spleen during the protest. we were hoping would he talk today. would you mind talking to us for a couple minutes. >> no. >>reporter: instead he was polite but firm though he did say he has seen the video that shows him revving orders to move by oakland police. stand off led to one officer bricking rank and going after him with a baton not once or twice but repeatedly. photographer who shot this video told us by telephone today this view of the incident. >> i figure something was going to happen so i felt compelled to be there next to him and stay there with him when he was getting beat. i mean, because i thought it was important and also because it's just hum an instinct. >>reporter: after his arrest he spent 14 hours in alameda couldn't jail where he says he complained of feeling sick. last week the sheriffs office countered with video from survillains camera that shows the veteran meeting with medical staff and then becoming ill hours later. at that point the staff called an ambulance and took him to high land hospital but that is secondary now. we had a link of the video to oakland police who didn't return calls. they said the case is under investigatio investigation. nor would members of the oakland city council comment but hi ranking law enforcement official from another city who asked to remain unidentify made 2 crucial points d.he said it appeared to him that he was being confrontational. second that the officer should never have broken rank to good after him. classic case he said of an escalating situation. earlier last week the sister told us had he hog to do with the demonstration. that he was simply trying to make his way home. video seems to contradict that. as for the photographer who shot this video, he says he's not turned it over to the retain your driver's license photo in its database without getting your permission first. already the utility has deleted tens of thousands of hat were collected in its database over the past 5 years. generally it's okay to swipe a license to vary fay age or identity for transaction like buying alcohol however it is rarely legal to store the fovrment legal analyst dean johnson says so far no one
