99 days late. the assembly passed the compromise budget earlier tonight. senate is meeting tonigight to give final approval. it has just taken a recess. state senate president stein berg just told legislators it's time to get over the road block and take action. >> until we break whatever log jam exists, i'm not sure there should be a log jam given the fact that this is a 5 party deal. 4 caucus and the administration. and it is day 99, i think. so we can be here a long time or we can be here a short time but we are not going to leave until we get the budget done. >>reporter: that's darrell sand berg minutes ago. recess lasts until 9:15. 15 minutes from now. but even when the budget does pass the senate will likely head into another fiscal mess. more on that now from capitol correspondent if annette. >> this is very best we can do. >> is this really going to work is the tape going to work. >> we'll have a deficit next year. there's no question about it. >>reporter: as the legislature worked its way through a massive 87 and a half billion dollar budget plan held together partly with band-aid almost everyone knows it will only temporarily end the state financial woe. revenue projection appear to be too optimistic. such as 5 billion dollar in federal aid typically falls short every year. and many budget solutions are one time revenue rather than permanent fixes. >> i'm very clear. this budget does not address california structural im balance and i don't say that with any great pride. >>reporter: why approve the flimsy budget plan? because california is embarrassingly approaching 100 days into the fiscal year with no state budget in place. plus the state needs to do some borrowing very soon for infrastructure projects and needs prove it is good for the money. >> the bottom line important is both our treasurer and controller told us they think it is solid enough so that they can go to wall street. >>reporter: in a few short months lawmakers might have to go back and rework the budget. could it meap more cuts and/or more payment withholding. people who depend on state funding like adult health day care provider like jim has had it with not knowing one day to the next if he gets money on any given month. >> we have already had the budget cut that we have had and the budget impasse that affected us dramatically and it's hard for us to really keep our doors open. it is getting to the point where i just don't want to could it any more. >>reporter: frustrating too for rank file lawmakers not part of the ledership that negotiates the final budget pro mice. >> taxpayers should be upset. and we need to get the job done. that's what we are elected to do we continue to fail step after step. >> memorial to the victims of the oakland fir storm is horribly defaced tonight. vandal stole huge chunk of the bronze sculpture likely to resell it to get 4 dollars a pound and thousands needed to repair the memorial. lisa is live in oakland fremont courthouse is expanding tonight. the suspects now being accused of using a technology loop hole to get away with the scheme. story from abc 7 vick lee. >> speak to us about the case. say anything at all? about how about trust. >>reporter: traffic clerk juan hernandez pleaded not guilty to all of the criminal counts including accepting bribes, embezzlement and grand theft. he's charged with fixing tickets in exchange for cash. hernandez was arrested in august after sheriff's deputy set up a sting in the fremont courthouse. this traffic clerk felix chavez was arrested last month. also charged with receiving money to fix tickets. he pleaded no contest to the charges against him. abc 7 news has learned that investigators found at least 3 transactions where he received 3 to 400 dollars each for fixing tickets t.sheriff sergeant nelson. >> he would clear the ticket so the person basesbasescly tl would not have any record of that ticket at all. >>reporter: investigators say chavez and hernandez discovered a secret which enabled them to do what they did. >> these two gentlemen took advantage of an antiquated computer system. if they found a loop hole in it and they took advantage of it. >>reporter: so what was that loop hole? the glitch in the court computer system allows traffic clerks to clear tickets without leaving a trace. e wantw who else took advantage of that loop hole. >> we are lacking at a lot of different transaction that have gone out at the courthouse down there. >>reporter: most of those who are her because they got tickets told us they wouldn't accept the bribe. >> i don't do. that i try to do what is right by the law. >>reporter: pay your ticket that would be against the law so i wouldn't. tempting. >> i would try to defend myself first and if i was found guilty then i would say can we talk about that option again. >>reporter: some said the 2 clerks violated the public trust in the judicial system. >> if you can't trust the court clerk i'm sure that it can happen on all different levels. >>reporter: by the way hernandez was caught in the sheriff sting after a woman with a ticket told deputy he had offered her the bribe. we are told
