She later denied any physical contact occurred so miller is facing a vandalism charge. Any time any crime is alleged against a person whether its a felony or a misdemeanor its a serious matter and when we charge a case against two people that are in a certain kind of relationship as mr. Miller and his former fianci were its a serious matter. Police radio calls from the day of the argument did show some initial confusion about what happened. Said boyfriend attacked her, took her keys, and she said never mind and hung up. A judge issued anpreventing miller with any contact with his exfianci. A livermore boy is back home tonight after surviving a crash that killed his aunt and baby cousin. A suspected drunk driver plowed in to them at a family party. Maria medina with the familys message to that driver. We spoke to the little boy a few minutes ago. He only remembers his family trying to wake him up. He does not remember the corvette plowing in to his backyard and his fence and falling on top of him. Hes the first one we got out but he wasnt responding. Reporter Carlos Morales says the only moments he remembers were his family trying to keep him alive. He kept nodding off every time we tried talking to him. Reporter but his sister remembers very well dragging him out under their fence after police say a drunk driver plowed his car in to the backyard where carlos was playing. While hes still in pain, so was his family emotionally. I feel like if it wasnt for my birthday, they wouldnt have even came out here. I feel like its my fault. Reporter rosa morales says family members were at the apartment on murrieta boulevard that night for her birthday and carlos first communion. Her mom, aunt, and 14monthold cousin were taking the dog for a walk when police say jones lost control of the car. My aunt grabbed the baby but she didnt have time to move. Reporter her aunt, who theyve identified as Esperanza Morales and her baby julie died. Police say jones admitted being at the livermore wine country festival. Just hours of the deadly crash he bailed out of jail and was back on the streets. I want him to pay for what he did. I dont want him to be out on the street killing more families.
