Reporter mark says he needs a little more time to clean up and finish up construction on his two story san mateo home. It is a project he started more than ten years ago. I have had some heather ishimaru shoes and stuff like like some health issues. They for some reason feel like it should be done immediately if not soon. A contractor by trade, he took out permits for an extensive remodel in 2001. Since that time he made progress but not nearly enough according to the city. It is a public nuisance that involves potential fire hazard and involves potential rodent infest yaks. In 2006 the City Attorney asked for a detailed timeline for the completion and clean yep of the debris on the property. Earlier this year the city red tagged the house as uninhabitable. His wife and children moved in with a relative and he move inside a tent in the front yard. I cant live in a tent because im not supposed to use the families sits in the house. Reporter the city wants an order requiring them to clean up or abeen a ton the house the city thinks is dangerously full of luter with unfinished walls and sealings and lack of heating. The neighbors we found were some what sympathetic. The house itself is presentable but i dont like the stuff in the yard. He has been working on that on that site for 710 years a little at a time on his days off. He has been working on it and done a real good job. I would like to get it done and my wife and children would love to have it done. I just need more time. Reporter the city has said that he has had more than enough time and they are done asking for cooperation and are now demanding it. The two sides will meet in court here on february 14. In san mateo, laura anthony, abc 7 news. Lets take you next to las vegas and dramatic images of a crash landing at North Las Vegas airport. Two people onboard the plane evacuated safely before it went up in flames as you can see. Crews were using purr flame retardant as they tried to put out the fire. An investigation is is underway to figure out exactly what happened. A pilot died while doing frost control in the central valley. Her helicopter crashed in a vineyard. Helicopters are often used to help circulate air above groves and vineyards. All the rain we had around christmas pushed the creek over its banks and into homes. David louie explains the plan now to keep the creek under control. Reporter christmas eve, East Palo Alto residents got a gift they didnt want. The waters of the creek rose to the third highest level in recorded history flooding 7 homes and damaging levees, streets and other properties. The public Property Damage at 2. 7 million but it it doesnt have the money to do repairs before the next big storm strikes. There is a threat for the remaining rainy season because of the gradual erosion that we have seen that is now affecting the road, it is affecting the bridge. And so it has the potential to break at some point. The city council will vote toll on an emergency proclamation. The first stop request disaster funds from the state. The East Palo Alto current budget is operating at a 372,000 deficit. State aid would cover 75 of the costs and the city would pick up the remaining 25 . There is no indication whether the governor will agree to help. Money is tight but we will october have to prioritize our budget and dip into the reserves in order to make the repairs. We have to make sure that our infrastructure and the lives of the residents is safe. An estimated 40 to 50 of the 28,000 residents live in the creeks floodplain. We are prepared to evacuate people. We are working closely with the School District and their buses and with the American Red Cross for shelter. Hopefully that wont happen but either way we want to be prepared. Reporter the city has done its homework, documenting the damage to levees pump station roads and other facilities. There is a longrange plan to address flooding but shortterm repairs are also need. They are in the same area we are working. It is something that we were conscious of and working with them on to make sure that anything that is done in the shortterm complements the longterm activity. Reporter these Palo Alto City Council meets at 7 30 tomorrow evening and will vote on a companion measure to extend a moratorium on new construction in the flood zone. Police say that a Northern California girl was so fed up with how strictly her parents were over the Internet Access in the home that she put sleeping medication in their trips. The incident happened last week in the sacramento suburb of rockland. Police just released the information today. Jonathan mum has details. They woke up at 1 00 in the morning and had hangover type systems and had a headache and went back to sleep and felt the same way the next morn something felt something was strange. The parents were so sure something strange was going on they picked up a drug test kit from the Police Department. Something parents often buy to check if their children are using drugs. This test, however, they tried on themselves. The results brought them back to the Police Department with their daughter along with them. The story came out the drug test, we asked the parents if there was a witness as well and asked them what happened and from that we dedeuced what occurred and arrested them both. As it is because they are juveniles it will be going through the Juvenile Court system. Because they are underage police are not identifying them or their families. Cards will begin and be available beginning february 1. Oakland expects to issue 6,000 of them during the first year of the program. The governor is about to announce one of the most significant changes in decades in how california funds education. Abc 7 news capital correspondent Nannette Miranda explains that it will change the way many special programs are paid for. And, of course, the plan is already growing. Reporter in a bid to give districts more local control and boost funding for schools with low income, governor jerry brown plans to dramatically change and maybe even eliminate what is called categorically funding. Superrestricted money the state gives to schools that must be spent on certain programs like Adult Education and smaller class sizes. 56 categories in it all costing nearly 12 billion a year. The analogy is that if you buy a pencil with the money out of one program you you better not be catching a kid use it inside another program. Reporter under the new formulas, Education Finance advisor kevin gordon says California Public schools would get the same about per pupil funding and would only get more if there is a large number of kids in poverty and or student who dont speak english. Some studies show it is more expensive to educate those groups but it will come at expense of more affluent areas to pay for it. The thinking is that urban districts will win big under this. Categorically were put in place for a reason. Reporter critics say while the goal of giving more money to needy students is good telling School Districts they dont have to spend money on certain programs could lead to no programs at all. Adult education was eliminated on a number of cam passes and money to limit class size in younger grades was spent elsewhere, leading to crowded classrooms up and down the state. The state has an interest and has an obligation to make sure that the School Districts are making the best decisions possible and that means having categoricals in place. Do you really believe in the local control and let the local School Boards make the decision or not. Do you trust them to do the right thing . A driver fell asleep at the wheel and crash inside two homes. The car hit the side of one house knocked down a fence and crashed into the bathroom of the second house. New information tonight about a man accused of murdering a south basisman and about the victim himself. He was killed in his own home at the end of november. Three people who identified themselves as garcias siblings told me her brother doesnt know the people accused of the same crime. He doesnt know any of them . Including raven . Raven dixon is the fourth person arrested in connection with the bizarre case. Police say she is a prostitute who had a relationship with kumra. President obama has just signed the fiscal cliff deal to avoid all of the problems that you heard it would cause. He did so by aa auto pen becaue the president is actually in hawaii. The auto pen duplicates his signature and he can sign a bill that way so that deal has become now the law. Last nights agreement to extend the bush era tax cuts that the president just signed spurred a rally on wall street today. The dow jones climbed 308 points its biggest gain since december of 2011. The nasdaq jumped 92 and the s p 500 rose 36. But the fiscal cliff deal also set up another confrontation between congress and the white house. Political reporter Mark Matthews with what is ahead and a little talked about step Congress Took last night to help wealthier taxpayers. Congress instituted the the alternative minimum tax back in 1969 to go after millionaires who were avoiding income taxes by claiming big deductions. And this was quite common where you could get into leveraged investments that would produce very high level amounts of deductions. Brian is a San Franciscobased Tax Specialist who has been writing about the alternative minimum tax and how it has gradually been hitting more tax paces than originally intended. It is not going to hit people that are in the 40,000 or 50,000 bracket. But if you are a couple making 150 and above. Then the amt could come into play. Reporter particularly because the law intended to catch the wealthy was never adjusted for inflation and wages and prices, well, they have gone up a bit since 1969. , trapping more and more of the middle class in the alternative minimum tax. Are we talking about millions of people . Im sure. Absolutely. Reporter so last night when Congress Passed the bush era tax cuts for middle class there was a provision to the amt that would account for inflation. Now, to explain the impact, a hype pathetical tax return for someone making 150,000 a year. Single. Over that amount. Our hypothetical taxpayer still got hit with the amt and the new adjustments didnt seem that be that big a deal. A few people will benefit in percentage terms but it is not that big a deal at all. If you have is been caught in the past you will likely be there again come april 15. Last night congress tweaked the amt, they didnt fix it. In the newsroom, Mark Matthews, abc 7 news. The solar panel produced an extra 1600kilowatt hours last year. Enough to power another house for three months. For that see received 57. Harrys system produced 310 and he got about 10 bucks. Allen took a different route. It would be a lot smarter for us just to use our electricity rather than sell it to the surplus to pg e. He replaced a gas heater with an electric one. People felt if they were generating more power are than they were using and not getting anything for it, that it was kind of a winfall to pg e. Reporter however, pg e says home owners do get paid and the rates are set by the California Public Utility Commission based on spot market prices. The idea that you are giving anything away at the end of the year is inaccurate. You are paid that spot rate the same 80s we would purchase that electricity anywhere else. Huffman sponsored the bill that provides the payment. I intended for folks to get more. I would like to at least double if not triple the amount that they are currently getting. Nobody is going to get rich from the net surplus power that they generate but that would be a more meaningful incentive. Some home inners instead of taking a small payment they are plugging in more stuff. People would string extra Christmas Lights or leave the hot tub on. Pg e and other Utility Companies say paying more to solar customers will result in higher rates for the rest are of the rate payers to cover overhead costs. Many home owners want policies that encourage more solar. There is too many reasons why it is a good thing. Makes us energy in dehe pendent and less reliant on far flung energy sources. Pg e says 7 of solar customers are producing surplus powers. Boyles cannot say how much energy the customers supply to the grid. A report says home owners added 5 gig gentleman watts to the grid.
