Is it reasonable for me to think that the court would want that 14 year old girl in that courtroom certainly say she was happy with the transfer of the parent who authority or the just seems like why wouldn't a great question and thank you for posing it is it seems very plausible to me the opposite that the court would want her out of the courtroom during some particularly delicate conversation yeah I would agree with that and it really depends on what's going on in the case and if she was actually testifying the 14 year old the then there can be a 2nd straight sheen of witnesses there can be all kinds of different things that may arise and so whether or not that's that's plausible it would really depend in my opinion on the circumstances of the case and so that in and of itself probably isn't a basis to say the stories false Yeah and I don't characters family law myself Jack but I can tell you that the one thing I do know for sure is is that these judges are constantly looking to protect the child best interests of the child etc so and a child at that age and again I don't practice family law but a child at that age I think would have very few legal rights when it comes to the right to be in the courtroom for any aspect of that proceeding Ok Dan let me follow up a quick so would your wife that if you were going to be in court your wife is going to be in court and you had a minor daughter would you you think your wife or any woman that listens to your radio show would so you know the strange man you know you can watch my daughter but that seems preposterous all but but under that accusation he's not a strange man he's he's a district attorney I mean that's the 1st person a monstrous a priest to be the 1st person the 2nd person to be the d.a. Interview that to me seems very very staged but at the same time that doesn't necessarily negate her credibility what to me as an attorney matters is whether or not you have proof or anything else that substantiates your allegation and just the context of this and the timing of this cast doubt in my opinion but it doesn't really have anything to do. Necessarily with assessing her credibility as an individual I don't think I have enough information I don't think anybody has enough information at this point which is why I've continued to say due process actually matters Jack recall man really appreciate there's a guy reads his stuff thinks about it it's better Pritchett to call 3 I guess there's a reason why 6971 the number so right now for 13 on a beautiful Monday afternoon won't be such a beautiful Tuesday. We don't have the 14 and now I'm not talking about that Jenna I'm talking about the allegation of the 14 year old more likely guilty more likely not guilty I'm going to say at this point with what we know more likely not guilty only because we don't have enough credible evidence for the proponents of evidence to shift in her direction and we have to remember that that the claim itself bears the burden of proof and if we shifted that and don't give him the presumption of innocence then we're negating everything that the law is about yet and we have some great sound from you you had on Burden of Proof and we'll play that in a bit but I think that is though it's outside the legal courtroom I think in the court of public opinion it's a fair way to approach it as well this this more likely than not standard we all know in a true criminal prosecution where you're looking to put somebody in jail etc would be beyond a reasonable doubt but in the court of public opinion I think most people apply that more likely than not so Al Franken boy there is so much good well I can't say good Al Franken today there's interesting Al Franken sound where do we begin he doesn't intentionally do what. Percent should they use that in college apps and both kids said no we don't want to go anywhere near that that's for and we all agreed on this No That's for folks who have been disadvantaged throughout their life because of you know getting to have a relative and because my I think and I'd have to ask my parents I think it was my dad's great grandmother if I'm remembering correctly that was 100 percent Cherokee one so I mean I have some native american probably more than Elizabeth Warren to be a 1000 times more like her chill yeah and a 1000000 times more than Elizabeth Warren because she's in that Churchill camp right they've never been able to document anything Frank Yeah but I was proud of our kids attitude and you know it's not like we were pushing at the question just came up through a college counselor to use that you know it's for people who've been disadvantaged that's one thing that was so repulsive about Ward Churchill using it it's see you. 1st in my opinion it was completely fraudulent but then you're taking a position from from somebody who is a true Native American and we all know how abuse Native Americans have been in this country right now and not my wife but I mean you know Native Americans who live who have lived that life and people who actually live the life and identify and have a significant part of their heritage in Hamley history I mean just being a because I think a lot of Americans we because this is the great melting pot we have a lot of different threads of of different lineage and all of that that we have and so how we use that I think what your kids did was was correct because it's not something that's actually the the full measure of what that's intended for which brings us to the Trump thing in the Pocahontas thing and we will get to that in the next segment but truly one reason that I can't imagine a scenario where she would be president of United States so let's hope she is the damn nominee if she can somehow knock off Hillary but I can't imagine a scenario where she'd have any chance to get elected because that is fraud I mean she used that to advance and it's fraudulent and you know that's that's just one of the worst things I think somebody can do you know when when so many true Native Americans have been so mistreated throughout 361619711 number what's so interesting about all of this too is that you look at people like Senator Warren and then you look at all of these sexual assault allegations and all of this stuff and really what are the consequences because we don't have term limits because we don't have any sort of process that's actually going to happen to any of these people I mean it's just it's an interesting phenomenon that we can all know Ok you lied you you're calling yourself you know Native American and lying on that all of these things that are coming to light yet there's really no consequence I mean if Al Franken doesn't want to step down what's going to happen. Yeah but when you say termites and believe me I appreciate fully respect all the good arguments in favor of term limits I don't think the founding fathers and mothers envisioned anything like what we have now but at the same time isn't that infringing on the freedom of the people on the will of the people to elect whoever the blank they want to I don't think that I mean if you have it term limits doesn't necessarily negate the right to vote among the options I mean we even saw that on in the 2016 election that we had a very close universe of options and the people's right to vote is actually a privilege in our system of government it's not an absolute right if our system changed then we wouldn't necessarily have the privilege of voting I'm glad that we do we have that aspect of democracy but imposing term limits I mean when the Constitution 1st was created senators were actually elected 3 state legislatures and I think the best way to deal with this is to repeal the 17th Amendment you want to go back to 0 times like just good as very and I think there are some great guys have been sandbagging me homely cow. You really want to do I think it would be much better is my head like literally exploding now are these headphones just like expanding out are they going to snap 1st or is my skull you really want to go there I do actually and I think that the 17th Amendment for the reasons that the founders insulated us from direct democracy and the House of Representatives and the Senate were supposed to be separate and serve different purposes and so the states having sovereignty were supposed to have some measure of representation in the Senate and that's why you have all of the things like advice and consent of the Senate not the House of Representatives with your permission I would love to explore this further after the break because it seems so diametrically opposed like totally backwards to the whole idea of big citizens small government why in the world would we want to empower the political elites with even more with even more of our decision making and take that out of the hands of the people but one thing you know about channel is she doesn't say anything without having a good argument to back it up I can't wait to hear this one Bob Bacon you are going through a break big fella. Well we lost Bob I guess he either had a bad cell connection or not a good answer for that because I thought her explanation made perfect sense you know she didn't want to blow the whistle on him because it would end her career she'd get blackballed etc So it would not surprise me at all if there were pictures of her smiling around him after that I haven't seen those myself I don't know that that is true because Bob seems to make some stuff up yeah but you hope you call back and it's a very interesting dynamic that we're experiencing now in this whole wake of the Harvey Weinstein thing because women are now feeling like they can come forward when there is a lot of pressure in a lot of different environments and I'm sure in Hollywood to just go along with whatever and whether or not that actually is consent or not I think is the most interesting question because if someone if a woman says you know what this this was absolutely terrible it was horrific but she goes along with it in order to advance her career then that to me makes her complicit and I and I think that there is and it's not that you have to report everything but I think that if you're willing to still stay around that and you're still willing you can't have remorse just after the fact if you're not willing to stand up and say this this is wrong at least privately here's why I would disagree maybe there's area for agreement in here but the reason I disagree is if a woman feels and if it whether it's a single mom working the counter at loaf and Jug no intent there with love from shop or if it's say an aspiring actress in Hollywood or even a well known actors who wants that key role if they sincerely feel like they must give in in order to keep their job or get a job to me I don't think they're complicit at all I consider that a form of rape and so. Yeah. Yeah well and I think there is some room for agreement because if it's essentially pressuring them in order to to continue on with their with their current They're in a double bind there it's a choice of evils essentially And I think there is a lot of compulsion and there's been a lot of unwillingness there on behalf of the women but at the same time they could walk away I mean we're not talking you know without severe consequence fine you can walk away but but and I'm sure I'm even more sympathetic I'm sympathetic in every example but even more sympathetic in the case of the single mom working at the gas station Yeah she has the right to walk away and not give that manager the sexual favor he's demanding if she wants to keep her job and get the paycheck to keep that apartment for her young children but if she walks away she walks away with with horrific consequences for her so I consider that a form of rape now apply it to the Hollywood actress who Ok maybe now she's looking for the big break or looking to stay on top it to me it's the same thing she doesn't really have the freedom to walk away yes physically she can walk away but then she has to pay a price which is to not make millions in Hollywood Well I mean I think I think there is and I'm not saying that these people if the allegations are true shouldn't be prosecuted but what I'm saying is I think it's a very interesting question to talk about consent to because really she's getting a benefit from it and Jenna she's not getting a benefit she's being spared. A theft she's being spared a deprivation she's being spared an unfair that it seems they have been titled glue that job to begin Well right and that's the assumption here is that with that single mom working in the gas station and everybody listening can think of a 1000 other example it sounds a little bit different and I think that when when someone already has a job and then someone comes in and their supervisor you know does that kind of an action him. It should be whether or not this happened have him go through that process have an investigation and the Senate by their own rules can expel him and I think they should they should conduct an investigation get to the truth of it and ultimately they should expel more guard lists of what that does to the g.o.p. Because we need to be concerned about truth yeah yeah no well no of course we need to be concerned about truth but what I'm looking at here is and I know you are too how passionately you're committed to these issues and you devote a big chunk of your life to prevailing on them but when we're talking about literally millions of lives at stake when we talk about the life issue when we talk about the stakes and all of these other big things Obamacare pick whatever one you want off the tree to me I'm really focused on on 1st and foremost winning. On those issues because let's face it when it comes to it we're always going to have some dishonest people in the Senate we're always going to have some bombs some will be Democrats some will be Republican we're always going to have some of that which doesn't mean we should greenlight it but at the same time if you're telling me I can take my choice I can either have a better chance of winning on all these big issues because Al Franken is sitting there in the Senate rotting away like a human stink bomb you know covering the entire left every single days there or we can of the Senate declare its purity by throwing them out I'd rather win on the issues I think that that presupposes that Al Franken will do so much damage that it will actually help the progress agenda and all that which I don't know that there's necessarily enough evidence for that at this point but secondly that's a very utilitarian approach to that and I would disagree with that from a from an integrity perspective to say we're guard list of what that does to the g.o.p. Agenda we need to be concerned about consequences and about and following we're the truth ultimately leads and recognizing that the rules of the Senate do provide for this and even though yeah you get some characters in there that are that are bad actors there's not always enough evidence or enough reason to expel them here it's pretty clear Well let's say that a state and believe me I think Al Franken is awful I mean an awful c. Understatement of the millennium in so many different ways even without this kind of behavior he's awful in lots of other ways but let's say a state that's a very prominent state elected somebody who had been a convicted rapist and they elected that person because the people of that state felt that individual had had reformed and had you know found God I say that in a sincere way and it changed his life with the Senate then have a right to throw that rapist out convicted admitted rape I think there's a difference between. Someone's passed and having already gone through due process than having an allegation come out now and there are allegations that he tapped this kind of conduct while he was in the Senate and so that changes the analysis and so you can't just say well if there's one misdeed in the past and I'm not meaning to minimize people who are convicted of those types of grievous sexual assault but having gone through and reform have paid your debt to society that shouldn't be held against you forever that's a very very fundamentally different than having these allegations while he was a senator coming up but let's say and I want to get to the phone lines but let's say that Al Franken Al Franken he goes before this committee where again most claims just go to die allegations he goes before the committee they find Yeah he is guilty of a b. C. And d. And then Franken says but I've reformed I've apologized look at the polls in my 30 days and they don't want me to leave at that point of the Senate still thrown out in order to vindicate the purity of the Senate I would say at that point yes because you're going through due process right there is a measure of the Senate it's not talking about something that happened prior to the persons allegedly and then you will different We'll come back and apply it to write more because even though you and I have a different view of him perhaps in general at the same time I've always felt if the people of Alabama elected him you know at that point it would be wrong for the Senate to expel him but to add to the phone lines the lovely Karen here with Dan and Jenna $710.00 can us Hey Karen Hi Karen Hi Dan it's Phil Long time since I called you and you really got me going Hi Jenna Hi It was wonderful and fascinating conversation to hear.
