Stronger in terms of understanding the facts you know for me and I am ready to vote but what about those 3 undecided senators we've been talking about all week what have you heard from them yeah we're focused still on Susan Collins of Maine Lisa Murkowski of Alaska and Jeff Flake of Arizona those 3 Republicans are really critical here Murkowski has mostly been ducking reporters and she's gone in and out reading that report for much of the day others like Susan Collins of Maine and flake they say you know they haven't said exactly how their vote but they both say they found this report helpful Collins called a thorough and flake who is one of the people who actually called for this investigation he told reporters he thought it was thorough as well and he says he hasn't seen any new corroborating evidence which is the thing that he said before he would be yes if that was the case if there wasn't a corroborating evidence that would be found so we're still kind of reading the tea leaves on how they're going to vote one of. The contents of this report how much of we learned about what's in there honestly virtually nothing because they can't tell us anything it is confidential that is locked behind those closed doors in the subbasement of the Capitol and we do know is that it's about 45 pages and they spoke to about 9 people and N.P.R.'s confirmed the names of 6 of them and most of those people are friends of cabin and Ford from high school they also spoke with Deborah Ramirez who was a classmate at Yale and she's the one who accused capitol of drunkenly exposing himself to her in the early to mid eighty's so like I said there's that one copy and the senators are just circulating through and telling us that you know that these are mostly interviews and a transcription of the of the conversations that they had we also know that Ford and Cavanaugh were not interviewed so they are not a part of this and Dems are pretty upset about that so senators now have the report the Senate majority leader has said he wants a vote in the next 48 hours what happens in that time sometime likely tomorrow morning there will be a procedural vote that is necessary for them to move on they need 51 votes to pass that and that makes this a really key test because 51 votes is all it takes to approve his confirmation when that comes up so if they can get to the 51 votes now it's very likely they'll be able to get to it once the final vote comes up and you know it's it while it is procedural it's really extremely rare for people to change their minds after a procedural vote like this and you know just as a reminder there are 51 votes Republicans have that right now and they can afford to lose one person and still approve Kavanaugh because vice president Mike Pence could step in and cast that tiebreaker then a final vote comes about 30 hours later that means sometime maybe Saturday afternoon or early evening for a final vote Kelso we reflect on the political consequences of this controversy we're about a month out from the midterms Yesterday we heard about this n.p.r. Marist poll saying the Republican enthusiasm had jumped over the last month perhaps because of Kavanagh do you expect that this confirmation vote could have a real impact. On congressional elections Honestly it depends on how you're looking at it for House Democrats it's great they're fighting a battle ground in the suburbs and they're eagerly courting women there and this has energized them the Senate battleground on the other hand is in states that trump won in 2016 and that's a much harder situation for Democrats up for reelection in those states so far only one Democrat in front of that group is some we haven't heard from that's Joe Manchin of West Virginia and yesterday Heidi Heitkamp said she would not win this is what she said the process has been bad but at the end of the day you have to make a decision and I've made that decision the polls are showing her down and this might be the thing that she needs to do to kind of remind people she is a Democrat and this is in the state of North Dakota right that's right and I mean from a lot of Democrats that they think Republican enthusiasm may fade if Cavanagh gets confirmed so we'll we will see N.P.R.'s Kathy Snell thanks so much change you well as we just heard Kelsey note there the f.b.i. Interviewed 9 people for its report not Ford or Cavanagh or some of the others from the judge's past who have stepped forward to share thoughts on his nomination Chad Ludington went to Yale with Cavanaugh he says they used to drink together that when Kavanagh drank he got belligerent and aggressive that he once saw Cavanaugh throw a drink in a man's face prompting a bar fight and that he believes Cavanagh may have lied under oath I asked Chad Ludington did he offer this information to the f.b.i. Yes I did I eventually did reach them by phone they did tell me what exactly to do 1st and that entailed sending a request for a form to fill out and then I filled out the form in fact when the former rival had been prefilled by the Presumably the age most spoke to with my testimony in it that took up most of the 3000 character spaces that they allowed So you filled out this form did you ever then sit down with or have a phone interview with with an f.b.i. Agent following up on it alas I did not I was never called back I waited by my phone by my computer. Hoping to get an e-mail that nothing happened I mean to be clear your statement boils down to that you saw him drunk back in college which of course does not prove or disprove allegations of sexual assault which is the central question that the f.b.i. Was looking into why is your account relevant to the f.b.i. Why do they need to question you well I think it's relevant because 1st of all I don't think one should lie in front of the Senate Judiciary Committee one has taken an oath and one is also trying out in this case it's a job interview to become a Supreme Court justice and when you're saying you thought he lied in testimony this was in regard to the extent of his drinking yes the basic lie was that he said he knew unequivocally that there was absolutely no way he ever drank to the point of being unaware of the phrases blacking out I think that made confuse that with passing out but the blacking out freeze means doing things that you don't know you have done and what I'm saying is there's no way that he given the state of his intoxication on a frequent basis can say that he knows for certain that he never got to that condition how can one know let me let me ask you this a central question today in Washington now that the f.b.i. News I'm Liz Ruskin walk into the National Portrait Gallery here in Washington right now and you will find a painting that has been ripped to shreds and those shreds nailed to the gallery wall another one nearby hangs half loose from it stretcher it's rumpled It's a portrait of Thomas Jefferson and behind it you glimpse a seated black woman the pieces called behind the myth of benevolence these are works by the artist far he takes familiar images and remakes them maybe pulls a hidden figure to the front as of today a farmer's work has been recognized with a MacArthur award these are the so-called Genius Grants and Titus Kfar joins us from New Haven Connecticut 1st of all welcome and 2nd of all congratulations and thank you so much I want to ask what was going through your head what was your honest reaction when the phone rang and you got this call but the truth of the matter is I did not believe the person on the other end and in fact I said stop it who is this but you know they reassured me that in fact there was a real I want to let people hear a little bit more about your work for people who aren't familiar with it so start with a portrait of Thomas Jefferson that I described talk to me about what you're trying to do here so I had a conversation with. American history teacher and somehow within that conversation there was this phrase that she uttered Yes but Thomas Jefferson was a benevolent slave owner and. I was sort of socked by that I didn't really. Dan what she meant and I asked her to elaborate on it but she couldn't she did and we sort of sat there in silence for a little bit I went back to the studio and this is the painting that I made and so that particular piece is kind of pulling back the curtain on these ideas these allusions these stories that we tell ourselves about the founding and to do that you're literally pulling pulling the canvas of the traditional portrait down that's right that's right and that really has to do with trying to for myself find a way in to these concepts that physically so if you were asking yourself a question about what is it how do you make a painting about torture then you change that yourself the question what does it mean to torture a painting rather than making paintings about something you make paintings that reflect that thing it sounds like if I'm hearing you right your big point isn't We've got to forget the past we're going to reset it's we have to shift our gaze and confront it why do I mean why does it matter to frame it in quite that way. I don't think that pretending like it didn't happen is beneficial I think it's in fact damaging I think if we are not honest about our past then we cannot have a clear direction towards our future and so you know we're having a sort of national conversation right now about public monuments and in this discussion we are talking about we have the sort of binary conversation about keeping the sculptures up or taking them down and I actually think that that binary conversation is problematic I think there's another possibility and I think that possibility has to do with bringing in a new work that speaks in conversation with this whole work it's about a willingness to confront very difficult past So practically speaking you know apply that to all the Robert e. Lee and all the Jefferson Davis statues that are all over the South is what you're saying. They can stay there but let's build some alongside them that makes you think about this man this history in a different way. Let me be absolutely clear if we are continuing that binary conversation where we're saying either keep it up or take it down take it down I don't feel in love with the sculptures that's not what this is about what I'm saying is the binary conversation doesn't bring all of the issues into consideration so there's a 3rd option the 3rd option is we engage our contemporary artists of this time in the same way that the w.p.a. Did we bring in contemporary artists we have the mix cultures that exist in the communities that they live in we present those sculptures in the same community squares where these Robert e. Lee sculptures exists we pull those sculptures down from the pedestal bring them at the same level as these new contemporary works and we force these works to engage one another I think one of our challenges is that we sort of consistently try to make public sculpture in a way that it's a sentence with a period at the end and inevitably it's not it's a comma and there should be a clause after that rather than thinking of these things as the sort of like and shifting concrete blocks that are finished.
