeff adachi is asking out loud right now, ken. Specifically, whats taking the District Attorney so long to make a decision in this case . It has been about three months since it emerged. Its outrageous that nothing has happened. Reporter he is referring to this a video that shows two Alameda County sheriffs deputies in a San Francisco alley striking Stanislaus Petrov with their nightsticks over and over. The beating went on for at least 15 minutes. [ screaming ] we can see continuously beating and you can hear the batons hitting against bone and flesh and mr. Petrovs screaming. [ sirens ] reporter just before he was beaten, police say he stole a car and crashed into two patrol cars then led police on a chase over the bay bridge. Its one of the most horrendous beating videos i have seen even worse than the rodney king case in many ways. And yet theres been no action. Reporter Luis Santamaria and paul waiver the two deputies are on paid administrative leave. Will they face charges . Thats up to the San Francisco District Attorney and he isnt saying but a Law Enforcement source says the case has gotten complicated recently and may be delaying that decision. Turns out that in addition to the two deputies the d. A. Is now investigating whether at least two other deputies on the scene possibly more may have also broken the law. I dont think thats an unusual amount of time. Reporter lining up all that evidence can take a while, says kpix 5 legal analyst judge ladoris cordell. The d. A. Has to be able to prove the case beyond a reasonable doubt. Right now, i dont think people should be too concerned but as time goes on, i would say if it gets to six months or more i think we should all be asking questions about why nothing has happened. Reporter so now theres another wrinkle we have learned about. Investigators have had some trouble tracking petrov down to talk to him. He is struggling with Mental Illness and has head injuries. The Alameda County District Attorney has decided not to pursue any charges against him. No charges there. But what about for the deputies . No specific date. But my sources tell me look for a decision, quote, very soon. Reporting live in the newsroom, im joe vazquez, kpix 5.
