Reports Terrance Hardy has served time for assault with a deadly weapon, he is suspected of violent incidents at three oakland libraries last week. Again, Oakland Police have confirmed that this man, hardy is in custody tonight. In the meantime, theres questions why police took 15 minutes to get the to a young boy. A doctor made the 911 call 11 30 friday, saying that his son was barely conscious and bleeding from the nose. The first Police Officer arrived 1 30, and firefighters 2 30 after the initial call and the ambulance, 15 minutes after the call. Was it a statue . Yeah, a dolphin statue fell on his head. Do you feel a quicker time would have made a difference . It hard to say. Despite the efforts on everyone involved, our trauma surgeons were not able to repair this boys injuries. The boy died from internal injuries to his abdomen. They keep commenting that the hospital and Police Department and how amazing everyone was to come to their aid. Earlier this week, his uncle said everyone was grateful for the response and the help they received after the accident. The uncle tolds that the family would have no comment on the time it took for the ambulance to arrive. Norad has confirmed that Russian Strategic bombers came within 15 miles of the pacific coast. They were practicing bombing runs near alaska. Two of the bombers turned back and the other two flew toward toward california. They were intercepted and the russians headed west. Norad spokesman, jeff davis said the aircraft acted professionally. 15 bombers have been intercepted near u. S. His father, oscar grant, jr. , is suing him charging that has been deprived of a familial relationship with his son. He was looking forward to seeing his son and developing those a greater relationship and to seeing him in the future. Grant was in court today at the plaintiffs table with two state Corrections Officers sitting behind him. He was transported from a prison, where he is serving a life sentence for murder t the dramatic moment of the day came when the attorney showed the cell phone video of the shooting. He never looked up. As it was playing. It was not until the afternoon when he finally took the stand. Plaintiffs carefully led him through a litany of questions about his career, his training and eventually to the night of the shooting. But his main line of questioning had to do with whether it was intended to shoot grant. He drew his firearm because he thought mistakenly thought that oscar grant had a gun. You do not bring a taser out to defend yourself when you are presented with a gun. His lawyers claim that caldwells civil ryes were invoi violated in that he was detained unlawfully. The archbishop of San Francisco is taking heat from several politicians for attending an event that is being organized by a antigay hate crew. A letter was sent to the archbishop in which they urge him not to attend a rally that was organized by the National Organization for marriage. Mayor lee said that the Catholic Church should move to unite people on samesex marriage. They are building a bypass around a town and the first phase will cost 210 million involve the largest wetlands fill in Northern California in at least 20 years. Caltrans has missed deadline a after deadline for environmentallial improvements required by state and federal governments. We had planned to bring you a update on this story, but caltrans backed out of the scheduled interview at the last minute and refusing to speak on camera because caltrans claims we are biased. We are not. They want us to submit our questions and allow them to answer in writing only. Certainly we do accept written informationing. But journalistic standards demand that we ask the custodians of our tax money face to face questions. No interview has been given and since they will not talk with us, we will focus on caltrans own photos and data to speak for themselves. Construction on the byapproximate pass bypass is in the second year. Work stopped for the winter but its back if swing now. The work is running through habitat for salmon and trout. Cal frantrans is required to pr the creek and make improvements to help the fish survive. Caltrans sent us picture of debris they removed to help the fish get up the stream and lay eggs. This is photos that showed what happened later. This is after a heavy rain when the Erosion Control measures failed. You can see the creek here, let me highlight it for you. There it is. As pollution poured, just at the time salmon were breeding. This is what is supposed to happen. A salmon in clear water digging up loose gravel to lay her eggs. This fish is in a creek in marin county, this photo was taken by is spawn, salmon all over the state are in trouble and the biologists told us that sediment can be dangerous. It decreases the amount of oxygen and smother the eggs. The problems were so bad that the Regional Water Quality Control board notified caltrans it violated the clean water act with ten Straight Days over the allowed levels. Public documents show they ordered caltrans to make improvements. And caltrans submitted photos to show the progress. Saying that contractors immediately began work following the rain event to correct the conditions and they would do more as weather allowed. Then another big rain storm hit and the site was inspected and more problems were found. They sent a lift to caltrans with detailed photos to document the problems. This creek is supposed to be protected from sediment, and you can see mud flowing down hill with the captions, inadequate Erosion Control. Slope failure. The drainage system was so overwhelmed, caltrans tried to pump up the water with trucks and haul it away. The water board said that trucks are an inefficient and unsustainable Water Protection action. This is unfortunate, the Water Quality is degraded. Caltrans is required to monitor Water Quality at the water construction site. Pollution caused was above the allowed level at some time on every day we checked. Sometimes by a lot. These Water Quality readings are from the worst day taken every 15 minutes and now you are looking at our analysis of the data. The percentages show how high pollution went above the permitted level. Many readings are more than 100 over what is allowed. A caltrans email acknowledged that since is february, turbidity exceeded the maximum allowed, but it happened with decreasing frequency as the repairs progressed. Caltrans submitted more photos to the water board showing improvements. They are saying they are committed to working with the water board and protecting the Water Quality, but spawning season for the threatened fish is over. A biologyist told us that there are young salmon and steel head in the creek about a highly downstream from where the Erosion Control failed. But theres no way to know for sure, whether more fish would have survived if less dirt had gotten into the water t water board said that caltrans could be fined up to 10,000 a day for the pollution violation. So far it has not happened. And as we told you, caltrans refused to speak with us on camera. I wanted to do that. A Senior Engineer said he does not agree with the water board findings.
