Reporter the group filed a Class Action Lawsuit against Santa Clara County on behalf of hundreds of inmates alleging their 14th amendment rights to due process and basic human needs are being violated. The county is isolating people without human interaction, environmental stimulation, fresh air, sunlight, 23 to 24 hours a day for months or years at a time. Reporter its one of a mounting number of lawsuits and investigations targeted at the jail in the aftermath of the killing of mentally ill inmate michael tyree, allegedly at the hands of three jail guards last august. We have already taken steps to improve operations in our custody facilities. Reporter a spokesman read a statement in the sheriff saying she appreciates the perspective of the Prison Law Office in ongoing efforts to improve practices and training. But families say thats little comfort for their loved ones behind bars now. Something needs to change. I cant believe this is happening here am i just lost all hope in the Justice System. There is no justice. Reporter nowsch the sheriff says the reforms began last june. A consultant has been hired to go through the jail and make recommendations on the changes. But veronica, the families and the Prison Law Group say that that is a too slow of a process and are hoping that the Justice System through the lawsuit filed today will prompt faster changes. Thank you, len. Tonight we are learning Santa Clara County inmates have filed more than 300 Excessive Force complaints against guards in the past five years. According to the San Jose Mercury news, just 14 of those complaints were formally investigated. Only five resulted in disciplinary action. A San Francisco woman has lost a contentious custody battle over her frozen embryos. Kpix 5s allen martin is in the newsroom with the judges decision and what happens next. Allen. Reporter really interesting case, ken, because todays ruling certainly a victory for the husband to wanted the them destroyed. While they were married they signed an agreement to destroy the embryos if they split up. The woman had cancer and cant have children and now she says they are her last chance to have children. A San Francisco judge ruled that by california law, the former couples preexisting agreement trumps the womans desire to keep the embryos. I think the court would have ruled this way even without there being an agreement. Its tough. Its a case that judges live for but also they dont want meaning its a case of first impression. Its a first time and youre looking around, how am i going to decide this . Its very difficult. This decision was a very thoughtful one, very reasoned one. In the end, the judge decided that lee cannot force her exhusband to become a father. But the embryos likely wont be destroyed right away. Lee can appeal this ruling. But no word yet on whether she plans to do that. In the newsroom, allen martin, kpix 5. Also tonight police say they have arrested the man who spraypainted an islamic symbol on a frenchamerican school in San Francisco. 44yearold transient Edward Vanwright has been charged with trespassing an vandalism for allegedly spraypainting a school wall but police say theres no evidence he has any ties to any terrorist groups. The star and number 7 found on the playground yesterday represents a group thats an offshoot of the nation of islam. But police say there is no evidence of any threat to the school or the students or staff. A Traffic Alert to tell you about. At least one person has died following a multivehicle crash on highway 37 in marin county. It happened in the eastbound direction which is headed toward vallejo near lakeville high school. The chp says two big rigs and at least five other cars all part of this mangled mess you see there. The lanes are blocked and you can see from chopper 5 that is backing up traffic for miles. Highway 37 is a primary route from the north bay to the east bay. The investigation and cleanup will take several more hours. Other bay area headlines tonight, Richmond Police say a 5yearold boy who was shot in a driveby shooting will survive. He and his father had just left a corner store about 7 45 last night when somebody drove up and started shooting. The boys father also hit by gunfire. Both are in serious but stable condition. Police do not have a motive. A close call at the Goodwill Store in dublin this afternoon. The Alameda County Fire Department says the driver accidentally hit the gas instead of the brake and plowed into the store. The car took out the store front window and scattered merchandise everywhere. No one was hurt in the crash. Super bowl planners in San Francisco have dropped plans to remove the overhead muni lines. The idea was to make room for super bowl city attractions on Market Street but it would have caused more disruption of the muni lines. There may finally be an end to the tree wars in San Francisco. Um, it would cost anywhere from 300 to could be a couple of thousand if its a serious job. Reporter and more if it messes up the sidewalks. It cost 20 million to take care of city sidewalk trees total. The city did pay until four years ago. I think that was when our budget was bad. We didnt have a lot of general fund money. Reporter San Francisco has a lot of money now and more new money coming in every day. So Supervisor John Avalos wants the city to pay to take care of the trees again. So its about choices that we make. Reporter when the city budget started being sawed away trees are often the first to be felled. This is not something that public works wanted to do in the first place but we couldnt take care of them ourselves. Reporter avalos wants to tack electricity mostly on commercial properties to pay for it. He will have to circulate petitions to get it on the ballot next year. Hopefully get at the root of the problem. The city says its all fine with them if there is a reliable source of income because they will be the first to tell you money doesnt grow on trees. The victims investigators say were forced to work at two south bay businesses. A restaurant and a salon in saratoga. Sheriff deputies arrested a husband and wife and their business manager. Investigators say the victims from spain were trapped in what amounted to modern day indentured slavery. They came here from spain. They were here on vacation. And then they were forced to work with either no pay, paying off a debt,or they were getting very minimum wages. At this point i still cant believe whats going on. I only wish the best for the owner obviously but he treated me and my family really great. The suspects face three counts of Human Trafficking and three counts of wage theft. The victims have been referred to an aid agency that works with victims of Human Trafficking. Californias independent legislative analyst is forecasting a rosie economic future. And now it looks like the state will end the fiscal year with 3. 6 billion in additional revenues. California could have nearly 12 billion in its rainy day accounts by the end of 2017. Today pg e faced through some questions, very tough ones from state lawmakers as to whether their power lines were responsible for deadly wildfires. That hearing comes after pg e said the butte fire may have started when a tree brushed against a power line. But senator hill wants to know if the Company Learned from their mistakes in 2007 when neglected power lines caused a rash of fires. A third or more are caused by power lines that either because of the wind they fall or the trees havent been trimmed. The brush is too close to it and they create a spark and it ignites the fire. The butte fire killed two people burned more than 9900 homes and other structures in the sierra foothills. Fire investigators have not announced their official findings. And now the county knows just how highrising sea levels will get and folks like sean mullins are worried about what they could do. Theres no retaining wall or seawall. The ocean just comes and takes what it wants. Reporter sea levels by the end of 21 00 are expected to rise 80 inches which means high tide will climb to be this much further. The county is now meeting with homeowners to decide how to handle the rising waters. And the tide of incoming problems they will bring with it. Everything from berms to building moratoriums are on the table at this point hopefully to be settled by spring of next year when the county updates its coastal plan. Its going to create a challenge to figure out who is responsible for some of these things and to figure out how to respond. A siege lasting seven hours in a paris suburb left two suspected terrorists dead. Eight others are under arrest tonight. During the furious firefight overnight, police unleashed 5,000 rounds. The trial of a wellknown chinatown figure is giving us a glimpse into what prosecutors say is a dark underworld in San Francisco. Their star witness an undercover agent who goes by the name david jordan is revealing his alleged dealings with raymond shrimp boy chow. Kpix 5s joe vazquez on a story involving whispered conversations and money changing hands. Reporter at various bars and restaurants in chinatown and across the city, agent jordan says he met with shrimp boy over a period of about three years and gave him cash. More than once, jordan is heard on the recordings saying i love you and i respect you and appreciate everything. And chow is heard saying, no, no, no. We could hear it on the audio recordings over and over. Shrimp boy sounding like he is rejecting cash from the fbi agent david jordan. No, no, no, he says. But then prosecutors say, shrimp boy eventually relented and accepted money, 1,000 and 2 thousand dollars at a time. But did shrimp boy chow take the money from the undercover fbi agent explicitly to commit the crimes he is accused of . So far, we havent heard that smoking gun. His attorneys say yes, their client took money but only as a sort of donation. The undercover agent gets my client to take money when he is trying to turn it down by professing his love for my client telling my client, we are meant to be, we are so good together, i love you.
