All lanes of southbound 280 reopened in the last half hour following a deadly Chain Reaction crash caused by a drunk driver. It happened around 2 30 this morning near mclaughlin avenue in san jose. Police say the drunk driver was speeding when he rear ended a car, forcing it to roll over and hit a third car which crashed against the guardrail and burst into flames. Good samaritans and first respondered try to free that driver from his car. Many people did go to the driver of the honda and try to get him out of the vehicle. Unfortunately, their attempts were unsuccessful. By the time the Fire Department arrived, the flames were too much to overcome. The person inside the car that rolled over is expected to survive. The drunk driver is being treated at the hospital and later this morning will be booked on drunk driving charges. We are following a developing story in the east bay. Police are reviewing Surveillance Video searching for who shot and killed a man and left him inside a running car. Police found the mans body in the car yesterday morning parked at a strip mall in newark. The 28yearold victim was said to have worked at a barber shop just across the street. Witnesses found him slumped behind the Steering Wheel and tell us theyre shocked to see this happen in their city in broad daylight. To see this, a little quiet town. You know, and stuff like this doesnt happen. The victim had sustained a gunshot wound to the head and died on scene. Police tell us this is not a random murder. According to crime data, the city of newark averages just one homicide per year. A High School Teacher and a student arrested for an alleged drug and theft scheme. Police say the teacher at Benicia High School was giving her car keys to the student during school hours and then that 17yearold was stashing stolen items inside the car. Police say marijuana edibles also were found inside the teachers car. That teacher, 23yearold rihanna lane, admitted to the crimes and was released on a citation. The student was arrested and then released to his parents. Women at stanford are on heightened alert after two sexual batteries on campus that happened just 20 minutes apart. Both attacks happened idfrieth non on escondido road. The first attack happened at 10 40 p. M. Near the frexman dorms and upper class housing. A bald white man groped a woman from behind while she was walking. 20 minutes later, a few blocks away on the same street, a female jogger was groped from behind by a man with the same description. Disturbing to hear it happened so close to where we live. Especially because i usually walk these streets around that time, and i crucially feel pretty safe, but now after i have to sort of rethink that. Stanford university sent out a text warning students about those attacks. Sheriffs deputies and the Campus Department of Public Safety are doing extra patrols in that area. Four homes were red tagged. A few blocks away, a tree smashed into a house while the family was still inside. That home was considered a total loss. And now with more rain to come, residents are preparing for more danger and damage. There are a lot of trees around here and a lot of water coming down. And we love the trees. But this is scary. No one was injured in the recent storms, but mud continues seeping into those red tagged homes. An oil spill from a sunken barge in the San Francisco bay now looks to be contained. The coast guard says 3,000 feet of boons are keeping an oil slick on the surface of the water where crews can clean it up. Under the water, divers say the plugs used to stop more diesel from pouring out of the barge is holding well. We have not seen any further sheen, so it appears the plugging operation was successful. Fortunately, the immediate pollution threat has largely been contained. Now were doing a survey. Detailed survaives, both dive and sight scan sonar to understand exact positioning of the barge piece under the water. Even though theres a fairly healthy population there, they really need to know where these bears are going and if theyre interacting with humans too much, then we have issues. Specifically more along the north bay and the coast. So that storm, as we head into tonight and into monday, could bring the chance of seeing a few showers. As we head into wednesday, we see an additional storm system, and thats going to bring some breezy evening rain. Were definitely expecting a big change in the weather pattern as we head into thursday, expect to keep the rain early on. This could dramatically change the landscape for renters and land lords in San Francisco. A new law was launched. Supervisor mark ferrell announced the legislation to make it easier for renters to prove that their landlords are wrongfully trying to evict them. The local mec bay area Investigative Unit produced a report that specifically looked into owner movein evictions and potential unlawful evictions. They did some great shoestring journalism. Bigad shaban exposed what appeared to be widespread abuse by landlords. He explained how the proposed law could impact a lot of people. If you have been under rent control for while in San Francisco, your landlord could be making a lot more in rent by kicking you out and bringing in a brandnew tenant. That would be illegal, but we discovered criminal charges are almost unheard of. After months of investigating, we discovered people in San Francisco are getting kicked out at an alarming rate. Put your names on it, and then open the books. Longtime teacher nicole said talk of the bay areas housing crisis hassen reached her fourth grade classroom. Shes overheard students and their families chatting about soaring rent and the fear of being evicted from their rentcontrolled apartments. How often would you hear parents talking about this . Regularly. But it still came as a shock when those fears became her reality. Nicoles San Francisco apartment was sold to a new owner. Who decided to evict nicole about a year later. Theres not a day that go said by that i dont miss it. What was the reason your landlord gave for evicting you . His broernl was going to move in. Here in San Francisco, its perfectly legal for homeowners to kick out tenets so they can move in. Once those landlords live in the building, they can also evict other tenants to make room for their relatives. Its called an owner movein eviction. And San Francisco is home to 413 of them last year. Thats a 200 spike from just five years ago. Theyre really spread out all over the place. Our Investigative Unit spent six months going door to door, to find out if landlords really moved in after evicting their tenants. We interviewed more than 100 people, and in 24 cases, thats nearly 1 in 4 of all the evictions we looked into, the landlord orfamily member was not living in the home. An apparent violation of the citys housing laws. No one tolerates fraud. San francisco supervisor mark ferrell is one of three lawmakers now proposing new laws to fight illegal evictions. The changes would make it easier for the District Attorneys Office to file criminal charges against landlords who wrongfully try to kick out tenants. Our recent investigation revealed that over the past ten years, the d. A. s office hasnt prosecutored a single landlord for abusing these kinds of evictions. It was the great work on nbc that really turned up the volume, i think. Really talked about and identified and exposed the amount of fraudulent practices that are happening in this area. Ferrells legislation would also require landlords and their relatives to submit proof of residency after they move in like a an electric bill or voter registration. Right now, they dont have to provide any of that, which left nicole skeptical she was only paying 1450 for her onebedroom apartment. Some people above me who had moved in were paying 3,000 for the exact same unit. I wondered if there was any ulterior motive. To find out, nicoles only option was to sue her landlord, which meant her attorney got to question the brother inlaw to see if he knew anything about it. When questioned by nicoles attorney, the brotherinlaw couldnt answer basic questions. Have you ever been told about the layout . No. How many bedrooms it is . No. He hadnt seen the unit before moving in. Mark is nicoles lawyer. I think this is a way that landlords are circumventing the rules to maximize their profits. He ultimately won nicoles case. She wont reveal how much she was awarded, but says no amount of money makes up for being forced out of her home. It was one of the worst experiences of my life. Nicole says she couldnt afford to stay in the city. She now lives across the bay in alameda but believes more oversight could have kept her out of court and in San Francisco. Her home of 15 years. Until the laws are changed to protect us, its going to continue. Supervisors aaron pesken and jane kim are now pushing another piece of legislation that also aims to make it easier to slap landlords with fines and criminal penalties if they wrong fame kick out tenants in order to charge new tenants a lot more in rent. Deferred maintenance for state and local roads and highways. Thats almost as much as the annual state budget. So the states roads rank 49th of the 50 states and are so poor that road related car repairs, and i think almost everybody can identify with this, road related car repairs cost california drivers twice the national average. Because of these miserable conditions, brown and the Legislature Passed this very important legislation. That seems like a nobrainer, of course, but why wouldnt they pass anything to fix the roads . It always simes like a nobrainer, but the factors you dont consider. California is a hightax state. Were among the highest in income taxes, sales taxes and rank ninth in gasoline taxes. The cost of living in california is also among the highest in the national. You put all these things together for all these reason and more. Many voters resist the idea of new taxes and that was the challenge for brown and the legislature. That makes sense. You had talked about a deferred maintenance issue. What led to that . Oh, gosh. Since we last passed a gasoline tax, the fuel efficiency of cars in california has increased by 25 . That means less gas consumed and fewer tax dollars as a result. Also, the states population has grown by 30 since 1994. Thats led more drivers to be on the same roads. And finally, the increaseds of hybrids and electric cars in california, all a good thing, but it means these vehicles use little or no gasoline, yet they travel the same roads. So you put this all together, and we have more cars using less gasoline on the same roads, which require more repairs with less money available. Thats the formula. Right, so then why was it so difficult for the legislature to pass this . Well, we already discussed the fact that were a hightax state. That antitax attitude of many californians is paramount. In addition, the state legislature has the highest vote requirement in the nation for passing tax increases. Its two thirds of the member in each chamber. Thats why Governor Brown had to work so hard to convince legislators in the more conservative parts of the state to go along. In some cases. He agreed to special allocations for thes to get their vote. Is that var . Special allocations for those districts . People can debate whether its fair, unfair, but its politics. Its politics at its core. Browns thinking was Something Like this. If i have to direct nearly a billion dollars in special road projects to get more than 50 billion in revenues over the next ten years, its worth it. Thats what he decided. And his term is ending, coming up. What does this say about his legacy . This has been a story, a story of stories considering the contrast between the first and second time. Only time will tell how brown is viewed by future generations, but we know this. Jerry brown over the last six years has been a much different leader than when he was governor between 1974 and 1982. Then, he was a take it or leave it guy who offended legislators left and right. 35 years later, this guy now knows how to work a room. Well, you know, sometimes it takes a Second Chance to do that. And even in the north bay, also waking up to the 30s, which is why there are some frost advisories in the north bay that are set to expire at about 8 00 a. M. So the next five minutes, were expecting to warm up nicely. Also in the north bay. San francisco, 44 degrees right now. Heres a quick check of what you can expect for today. We will be climbing into the upper 50s along the coastline. San francisco, 58 half moon bay, 57. And areas in the north bay, 62. For napa, 63. For santa rosa, and we take you down to the east bay, oakland, 61. And for the south bay, also in the 60s. San jose, a high of about 64 degrees. Doppler radar right now is looking pretty good. Were not seeing too much cloud cover. We saw just some hazy skies overnight. But over the next 24 hours, we do still have a chance of seeing slight showers. More along the areas in the north bay that because were expecting to see a storm system sitting off the Pacific Northwest. Thats going to bring in showers overnight into tomorrow morning. If you live in the north bay or along the coastline, theres a chance you might catch showers in the Early Morning commute. Were tracking an additional storm system on wednesday night into thursday morning. Thats going to start kicking up those breezy conditions becoming more widespread through wednesday night into thursday. But for the most part, it still looks like its going to be heavily focused on the north bay. On thursday, we are expecting to see the rain become more widespread, making for a very wet thursday ahead. Lets check your day planner. All in all, its going to be a very great, sunny day.
