As kpix 5s lisa chan shows us, voters are less agreeable on this issue reporter prop 62 would end the states Death Penalty and replace it with life in prison. A new field poll shows 51 of statewide voters support the measure. That is compared to 45 who are opposed to it. And prop 66 which would speed up the process of executions is a much tighter race. A new field poll showings 48 of voters are in support of the measure compared to 42 who are opposed to it. 10 of voters are still undecided on the issue. This law professor is confident that the Death Penalty will be revealed. Your voters know that the Death Penalty is unreliable and arbitrary and dysfunctional. And when the people of california review that, they are going to vote yes on 62 to abolish it. If both prop 62 and prop 66 win at the polls on tuesday, the one with more votes will become law. A bond hearing is set today for a man suspected of kidnapping a South Carolina woman and keeping her chained inside a storage container for two months. Investigators say a tip led them to the property of registered sex offender todd coalhappen. When they arrived yesterday morning they heard loud banging from inside a metal storage container. Inside, they found kayla brown. She and her boyfriend had been missing since august. It was pretty emotional to say the least when she was found, especially, you know, when she was chained like a dog. She had a chain around her neck. The man was arrested. Brown told investigators there could be four bodies on the property. The search continues for her boyfriend, charles carver. The search is on for a killer in san jose. Police say that someone shot two men last night near bambi lane and peter pan avenue on the citys east side. One of the men died. The other was rushed to the hospital but is expected to survive. So far police are not releasing any information about a possible suspect or motive. And in oakland, authorities are investigating after a body was discovered in a park. Someone found a womans body yesterday. Chopper 5 was over the scene at arroyo viejo park on krauss avenue. Police dug through the area trying to find some evidence and right now, theres no word yet how the woman died. The Alameda County coroner is working to identify the victim. New this morning, a santa rosa man is behind bars after threatening to kill a police officer. It happened last night just before 7 p. M. Near marlow and piner roads. The officer stopped and got out of his patrol car. Police say raoul valencia ran away, punched a car and weaved in and out of traffic, throwing a cell phone into a large glass window at a nearby jackinthe box before shattering it and was arrested. City attorney Dennis Herrera is suing the millenium tower developer. He is accused of deliberately hiding the sites structural problems from buyers. The lawsuit claims that the developer knew about the issues before putting the expensive condos on the market. My offices investigation shows that the developers Mission Street development, llc, knew for at least a year before they began selling condominiums that this 58story residential building was sinking much faster than expected. The developer says that herrera, quote, has chosen to take the focus off finding a fix for the building and is instead attempting to divert attention from the real culprit here, a government agency, end quote. The developer claims that the construction of the new transbay terminal next door is making the soil weak. A taller residential tower is under Convention Next to the millenium tower. 181 fremont is expected to open next year. The tower is 55 condos, expected to be some of the most expensive. But because of the sinking and tilting problems millennium is experiencing, chief Investment Officer says buyers are not flooding the Sales Department with questions about foundation designs and structural engineering.
