The recall effort folks say this is a county matter but the judge is arguing this really is for the state to decide because as the judge he is a state worker. Now judge aaron persky has been the subject of a recall effort as you mentioned almost from the moment he sentenced former stanford swimmer brock turner to just six months in jail instead of prison for the Sexual Assault of an unconscious woman. It was said to be too lenient and showed deference to the attacker rather than the victim. The attorney general will make the argument that the recall effort against persky is a county matter and not one for the secretary of state as persky argued. There is a restraining order granted on behalf of judge persky forcing the recall effort to be on hold while this is decided. Now if this is deemed to be a matter rather than a county matter, then the whole recall effort starts from the beginning. Although the proponents of the recall say this is just a temporary pause. And breaking overnight out of pennsylvania more than 40 people are hurt this morning after two highspeed commuter trains collide earlier this morning. This all happened west of philadelphia. Authorities say one of those trains was heading into a station in upper darby when it hit a parked, unoccupied train. Everyone onboard is expected to survive but the passengers are no doubt shaken. An audit of levis stadium finances shows the team owes nearly 2 million to the city. And today in the bays bob redell is live this morning with what the mayor is saying about the audit and how that team responded within the past few minutes. Bob. Reporter good morning. Yes, the 49ers just released a statement within the past three minutes that we received and they said that audit says they owe nearly 2 million to the city of santa clara is riddled with errors. However, we did speak with mayor lisa gilmore of santa clara within the mast 9 past 90 minutes and she expects the 49ers to be put on 30 days notice starting this thursday to pay up that money or face legal action. Yesterdays release of the final audit commissioned by the city made 37 findings including that the 49ers owe santa clara nearly 2 million, about 900,000 for public safety, construction fund, about 800,000 for parking on city owned golf course across from levi stadium, and about 200,000 in unreimbursed. They are in violation of measure j which prohibits taxpayer money being spent on stadium events. Mayor gilmore says her city has to fix the way theyre doing business and managing levi stadium, tells me that the first step will be to hire someone with Stadium Management experience. Santa clara was illprepared. Were changing things and were fixing it right in the beginning of theship. I am very confident that once we do fix the problem we will have much smoother sailing knowing santa clara taxpayers are protected and the stadium is properly managed and operated. And it says the city of santa clara wasted over 200,000 in public funds to discover the city of santa clara failed to bill 150,000 in expenses, something that was their responsibility. The issue, the eled lead level gained National Attention because of the crisis in flint, michigan. Here in california one proposed bill would urge doctors to ask more questions to assess a familys risk of lead exposure. The Health Department would be held at a higher standard when it comes to reporting that data. Another bill would require School Districts to test water for lead and fix any contamination. And in flint the cdc says 5 of kids under the age of 6 had elevated lead levels.
