President trump announced his pick during east coast prime time hours. Neil gorsuch at 49 years old, the youngest nominee in the past three decades has three degrees from columbia, harvard, and ox farred. He worked under george w. Bush and was on denvers court of appealing. He has a brilliant mind, tremendous discipline and has earned bipartisan support. Reporter he ruled in favor hobby lobby. The owner said he was refusing for religious reasons to refuse Birth Control to employees for the Affordable Care act. A judge who likes every outcome he reaches is very likely a bad judge. While it is a tremendous honor, it will be a wild ride. Reporter John Trasvina is the dean at the u. S. Law school. He says gorsuch is uncontroversial, but the fight for his nomination could turn into a brawl. Will the democrats block the nomination and with the republicans get rid of the filibuster . Then we will have another institutional crisis on our hands. Reporter behind the scenes there has been drama. All day, the event has been built as a suspenseful episode of the apprentice with two front runners going to washington and the winner announced at the last second. After all the drama, the other front runner never even left pennsylvania. Joe vasquez, kpix5. Gorsuchs family has a long history in the legal profession. His mother was the director of the epa under president reagan. His father and grandfather were also lawyers. Gorsuch is the father of two daughters. Tonight, the president tweeted i hope you like my nomination. He is a good and brilliant man respected by all. A crowd of people both for and against gorsuch gathered on the steps of the supreme court. Some prayed for him and others chanted against him. Californias new senator Kamala Harris tweeted this. I am troubled by the nomination of judge gorsuch and will fight to assure the voice of the American People is heard in this process. Senate democrats are vows to block the nomination just like republicans blocked president obamas pick last year. And House Minority leader nancy pelosi is not mincing wording calling gorsuch a very hostile appointment. If you eat food, take medicine, or in any other way interact with the courts, this is a very bad decision. Well outside the man stream of american legal thought. And, from congresswoman barbara lee, i am concerned he will not meet the high standards necessary to be a justice that protects all americans. Reporter yeah, the city Council Voted unanimously to file a lawsuit over president trumps executive order targeting sanctuary cities. Santa clara county gets a billion dollars in federal funning a year that will soon be filed thursday or friday. It comes on the heels of the first lawsuit filed earlier today. Obey the rule of law. Abide by the constitution. Reporter San FranciscoCity AttorneyDennis Hererra defiant in the face of trumps executive order to withhold funds from sanctuary cities saying it vie lutes the constitution protections of religious freedom and forces cities to do the jobs of immigration officials. President trumps executive order tries to turn city and state employees into federal immigration officers. That is unconstitutional. Please proceed. Reporter meanwhile, in sacramento today, the backlash came from Democratic State lawmaker. Forget sanctuary cities, they are pushing to turn california into a sanctuary state. We want to make sure that people who are here for all of the right reasons are able to stay here. Reporter senate bill 54 would block local Law Enforcement statewide from using resources to investigate, interrogate, detain, detect, report, or arrest persons for Immigration Enforcement purposes. Legislation that would require the whole state to follow protections including cities like san rafael which has declared it is not a sanctuary city. And menlo park which is on the fence. The California Sheriffs Association released a statement opposing senate bill 54 saying it would limit the ability of Law Enforcement agencies to cooperate with federal authorities on immigration matters. The rain will move in as soon as tomorrow night. Talk about the impacts that have been fired up. A winter storm warning is in effect for the sierra. About 5500 feet in elevation, there will be snow. Lake level getting up to a foot of snow. But the peaks, the higher elevations, eight or 9,000 feet. Fife feet of snow by saturday. Strong winds on highway 50 also interstate 80. Speaking of wind, the coastline and the bay area, you are under a wind advisory beginning tomorrow evening. Wind gusts here could be upwards of 50 miles an hour. They put in bathrooms. Reporter there are not just tents, but tiny plywood houses complete with doors and windows popping up inside marcus park. The rvs were cleared out today. And, the city has warned the structures and the care facilities will be evicted thursday. I got part time job. But, im hopeless and i need to be able to brush my teeth and take a shower and show up to work. Reporter 16 full time residents at the Promised Land plus advocates showed up at the Oakland City Council meeting begging for a reprieve. Its a crisis. There is so much homeless out there. People are dying on the streets because it is coal. That really bothers m. Why should we die because it is cold . We are in a city of so many. Reporter the city of oakland says they get daily complaints about encampments around town. Not just the Promised Land. Encampments springs up, torn down, and reemerges again. Someone needs to step up to the plate and help us and quit acting like we are a disease. Flores some say it is a bay area Justice System in disarray tonight. Computer problems are so bad, Jessica Flores reports some are being wrongfully arrested. Reporter this was supposed to be an upgrade, but the Public Defenders Office and prosecutors agree it is causing chaos. I would say it is more than frustrating. It is completely outrageous. Reporter Alameda County public defender brendan wood says the new Computer Software they are using is processing inaccurate recording and causing legal nightmares. There are miscommunications that are now felonies. We have people driving without a license showing up as a felony. Reporter woods filed a motion with the Alameda County court blameing the software called odyssey for wrongful arrests and unlawful jail time and listing people as sex offenders. Court and ministration and the District Attorney agreed the software is not working. They call it cumbersome. What would take it to update normally . 20 to 25 minutes. The clerks are really working hard trying to keep up. They simply cant. Reporter so, for some defendants, they show up to court, have their warrants recalled, but the information doesnt show up in the system. In the worst examples, defendants are wrongfully arrested on outdated warrants. What is the Justice System here in the county. It is making it extremely inefficient. Outside of peoples Constitutional Rights being violated. Reporter the judge is giving all parties a week to come up with a fix. But the problem now could be money. The county already spent 4. 5 million on the software. In oakland, im Jessica Flores, kpix5. The maker of the Software Company odyssey tells the chronicle it is committed to Alameda County but the problems are not the fault of the software and it is working just fine in other places. Mane while, in a courtroom in san jose, the defense began attacking the dna evidence in the sierra lamar murder trial. Antolin Garcia Torres accused of kidnapping and killing the 15yearold girl almost five years ago. But her body has never been found. So, prosecutors are relies heavily on items they say have dna from both sierra and the defendant. Today, a defense attorney told the jury in san jose that investigators mishandled that evidence. He also said the science being used in the case is questionable. It is clear from this case that the battleground is going to be the dna evidence. And, what the defense did today is to suggest that it was contaminated at the outset. Sierra was last seen walking to a School Bus Stop in morgan hills. Tonight, uc berkeley is bracing for potential chaos on campus. A Breitbart News editor is paying a visit tomorrow. As veronica de la cruz tells us, more than a thousand protesters plan to greet him. But, if you start the application before then, you will have an extra four days to complete the application. It is unclear what the future holds for covered california and the aca. But, since open enrollment started in november, more than 320,000 people have signed up for covered california. And that is up from last year. Have you checked your pg e bill lately. Tonight california customers are complaining their bills are skyrocketing all of a sudden. So whats the deal . Here is what we found out. Reporter Angeline Roswell only runs the heater a few hours a night to break the chill and avoid burning her bottom line. But, in the last three months, her bill has left her with sticker shock. Im like what . Reporter her bill jumped from 20 to 90 a month for the first time in the 12 years she has lived here in folsom. 350 increase. Ion scared. One of these days im coming home, that they cut off my heat. Reporter the utility Watchdog Group turn says they are hearing from more bay area user withs skyrocketing bills. If you have the sort of real combination of higher rates, winter baseline, in effect. And cold weather. Reporter pg e tells cbs13, rates went up 7 a month. That is not enough to triple someones bill. A spokesman said while average customers bills are still well below the national average, we want customers to know we are here to make Smart Energy Choices and manage their costs. Pg e apparently is not doing enough to help customers this winter. Reporter pg e says it can perform Energy Audits of any users home to trace the source of their high bills. That encourages concerned consumers to call the utility advocate for help analyzing their bills comparing overall usage from year to year. Angeline says she will suck up this bill and turn off the heater altogether to see if that makes a difference. Well, nights will be a little warmer because we will be cloudier the next several nights. Also wetter. Rain moving in tomorrow. Oakland now, 51 degrees under mostly cloudy skies. If you add everything up, the rain beginning tomorrow, ends friday night, an inch or two of rainfall for the east bay. Which a couple of years ago we would have said thats a huge tomorrow storm but compared to a few weeks ago, that is about half the amount. Beautiful city of San Francisco, one or two inches of rainfall. But, we are not done yet. The unstable pattern will continue. Low pressure to our north. One sitting off to our west. Keeping things unsettled. And next monday, we will also have an additional rain chance. So, rain, more often than not for the foreseeable future and it begins tomorrow.
