Only on 5 tonight allen martin discovered something the city didnt want anyone to know. Reporter they line up before dawn waiting to get into traffic court. Many are hoping to get a break on that expensive red light camera ticket. Im definitely not looking forward to pailing the 400. The yellow turns go fast to red and i didnt have a chance to react. Reporter it happened at mallory and farwell, an intersection in fremont that caught the attention of this man. Sometimes you see something thats going on. Reporter jim listener made it a hobby to monitor red light cameras across the state. Recently he noticed a pattern at that same location that he considered suspicious. It all started when a new state law required yellow lights to lengthen for safety reasons based on the actual rather than posted speed of traffic. On august 1st, 2015, when the new law took effect, tickets dropped dramatically. Then suddenly the cameras turned out an average of 280 tickets a month from february through october 2016 from 54 a month. Just as suddenly the ticket count took a nose dive back down in november. Jim noticed a similar pattern up the street where an average of 17 tickets a month spiked to an average of 177, then lunged back down. That raised alarm bells. Why did that happen . Reporter sifting through documents he routinely requests from cities, jim discovered two sets of timing charts for the two intersections that he considers suspicious. One shows the yellow light timed at 4. 7 seconds, a line across the chart and the words superseded. The second set of charts shows the yellow timed at 4. 0 with the handwritten note that the change was made february 1st, 2016. That happens to be the very same date the cameras started cranking out red light citations in record numbers. They shortened the yellows. Thats the smoking gun. Reporter shorter yell homes can produce more yellows can produce more red light tickets, but if the city did change the timing on the yellow lights. We put a stop watch on them and both were timed at 4. 7 seconds. So what happened. We had student interns helping us. Unfortunately in a few cases some of the information that was on those pieces of paper werent accurate and dont represent what was actually done out in the field at the traffic signal. Reporter he said even though it may look that way the yellow lights were never actually shortened. People hear that and say oh, really, blaming the internal. It was the intern who caused the stock market crash. I dont know if theyre going to buy it. I think what were talking about is whats written on a piece of paper. The issue here is, you know, is the yellow timing out at the intersection in compliance with state laws . The answer is yes. Reporter as for the spike in tickets over nine months last year, he says its partly just more traffic, but also we consider this the rebound effect and people will get used to okay, theres more yellow time here now. Ill use as much as i can. Reporter back at the courthouse rohan wasnt too hopeful, but who knows. After this report things could change in. Fremont allen martin, kpix5. Rohan appealed his red light ticket. Allen will keep us posted on his case. Look at this.
